HomeMy Public PortalAbout007-2011 - Resolution APPROVING SALE of certBOARD OF PUBLIC WORKS & SAFETY CITY OF RICHMOND, INDIANA RESOLUTION NO. 7 -2011 A RESOLUTION TO APPROVE OF THE DISPOSAL OF REAL PROPERTY LOCATED IN NEIGHBORHOOD STABILIZATION PROGRAM (NSP) AREA (VAIL,E NEIGHBORHOOD) RICHMOND, INDIANA WHEREAS, The Board of Public Works and Safety ( "Board ") is the disposing agent for real property owned and to be transferred or acquired by the City of Richmond, Indiana ( "City ") pursuant to the provisions of Indiana Code (IC) 3 6 -1 -11, et. seq. (the "Act "); and WHEREAS, The City of Richmond previously acquired certain properties located in the geographic area known as the Neighborhood Stabilization Program (NSP) area, and more commonly known as the Vaile neighborhood, and has completed the rehabilitation of existing structures and new builds on vacant lots pursuant to NSP grant Guidelines; and WHEREAS, On August 15, 2011, the Common Council of the City of Richmond, Indiana by Ordinance Number 49 -2011, which Ordinance is incorporated herein by reference, approved the NSP Guidelines governing the sale of the NSP properties and authorized the Board of Works to conduct any required public hearings prior to the transfer of the properties; and WHEREAS, The public hearing for the sale of certain NSP properties as required by IC 36- 1 -11 -3 was conducted on October 13, 2011, and the notice of public hearing was published on October 2, 2011, in accordance with IC 5-3-1 - 2(b), and the proof of publication for said hearing is attached hereto as Exhibit "A "; and WHEREAS, It is in the best interest of the City of Richmond that the Board of Public Works and Safety approve of the disposals and conveyances of the NSP real properties that were the subject of the above - referenced required public hearing to eligible households in accordance with federal NSP Guidelines and, by this Resolution, notify the Mayor of the Board's recommendation herein; and WHEREAS, To comply with the federal NSP requirements, each of the real properties must be sold at a price less than or equal to their respective capped amounts as set forth in the Housing Economic Recovery Act of 2008 (Pub. L. 110 -289, approved July 30, 2008); and WHEREAS, It is in the best interest of the City of Richmond that the Department of Metropolitan Development and City of Richmond support staff proceed with the disposition activities required by both federal NSP requirements and Indiana Code including, but not limited to, obtaining appraisals, marketing, and the publication of the notice of the sale of the NSP real properties in order that the properties maybe sold to eligible households. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works and Safety of Richmond, Indiana, that said Board, having previously conducted the public hearing as required by IC 36- 1 -11 -3, hereby approves of the disposal of the real properties pursuant to the NSP Guidelines and pursuant to the NSP Disposition Procedures previously approved by the Common Council of the City of Richmond, Indiana, which properties are located at the following addresses in Richmond, Indiana: a. 217 South 6 th Street b. 239 South 7 th Street C. 417 South 7 th Street d. 625 South 7 th Street e. 333 South 10 Street f. 339 South 10 Street g. 135 South 11 Street h. 201 South 11 Street i. 224 South 11 Street j. 312 South 13 Street NOW, THEREFORE, BE IT FURTHER RESOLVED by the Board of Public Works and Safety of Richmond, Indiana, that said Board, pursuant to Indiana Code 36- 1 -11 -3, recommends to the Mayor of the City of Richmond that the above - listed properties be approved for conveyance in accordance with the NSP Guidelines in order that the Department of Metropolitan Development and the City administration may commence with conducting disposition activities including, but not limited to, obtaining appraisals, marketing, and the publication of the notice of sale of the above properties in accordance with IC 36- 1 -11 -4, in order that the Department of Metropolitan Development may begin receiving of offers from eligible households pursuant to NSP Guidelines. NOW, THEREFORE, BE IT FURTHER RESOLVED by the Board of Public Works and Safety of Richmond, Indiana, that each of the above properties be sold at a price less than or equal to their respective capped amounts which shall be, for each property, equal to or less than the cost to acquire and redevelop or rehabilitate such home or property up to a decent, safe, and habitable condition plus transaction (escrow and title) costs and carrying costs, which shall include but not be limited to taxes, insurance, maintenance, marketing, overhead, and interest, pursuant to the NSP federal requirements. NOW, THEREFORE, BE IT FURTHER RESOLVED by the Board of Public Works and Safety of Richmond, Indiana, that the Mayor, the Director of the Department of Metropolitan Development, the Director of the Department of Finance, the Deputy Director of the Department of Finance, the Community Development Specialist, the President of the Board of Public Works and Safety, the City Attorney, and /or the Assistant City Attorney be authorized to sign and /or take all other action necessary including but not limited to, signing any and all documents required to effectuate the conveyance and transfer of the above - listed real estate in accordance with federal NSP provisions.
