OF THE CITY OF RICHMOND, INDIANA
RESOLUTION NO. 2 -2008
A RESOLUTION AUTHORIZING THE CONVEYANCE OF REAL ESTATE
WHEREAS, The Board of Public Works and Safety ( "Board ") is the disposing
agent for real property owned and to be transferred or acquired by
the City of Richmond, Indiana ( "City ") pursuant to the provisions
of Indiana Code (IC) 36 -1 -11, et. Seq. (the "Act "); and
WHEREAS, Indiana Code (IC) 36- 1- 11- 1(b)(20) allows for the disposal of
residential structures by a municipal corporation without
consideration to a nonprofit corporation that is organized to expand
the supply or sustain the existing supply of good quality,
affordable housing for residents of Indiana having low or moderate
incomes; and
WHEREAS, Habitat for Humanity of Greater Richmond, Inc. is such a
nonprofit corporation; and
WHEREAS, On November 7th, 2007, the Board of Public Works and Safety of
the City of Richmond passed Resolution No. 12 -2007 to purchase
residential real estate commonly known as 730 South 6 th Street,
Richmond, Indiana from the United States Department of Housing
and Urban Development ( "HUD ") for the nominal sum of One
Dollar; and
WHEREAS, On November 8 2008, the City of Richmond, Indiana acquired
title to such real estate from HUD; and
WHEREAS, It was the intent of the City of Richmond in acquiring such
property from HUD to make such property available for affordable
housing for Richmond residents, and after careful consideration, it
is the desire of the City of Richmond to convey said property,
without consideration, to Habitat for Humanity of Greater
Richmond, Inc. for such purposes. The real estate being conveyed
is legally described on the document that is attached hereto and
incorporated herein by reference as Exhibit "A "; and
WHEREAS, The Board of Public Works and Safety of the City of Richmond is
the entity that must approve the conveyance of real estate on behalf
of the City of Richmond.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS
AND SAFETY OF RICHMOND, INDIANA, that said Board approves the conveyance
of the real estate as described on Exhibit "A" to Habitat for Humanity of Greater
Richmond, Inc. from the City of Richmond, Indiana, as a donation, without
consideration.
NOW FURTHER BE IT RESOLVED BY the Board of Public Works and Safety of
Richmond, Indiana, that the Board President, Vicki Robinson, acting for and on behalf of
the City of Richmond, Indiana and acting through its Board of Public Works and Safety,
be authorized to sign the Deed conveying the real estate described and set forth in Exhibit
"A" to Habitat for Humanity of Greater Richmond, Inc., an Indiana not for profit
corporation, and to sign any and all other documents necessary or required to effectuate
the conveyance and transfer of the real estate as set forth in Exhibit "A ".
NOW FURTHER BE IT RESOLVED by the Board of Public Works and Safety of
Richmond, Indiana, that the Director of the Department of Metropolitan Development,
Tony Foster II, and /or Mayor Sally L. Hutton be authorized to take all other action
necessary, including, but not limited to, signing any and all documents, to effectuate the
conveyance, transfer and closing of the real estate described in Exhibit "A" from the City
of Richmond, Indiana to Habitat for Humanity of Greater Richmond, Inc.
THIS RESOLUTION IS ADOPTED THIS 7 TH DAY OF JEBRUARY 1 2008.

LEGAL
A strip of ground thirty -six (36) feet wide off of the entire south side of Lot number six
(6) of certain out lots laid out by Christian Schwegman. ALSO: A part of Lot Number
eight (8) of certain out lots laid out by Daniel Burgess, all in the South East Quarter of
Section (5), Township (13), Range (1) West, beginning at the south east corner of said lot
number six above described; thence south with Sixth Street 19 degrees west 6 feet 6'/2
inches; thence in a westerly direction to a point in the south line of said line of said lot
number six, 47 feet 8 inches west of the south east corner of said lot number six; thence
east along the south line of said lot number 6 to the place of beginning. All of the same
now being a part of the City of Richmond.
