HomeMy Public PortalAbout010-2012 - Resolution to purchase real estaBOARD OF PUBLIC WORKS & SAFETY CITY OF RICHMOND, INDIANA RESOLUTION NO. 10 -2012 A RESOLUTION TO PURCHASE REAL ESTATE WHEREAS, The City of Richmond wishes to acquire certain properties located in the Vaile neighborhood, to permit greenspace areas to be created and located within said neighborhood; and WHEREAS, John Mueller, as the current owner (hereinafter "Seller ") of two (2) properties located at 132 South 11 Street and 133 South 11 Street, both in the Vaile neighborhood in Richmond Indiana, wishes to sell the properties to the City of Richmond and the total price to purchase said properties shall not exceed Twenty - five Thousand Dollars ($25,000.00) for purposes of Indiana Code (IC 36-1-10.5 - 1(b)(1); and WEHREAS, The Seller has executed or will execute a Real Estate Purchase Agreement (Contract No. 57- 2012), which Agreement is attached hereto as Exhibit A, outlines the terms and conditions of the sale, and includes provisions that outline the negotiated additional good and valuable consideration of the release or extinguishment of any and all weed liens currently existing on the stated properties and the payment of a default judgment currently existing against Seller; and WHEREAS, after careful consideration, it is the desire of the City of Richmond to proceed with the purchase of the properties; and WHEREAS, IC 36 -9 -6 -4 permits and funding is currently available for the Board of Public Works & Safety to make the purchase of the stated properties. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY, that the City of Richmond agrees to execute the Purchase Agreement attached hereto as Exhibit A in order to purchase the properties located at the addresses set forth below from the current owner, John Mueller, Seller, so that the City may create additional greenspace in the Vaile neighborhood. NOW, THEREFORE, BE IT ALSO RESOLVED that Sally Hutton, Mayor, Vicki Robinson, President of the Board of Public Works and Safety, Tony Foster, Director of the Department of Metropolitan Development, Walter S. Chidester, City Attorney, Kimberly A.
