HomeMy Public PortalAbout008-2012 - Resolution to purchase real estaBOARD OF PUBLIC WORKS & SAFETY CITY OF RICHMOND, INDIANA RESOLUTION NO. 8 -2012 A RESOLUTION TO PURCHASE REAL ESTATE LOCATED IN NSP -3 AREA (VAILE NEIGHBORHOOD) RICHMOND, INDIANA WHEREAS, The City of Richmond is the recipient of a Two Million Dollar ($2,000,000) Neighborhood Stabilization Grant (NSP -3) from the Indiana Housing and Community Development Authority; and WHEREAS, The City of Richmond wishes to acquire certain properties located in the geographic area known as the Neighborhood Stabilization Program (NSP) area, and more commonly known as the Vaile neighborhood, to proceed with the rehabilitation of existing structures and new builds on vacant lots pursuant to NSP grant guidelines; and WHEREAS, L.V. Baker, as the current owner (hereinafter "Seller ") of a certain property located at 216 South 10 Street in Richmond, Indiana, in the NSP -3 geographic area wishes to sell the property to the City of Richmond; and WEHREAS, The Seller has executed or will execute a Real Estate Purchase Agreement (Contract No. 65- 2012), which Agreement is attached hereto as Exhibit A, outlines the terms and conditions of the sale, and includes provisions that outline the negotiated additional good and valuable consideration of the satisfaction of any and all mortgages existing on the property as well as any outstanding tax warrants existing on the property; and WHEREAS, after careful consideration, it is the desire of the City of Richmond to proceed with the purchase of the property; and WHEREAS, Indiana Code 36 -9 -6 -4 permits and funding is currently available for the Board of Public Works & Safety to make the purchase of the stated properties. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY, that the City of Richmond agrees to execute the Purchase Agreement attached hereto as Exhibit A in order to purchase the property located at the addresses set forth below from the current owner, L.V. Baker, Seller, so that the City may use the property in connection with its NSP Program. NOW, THEREFORE, BE IT ALSO RESOLVED that Sally Hutton, Mayor, Vicki Robinson, President of the Board of Public Works and Safety, Tony Foster, Director of the Department of Metropolitan Development, Walter S. Chidester, City Attorney, Kimberly A. Vessels, Assistant City Attorney, or Sharon Palmer, as the City's Community Development Specialist, shall be authorized to execute any and all documents associated with the purchase of the below properties: Property Address Map Number State Parcel Number a. 216 South 10 Street 500413032000029 891804130320000030 Passed and adopted this _ 17 th day of May 2012, by the Board of Public Works & Safety.
