HomeMy Public PortalAbout007-2012 - APROVING TRANSFER of certain nsp-BOARD OF PUBLIC WORKS & SAFETY CITY OF RICHMOND, INDIANA RESOLUTION NO. 7 -2012 A RESOLUTION TO APPROVE OF THE TRANSFER OF REAL PROPERTY LOCATED IN NEIGHBORHOOD STABILIZATION PROGRAM (NSP) AREA (VAIL,E NEIGHBORHOOD) RICHMOND, INDIANA TO THE HOUSING AUTHORITY OF THE CITY OF RICHMOND, INDIANA WHEREAS, The Board of Public Works and Safety ( "Board ") is the disposing agent for real property owned and to be transferred or acquired by the City of Richmond, Indiana ( "City ") pursuant to the provisions of Indiana Code (IC) 3 6 -1 -11, et. seq. (the "Act "); and WHEREAS, The City of Richmond previously acquired certain properties located in the geographic area known as the Neighborhood Stabilization Program (NSP) area, and more commonly known as the Vaile neighborhood, and has completed the rehabilitation of existing structures and new builds on vacant lots pursuant to NSP grant Guidelines; and WHEREAS, On June 6, 2010, the Board of Public Works and Safety approved a Memorandum of Intent to Transfer Property (Contract No. 82 -2010) with the Housing Authority of the City of Richmond (also commonly known as the Richmond Housing Authority or "RHA ") in order that the City may transfer some of the NSP properties to RHA; and WHEREAS, In accordance with IC 36- 1- 11- 1(b)(20) and with IC 36- 1 -11 -8 the City of Richmond wishes to transfer two (2) duplexes located at 524 -526 south 7th Street and at 601 -603 South 7 Street to the Housing Authority of the City of Richmond, Indiana, which duplexes were rehabilitated in order that affordable housing (for families whose income is at or below 50% of the area median income) could be provided as pledged in the City's NSP grant application; and WHEREAS, It is in the best interest of the City of Richmond that the Board of Public Works and Safety approve of the transfer of the above - described duplexes to the Housing Authority of the City of Richmond, Indiana. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works and Safety of Richmond, Indiana, that said Board hereby approves of the transfer of two (2) duplexes located at 524 -526 South 7 th Street and 601 -603 South 7 th Street to the Housing Authority of the City of Richmond, Indiana. NOW, THEREFORE, BE IT ALSO FURTHER RESOLVED by the Board of Public Works and Safety of Richmond, Indiana, that the Mayor, the Director of the Department of Metropolitan Development, the Director of the Department of Finance, the Deputy Director of the Department of Finance, the Community Development Specialist, the President of the Board of Public Works and Safety, the City Attorney, and /or the Assistant City Attorney be authorized to sign and /or take all other action necessary including, but not limited to, signing any and all documents required to effectuate the conveyance and transfer of the above - listed real estate in accordance with federal NSP provisions.
