HomeMy Public PortalAboutResolution 98-1872 PC" " " RESOLUTION 98- 1872PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY DECLARING ITS INTENT TO CONDUCT A PUBLIC HEARING TO DETERMINE THE EXISTENCE OF A PUBLIC NUISANCE FOR THE PROPERTY LOCATED AT 4846 CAMELLIA AVENUE. (SHRUBAR) (PN 98 -1) The Planning Commission of the City of Temple City does hereby resolve: WHEREAS, the Planning Commission of the City of Temple City finds that certain premises, within the City may be maintained contrary to the provisions of the Municipal Code of the City; and WHEREAS, the City staff recommends that a public hearing be held to ascertain whether or not a public nuisance exists, NOW, THEREFORE, the Planning Commission hereby declares its intent to hold a public hearing on February 24, 1998, to ascertain whether certain premises situated in the City of Temple City, State of California, known and designated as 4846 Camellia Avenue in said City, and more particularly described as Lot 59 of Tract 5342, Map Book 64 -92, Page 16 of maps in the Office of the Recorder, County of Los Angeles, State of California, constitute a public nuisance, subject to abatement by the City: SECTION 1. That the following conditions maintained on said property may exist contrary to the provisions of Section 4230 of the Temple City Municipal Code: 4230(A) - Buildings or structures which are structurally unsafe or which are not provided with adequate egress or which constitute a fire hazard; or which are otherwise dangerous to human life; or which in relation to existing use constitute a hazard to safety or health or public welfare by reason of inadequate maintenance, dilapidation or abandonment. 4230(D) - Premises maintained so as to constitute a fire hazard by reason of woods, rang overgrowth or accumulation of debris. 4230(E) - Buildings which are abandoned, boarded up, partially destroyed, or left unreasonably in a state of partial construction. 4230(G) - Broken windows constituting hazardous conditions and inviting trespassers and malicious mischief. Resolution 98- 1872PC Page 2 Property Nuisance Case No. 98 -1 4230(H) - Overgrown vegetation likely to harbor rats, vermin and other nuisances or causing detriment to neighboring properties or property values. 4230(L) - Attractive nuisances dangerous to children in the form of abandoned or broken equipment and neglected machinery. 4230(Q) - Neglect of premises to cause detrimental effect upon nearby property and property values. 4230(S) - Property maintained in such a condition as to become so defective, unsightly, or in such condition of deterioration or disrepair that the same causes depreciable diminution of the property values of surrounding properties or is materially detrimental to proximal properties and improvements. 4230(V) - Any building or structure which has been constructed or which now exists or is maintained in violation of any specific requirement or prohibition, applicable to such building or structure, of the building regulations of this City, as set forth in the Uniform Building Code or Uniform Housing Code, or of any law or ordinance of this State or City relating to the condition, location or structure of buildings. 4230(X) - Landscaping not being adequately maintained by reason of landscape material which is overgrown or landscape areas not kept free of debris and weeds. SECTION 2. That abatement by the following method(s) has been suggested: 1) Completion of the construction 2) Remove all trash, debris, abandoned or broken equipment and neglected machinery and overgrown vegetation from the property. SECTION 3. That the Secretary of the Planning Commission shall cause the owner of said premises to be served with appropriate notice in the manner prescribed by the Municipal Code. • • • " " " Resolution 98- 1872PC Page 3 Property Nuisance Case No. 98 -1 SECTION 4. That the Secretary of the Planning Commission shall cause said premises to be posted in the manner prescribed by the Municipal Code. SECTION 5. The Secretary shall certify to the adoption of this Resolution.
