HomeMy Public PortalAbout007-2010 - BOW - Accept conveyance of roadway Gaar Jackson.docBOARD OF PUBLIC WORKS & SAFETY CITY OF RICHMOND, INDIANA RESOLUTION NO. 7-2010 A RESOLUTION TO ACCEPT THE CONVEYANCE OF A PUBLIC STREET OR ROADWAY, RICHMOND, INDIANA WHEREAS, Pursuant to Indiana Code 36-9-6-4, the City of Richmond, by and through its Board of Public Works and Safety may purchase real property needed by the City for public use; and WHEREAS, The City of Richmond Department of Public Works wishes to obtain a certain 0.339 acre parcel of property near the intersection of Gaar Jackson Road and Round Barn Road for the Gaar Jackson Road road-widening project; and WHEREAS, The Department of Public Works has obtained an appraisal for the 0.339 acre parcel, in the amount of Three Thousand Three Hundred Ninety Dollars and Zero Cents ($3,390.00); and WHEREAS, Toschlog Farms, an Indiana Partnership, is the owner of record of the parent tract of real estate located at 1432 North Round Barn Road, Richmond, Indiana, 47374, and wishes to convey to the City of Richmond the 0.339 acre portion of that real estate for the road-widening project in consideration of the sum of Three Thousand Three Hundred Ninety Dollars and Zero Cents ($3,390.00); and WHEREAS, The 0.339 acre parcel is more particularly described on a Survey and Land Description (which Land Description references the parent tract as described in Instrument Number 1995007168), and is attached to the Special Warranty Deed, all of which is attached hereto and marked as Exhibit A; and WHEREAS, The City of Richmond, by and through Board of Works & Safety, wishes to accept the conveyance of the above-referenced 0.339 acre portion of real estate in order that the City can proceed with the above-referenced road-widening project; and WHEREAS, It is in the best interest of the City of Richmond that the Board of Public Works and Safety accept the attached Special Warranty Deed executed by Toschlog Farms, an Indiana Partnership as the owner of record of the above-referenced portion of real estate, which Deed is attached hereto and marked as Exhibit A. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY, that the City of Richmond, by and through its Board of Public Works, will accept the attached Special Warranty Deed executed by Toschlog Farms, an Indiana Partnership for the 0.339 acre parcel of real estate located near the intersection of Round Barn Road and Gaar Jackson Road in order that the real estate may be conveyed, used, and dedicated as a street or roadway for public use and in order that the City can proceed with the above-referenced road-widening project; and NOW, THEREFORE, BE IT ALSO RESOLVED that the City of Richmond authorizes the payment of an amount not to exceed Three Thousand Three Hundred Ninety Dollars and Zero Cents ($3,390.00) to Toschlog Farms, an Indiana Partnership as the purchase price paid in consideration for the conveyance of the 0.339 acre parcel of property near the intersection of Gaar Jackson Road and Round Barn Road for the Gaar Jackson Road road-widening project; and NOW, THEREFORE, BE IT ALSO RESOLVED that Greg Stiens, as the City’s Director of Public Works, shall be authorized to obtain closing services with closing costs to be paid for out of redevelopment TIF funds, and execute any and all documents associated with such conveyance.
