HomeMy Public PortalAboutResolution 98-1877 PC" RESOLUTION NO. 98- 1877PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY APPROVING MODIFICATION OF CONDITIONAL USE PERMIT 73 -389 AND ZONE VARIANCE 98 -1335, A REQUEST BY IN -N -OUT BURGER TO ALLOW THE CONSTRUCTION OF AN 8 FOOT HIGH MASONRY WALL (INSTEAD OF A 6 FOOT HIGH BLOCK WALL) IN THE GENERAL COMMERCIAL (C -2) ZONE. (IN -N -OUT BURGER) The Planning Commission of the City of Temple City does hereby resolve: SECTION 1. Based upon a public hearing for the above Modification of Conditional Use Permit and Zone Variance and not to determine, if a public nuisance exists, the Planning Commission finds: MODIFICATION OF CONDITIONAL USE PERMIT 1. That the site for the proposed use is adequate in size, shape, topography and circumstances in that the subject property is a corner site with a total square footage of 13,040 and no new building square footage is proposed; and 2. That the site has sufficient access to streets and highways, adequate in width and pavement type to carry the quantity and quality of traffic generated by the existing use in that Lower Azusa Road is a primary arterial with 80 feet of right -of -way and 64 feet of road way; and 3. That the existing use will not have an adverse effect upon the use, enjoyment or valuation of adjacent property or upon the public welfare in that the proposed application includes construction of a new block wall measuring 36 inches in height along the first westerly 30 feet; 6 feet in height along the next westerly 24 feet and 8 feet in height along the remaining 110 feet. ZONE VARIANCE 1. That there are exceptional and extraordinary circumstances or conditions applicable to the property which do not generally apply to other properties in the same zone in that the subject site contains a drive -thru restaurant with 164 feet of frontage on Lower Azusa Road and 80 feet of frontage on Doreen Avenue. The property is level in grade and rectangular in configuration and is improved in a similar manner as other commercial properties in the immediate area; and 2. That such a variance is necessary for the preservation and " enjoyment of a substantial property right possessed by other properties similarly situated, but which is denied to the property in question in that other commercial properties that border residential zones have similar block walls; and Resolution No. 98- 1877PC Modification of Conditional Use Permit 73 -389 Zone Variance 98 -1335 Page 2 3. That the granting of the variance will not be materially detrimental to the public welfare or injurious to adjacent neighboring properties in that granting approval of a new block wall along the westerly and easterly property line would provide visual relief and mitigate noise from the business; and 4. That there are special circumstances as provided' in Section 65906 of the California Government Code in that the subject property is similar to other commercial properties that border residential neighborhoods throughout the City. SECTION 2. This project is Categorically Exempt from an environmental review in accordance with the State CEQA guidelines. SECTION 3. Accordingly, Modification of Conditional Use Permit 73 -389 and Zone Variance 98 -1335 is approved, subject to the following conditions: 1. Submitted plans shall be in substantial compliance with the adopted conditions of approval. 2. The westerly 30 feet of the proposed wall shall be 36 inches in height; the next 24 feet shall be 6 feet in height; the remaining 110 feet of the proposed wall along the northerly property line shall be 8 feet in height; and the 80 feet along the easterly property line with the exception of the first 18 feet shall be 6 feet in height. 3. The construction of the new block wall as approved herein shall include the replacement of the existing block wall; the proposed wall along the northerly and easterly property line shall be reinforced masonry and shall be in conformance with all applicable sections of the Uniform Building Code. 4. A survey shall be conducted to determine the location of the property line. If agreement cannot be reached where to place the wall, the wall shall be constructed on the property of In- N -Out Burger. 5. Obtain necessary permits for all construction and demolition work from the Building Department. 6. The construction of the new wall(s) along the northerly and easterly property lines shall begin within 30 days and construction shall be completed 60 days from the date of approval of this resolution. 7. The conditions of approval contained in this resolution may be enforced by the Sheriff's Office as well as City staff. Any violation of any condition is a misdemeanor and may be processed by criminal complaint. • • " " " Resolution No. 98- 1877PC Modification of Conditional Use Permit 73 -389 Zone Variance 98 -1335 Page 3 SECTION 4. The Planning Commission finds that this request by In -N -Out is an attempt to ameliorate the alleged nuisance. In granting this application, In -N -Out has admitted and agrees that this action is an attempt to modify the noise levels (it may or may not); it has nothing to do with the other elements of the pending nuisance determination. SECTION 5. The Secretary shall certify to the adoption of this Resolution.
