HomeMy Public PortalAbout014-2007 resolution authorizing easementBOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA RESOLUTION NO. 14 -2007 A RESOLUTION AUTHORIZING THE PRESIDENT TO SIGN A UTILITY EASEMENT REGARDING REAL ESTATE WHEREAS, The Board of Public Works and Safety ( "Board ") is the disposing agent for real property owned and to be transferred or acquired by the City of Richmond, Indiana ( "City ") pursuant to the provisions of Indiana Code (IC) 36 -1 -11, et. Seq. (the "Act "); and WHEREAS, Indiana - American Water Company, Inc. (INAWC) is in need of a utility easement from The City of Richmond, Indiana, and needs both a Permanent Water Line Easement and a Temporary Construction Easement, and has made an offer to pay for said Permanent Water Line Easement, with said Permanent Water Line Easement and a Temporary Construction Easement, both described in Exhibit "A ". Both easements are located on or about Peacock Road in Richmond, Wayne County, Indiana. Said real estate is located within the city limits of Richmond. A copy of the map showing the Permanent Waterline Easement and the Temporary Construction Easement is shown in Exhibit `B "; and WHEREAS, A Utility Agreement needs to be entered into by and between the City and INAWC, a copy of which is attached hereto and incorporated herein as Exhibit "C "; and WHEREAS, INAWC is need of the utility easement for the purpose of installing, laying, operating, maintaining, inspecting, removing, repairing, replacing, relaying and adding to from time to time water pipe or pipes, together with all necessary fittings, valves, hydrants, meters, appurtenances and attached facilities, including service pipes and laterals to and connections for the transmission and distribution of water; and WHEREAS, INAWC is anxious to close on the utility easement to begin work as soon as possible on its water line on or about Peacock Road in Richmond, Indiana; and WHEREAS, The purchase price by INAWC to the City of Richmond for the Permanent Water Line Easement of .26 acres, more or less, is $1,150.00. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF RICHMOND, INDIANA, that said Board approves, subject to any requirements necessary for the granting of said utility easement as set forth in Exhibit "C ", with said requirements to be determined and approved by the Law Department of the City of Richmond, to grant the Permanent Water Line Easement and the Temporary Construction Easement on the real estate described in Exhibit "A" located at Peacock Road, Richmond, Indiana, and as shown on Exhibit `B ", to Indiana American Water Company, Inc. for the total sum of One Thousand One Hundred Fifteen Dollars and No Cents ($1,115.00) and other good and valuable consideration. NOW FURTHER BE IT RESOLVED BY the Board of Public Works and Safety of Richmond, Indiana, that the Board President, Vicki Robinson, for and on behalf of the City of Richmond, Indiana, acting through its Board of Public Works and Safety of Richmond, Indiana, be authorized to sign the Utility Easement set forth in Exhibit "C" granting the Permanent Water Line Easement and the use of the Temporary Construction Easement on the real estate set forth in Exhibit "A" and as shown on Exhibit "B" to Indiana American Water Company, Inc., and to sign any and all other documents necessary or required to effectuate the sale and granting of said utility easement to Indiana American Water Company, Inc. NOW FURTHER BE IT RESOLVED by the Board of Public Works and Safety of Richmond, Indiana, that the City Attorney, Walter S. Chidester, or the Assistant City Attorney, Kenyatta P. Cox, and Mayor Sally L. Hutton be authorized to take all other action necessary (including, but not limited to, signing any and all documents) to effectuate the granting of the Utility Easement described in Exhibit "C" and as shown on the real estate set forth in Exhibit "A" and as shown on Exhibit `B" from the City of Richmond to Indiana American Water Company, Inc. THIS RESOLUTION IS ADOPTED THIS 8 TH DAY OF NOVEMBER, 2007.
