HomeMy Public PortalAbout016 2010 - EDC - land transfer.docBOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA RESOLUTION NO. 16-2010 A RESOLUTION AUTHORIZING THE TRANSFER OF LAND WHEREAS, The Board of Public Works and Safety of Richmond, Indiana (“Board”) is the disposing agent for real property owned and to be transferred or acquired by the City of Richmond, Indiana (“City”) pursuant to the provisions of Indiana Code (IC) 36-1-11, et. Seq. (the “Act”); and WHEREAS, Richmond Power & Light is the owner of certain real estate located on N.W. 11th Street, Richmond, Indiana, of approximately 15.030 acres, more or less, with said real estate described in Exhibit “A”, attached hereto and made a part of this Resolution 15-2010 as Exhibit “A”; and WHEREAS, On November 15, 2010, the Board of Directors of Richmond Power & Light passed a resolution, Resolution 5-2010, authorizing the transfer to the City of Richmond of the real estate described in Exhibit “A”; and WHEREAS, On November 15, 2010, at a meeting following the meeting of the Board of Directors of Richmond Power & Light, the Common Council of the City of Richmond passed Ordinance 50-2010, authorizing, for One Dollar ($1.00) and other valuable consideration, the transfer to the Economic Development Corporation of Wayne County, Indiana of the real estate legally described in Exhibit “A”; and NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works and Safety of Richmond, Indiana that said Board approves the transfer of the land described in attached Exhibit “A" to The Economic Development Corporation of Wayne County, Indiana for the sum of One Dollar ($1.00) and other valuable consideration, the receipt of which is hereby acknowledged. NOW FURTHER BE IT RESOLVED BY the Board of Public Works and Safety of Richmond, Indiana, that the Board President, Vicki Robinson, acting for and on behalf of the City of Richmond, Indiana and acting through its Board of Public Works and Safety, be authorized to sign the Deed conveying the real estate described and set forth in Exhibit “A” to the Economic Development Corporation of Wayne County, Indiana, an Indiana not for profit corporation, and to take all action and to sign any and all other documents necessary or required to effectuate the sale and transfer of the real estate as set forth in Exhibit “A”. NOW FURTHER BE IT RESOLVED by the Board of Public Works and Safety of Richmond, Indiana, that Mayor Sarah L. Hutton and City Attorney Walter S. Chidester also be authorized to take all other action necessary, including, but not limited to, signing any and all documents, to effectuate the sale, transfer and closing of the real estate described in Exhibit “A” from the City of Richmond, Indiana to the Economic Development Corporation of Wayne County, Indiana. Board of Public Works and Safety of Richmond, Indiana S/S Vicki Robinson________________________ Vicki Robinson, President S/S Dian Lawson__________________________ Dian Lawson S/S Mary Jo Flood_________________________ Mary Jo Flood EXHIBIT “A” Being a part of Lot Number 2 in Richmond’s Northwest Industrial Park Section 2 in the Northeast, Northwest, Southeast and Southwest Quarters of Section 30, Township 14 North, Range 1 West in the City of Richmond, Indiana, and being more particularly described as follows: Commencing at an iron rod found at the northwestward corner of Lot Number 2 in said Richmond’s Northwest Industrial Park, Section 2, as recorded in Plat Book 11, page 546 in the Office of the Wayne County Recorder, Wayne County, Indiana, and also being on the northeastward right-of-way line of Northwest 11th Street, and running thence, south 44 degrees, 34 minutes and 30 seconds east, along the northeast right-of-way of said Northwest 11th Street and along the southwestward line of said Lot Number 2, 15.03 feet to an iron rod set at the beginning point of this description; and running thence, from said beginning point, north 49 degrees, 26 minutes and 00 seconds east, parallel to the northwestward line of said Lot Number 2, 979.95 feet to an iron rod set; thence south 40 degrees, 34 minutes and 00 seconds east, 685.00 feet to an iron rod set; thence south 49 degrees, 26 minutes and 00 seconds west, parallel to the northwestward line of said Lot Number 2, 928.24 feet to an iron rod set on the southwestward line of said Lot Number 2, and being on the northeastward line of said Northwest 11th Street; thence north 48 degrees, 22 minutes and 44 seconds west, along a chord of a 420.00 foot radius curve to the right in said northeastward line, a chord distance of 55.73 feet to an iron rod found at the point of tangency of said curve; thence north 44 degrees, 34 minutes and 30 seconds west, along the northeastward line of said Street and the northwestward line of said Lot Number 2, 631.32 feet to the place of beginning, containing an area of 15.030 acres. SUBJECT TO: Any easements of record. AND SUBJECT TO: An easement strip of 15.00 feet in width off the entire northeastward and southeastward lines of said tract, for the use of public utilities.
