RESOLUTION 1 -2012
A RESOLUTION ACCEPTING THE DEDICATION OF A CERTAIN PORTION OF
N.W. N STREET, AND /OR THE PARCELS MAKING UP SUCH ROADWAY, FROM
THE APPLICABLE PROPERTY OWNERS
WHEREAS, The Board of Public Works and Safety ( "Board ") is the disposing agent for real
property owned and to be transferred or acquired by the City of Richmond,
Indiana ( "City ") pursuant to the provisions of Indiana Code (IC) 36 -1 -11, et. Seq.
(the "Act "); and
WHEREAS, in or about the years 2001 and 2002 a new roadway was constructed according to
City specifications and standards adjacent to and running westerly from N.W. 11th
Street to the Holland Colours of Americas Inc. property, by the relevant property
owners in conjunction with development of certain lots owned at the time by the
community organization, Industries, Inc; and
WHEREAS, since the time of its original construction, the above roadway has been given the
name of N.W. "N" Street; has been maintained by the City of Richmond; and has
been for all purposes treated as a local street by the City and the affected property
owners; and
WHEREAS, it has been the belief by the property owners upon which the street is located that a
prior public dedication of N.W. "N" Street running westerly from N.W. 11 Street
to the Holland Colours of Americas Inc. property had already occurred; however,
upon further investigation, it has been determined that no dedication has yet
occurred and the roadway remains part of the various real estate parcels located
adjacent to the north side of N.W. N Street running westerly from N.W. 11 Street
to the Holland Colours of Americas Inc. property; and
WHEREAS, some of the relevant property owners, to -wit: FHS Partners, LLC; AACC
Industries, Inc and R132, LLC have all expressed their willingness to provide
Deeds of Dedication upon their respective parcels of real estate in order for N.W.
N Street, as described above, to finally become a dedicated public roadway; and
WHEREAS, the specific parcels, and the descriptions establishing the roadway, are more
specifically set forth in the copies of deeds and drawing attached to this
Resolution; and
WHEREAS, it is within the power of the Board of Public Works and Safety to accept
dedications of public roadways and /or right of ways; and
WHEREAS, it is in the best interest of the City of Richmond to accept N.W. N Street running
westerly from N.W. 11 Street to the eastern edge of the Holland Colours of
Americas Inc. property as a public roadway.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS AS
FOLLOWS:
1. The signed and executed Deeds of Dedication submitted by the following
property owners, as owners of properties making up N.W. N Street running westerly from N.W.
11 Street to the eastern edge of Holland Colours of Americas Inc. property, to -wit:
a. FHS Partners, LLC
b. AACC Industries, Incorporated
c. RB 2, LLC
which properties are more specifically identified in the Deeds and Drawing attached to this
Resolution, are hereby accepted by the City of Richmond, subject to the proper recording of said
documents in the Wayne County Recorder's office.
2. The City of Richmond accepts the dedication and ownership of the parcels
described above within such Deeds, so long as all the above - described property owners properly
execute the required documents; agrees to the terms therein; and makes such properties a part of
the City of Richmond street organization.
3. The executed Deeds shall be recorded in the office of the Wayne County
Recorder, with the costs of recording to be paid by the above - described property owners.
4. Any affected department of the City of Richmond is hereby authorized to take any
and all action necessary in order to implement the terms of this Resolution.
This Resolution is duly passed and adopted this _ 3 rd _ day of February, 2012.
