HomeMy Public PortalAbout011-2006 - authorizing an easement on property to RPL-JohBOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA RESOLUTION NO. 11 -2006 A RESOLUTION AUTHORIZING THE GRANTING OF EASEMENTS WHEREAS, The Board of Public Works and Safety of Richmond, Richmond, Indiana ( "Board ") is the disposing agent for real property owned and to be transferred or acquired by the City of Richmond, Indiana ( "City ") pursuant to the provisions of Indiana Code (IC) 36 -1 -11, et. Seq. (the "Act "); and WHEREAS, The City of Richmond, Indiana, wishes to grant an easement on the following described real estate to Richmond Power & Light ( "RP &L): a) An easement real estate described in the attached Exhibit A, Easement Tract B, consisting of approximately 1.419 acres, more or less; and b) An easement on real estate described in the attached Exhibit A, Easement Tract C, consisting of approximately 0.733 acres, more or less; and C) An easement on real estate described in the attached Exhibit A, Easement Tract D, consisting of approximately 0.294 acres, more or less; and WHEREAS, Richmond Power & Light, a municipally owned utility company owned by the City of Richmond, Indiana, has a sub - station, known as the RP &L Johnson Street Sub - Station, located on real estate in the area where the easements described in Exhibit "A" are located; and WHEREAS, the management of Richmond Power & Light, is in need of the easements in Exhibit A for the effective management and operation of the Johnston Street Sub - Station; and NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works and Safety of Richmond, Indiana that said Board approves the granting of easements on the following described real estate from the City of Richmond, Indiana, to Richmond Power & Light, a municipally owned utility company owned by the City of Richmond, Indiana, in consideration of the mutual benefits to be gained by this transaction the following: 2 a) An easement real estate described in the attached Exhibit A, Easement Tract B, consisting of approximately 1.419 acres, more or less; and b) An easement on real estate described in the attached Exhibit A, Easement Tract C, consisting of approximately 0.733 acres, more or less; and C) An easement on real estate described in the attached Exhibit A, Easement Tract D, consisting of approximately 0.294 acres, more or less; and THIS RESOLUTION IS ADOPTED THIS day of November, 2006.
