A RESOLUTION FOR THE CITY OF RICHMOND, INDIANA TO
ACCEPT THE CONVEYANCE OF CERTAIN REAL ESTATE FROM THE
WHEREAS, The Board of Public Works and Safety of Richmond, Indiana (`Board ") is
the disposing agent for real property owned and to be transferred or
acquired by the City of Richmond, Indiana ( "City ") pursuant to the
provisions of Indiana Code (IC) 36 -1 -11, et. Seq. (the "Act "); and
WHEREAS, The State of Indiana ( "State "), owns real estate of approximately 2.704
acres located on the south side of Interstate 70 in Wayne County, Indiana,
that it wishes to sell to City, with said real estate being described in
Exhibit "A ", attached to this Resolution hereto and incorporated herein by
reference as Exhibit "A "; and
WHEREAS, State wishes to dispose of the real estate described in Exhibit "A" because
the State no longer has any need or use of said real estate and City will be
purchasing the real estate of approximately 2.704 acres; and
WHEREAS, State is selling the subject real estate described in Exhibit "A" to City for
the sum of $4,800.00 plus a Buyer's premium to Collier's International of
$144.00, for a total purchase of $4,944.00; and
WHEREAS, It is in the best interest of the City of Richmond to accept from State the
approximately 2.704 acres described in Exhibit "A ".
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS
AND SAFETY, that it authorizes the President, or her designee, of the Board of Public
Works and Safety of Richmond, expressly subject to title insurance that ensures
marketable title of the subject real estate to be conveyed to City, to execute any and all
documents to complete the transaction for the purchase of the real estate described in
Exhibit "A" of approximately 2.704 acres and including the Conditional Sales Agreement
with State and any and all required documents with the Conditional Sales Agreement and
any and all documents required to effectuate the purchase of said real estate.
BE IT FURTHER RESOLVED that the President, or her designee, of the Board of Public
Works and Safety of Richmond, Indiana, be, and hereby is, authorized to take all other
action necessary to effectuate the transfer the subject real estate described in Exhibit "A"
to the City of Richmond, Indiana.
This Resolution is duly passed and adopted this _eday of July, 2012.

feet; thence Southeasterly 353.8 feet along an arc to the left and having a radius of 68,624.9 feet

feet (bearing and distance quoted from Book 316, page 329) thence South 78 degrees 08 minutes
West 500.00 feet (gearing and distance quoted from Book 316, page 329); thence North 37 degrees
20 minutes West 232.6 feet (bearing and distance quoted from Book 316, page 329), thence North
79 degrees 00 minutes 38 seconds East 650.09 feet to the point of beginning and containing 2.704
acres, more or less.
Reserving unto the State of Indiana the right to control access to the INDOT Facility know as
Interstate 70 along the line described as 650.09 foot in the legal description above of a 2.704 acre
tract. This restriction shall be a covenant running with the land and shall be binding on all successors
in title to said abutting lands.
