HomeMy Public PortalAbout011-2007 resolution authorizing PURCHASEBOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA RESOLUTION NO. 11 -2007 A RESOLUTION AUTHORIZING THE PURCHASE OF REAL ESTATE WHEREAS, The Board of Public Works and Safety ( "Board ") is the disposing agent for real property owned and to be transferred or acquired by the City of Richmond, Indiana ( "City ") pursuant to the provisions of Indiana Code (IC) 36 -1 -11, et. Seq. (the "Act "); and WHEREAS, The City of Richmond, Indiana, by and through its Parks Department, has made an offer to purchase real estate located at 28 Waterfall Road, Richmond, Wayne County, Indiana, from Ludwig's Spring Grove Greenhouses, Inc. Said real estate, the legal description which is attached hereto and incorporated herein by reference as Exhibit "A ", is located within the city limits of Spring Grove, Indiana; and WHEREAS, On October 2, 2007, the Parks Department for the City of Richmond, Indiana, authorized the Parks Board to purchase the Ludwig's Spring Grove Greenhouses, Inc., located at 28 Waterfall Road, Richmond, Indiana, for One Hundred Forty -One Thousand Three Hundred Seventy -Five Dollars ($141,375.00), subject to a Phase I Site Assessment that revealed no significant environmental deficiencies or liabilities and also subject to an appraisal on the real estate that meets or exceeds the purchase price of the real estate; and WHEREAS, The Seller, Ludwig Spring Grove Greenhouses, Inc., is anxious to close on the sale of the real estate as soon as possible, with a closing date presently scheduled for Monday, October 15, 2007; and WHEREAS, The Board of Public Works and Safety of the City of Richmond is the entity that must approve the purchase of real estate on behalf of the City of Richmond; and NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF RICHMOND, INDIANA, that said Board approves the purchase of the real estate located at 28 Waterfall Road, Richmond, Indiana, from Ludwig's Spring Grove Greenhouses, Inc. for the total sum of $141,375.00, subject to the requirement of a Phase I Environmental Site Assessment that reveals no significant environmental deficiencies or liabilities on said real estate and also subject to an appraisal on said real estate located at 28 Waterfall Road, Richmond, Indiana, for an appraisal that meets or exceeds the purchase price of the real estate, and further subject to any other requirements necessary for the conveyance of said property as determined and approved by the Law Department of the City of Richmond. NOW FURTHER BE IT RESOLVED BY the Board of Public Works and Safety of Richmond, Indiana, that the Board President, Vicki Robinson, for and on behalf of the City of Richmond, Indiana, acting through its Board of Public Works and Safety of Richmond, Indiana, be authorized to sign any and all documents necessary or required to effectuate the purchase of, and closing on, the real estate located at 28 Waterfall Road, Richmond, Indiana from Ludwig's Spring Grove Greenhouses, Inc. to the City of Richmond. NOW FURTHER BE IT RESOLVED by the Board of Public Works and Safety of Richmond, Indiana, that the City Attorney, Walter S. Chidester, or the Assistant City Attorney, Kenyatta P. Cox, be authorized to take all other action necessary (including, but not limited to, signing any and all documents) to effectuate the purchase of, and closing on, the real estate located at 28 Waterfall Road, Richmond, Indiana from Ludwig's Spring Grove Greenhouses, Inc. THIS RESOLUTION IS ADOPTED THIS 11 DAY OF OCTOBER, 2007.
