A RESOLUTION APPROVING PURCHASE DONATION OF REAL ESTATE
AND ACCEPTING THE CONVEYANCE OF CERTAIN REAL ESTATE FROM
WILLIAM M. LEGEAR and MANDEE K. LEGEAR TO THE CITY OF
RICHMOND, INDIANA
WHEREAS, The Board of Public Works and Safety of Richmond, Indiana ( "Board ") is
the disposing agent for real property owned and to be transferred or
acquired by the City of Richmond, Indiana ( "City ") pursuant to the
provisions of Indiana Code (IC) 35 -1 -11, et. Seq. (the "Act "); and
WHEREAS, City is engaged in a project ( "Project "), number 0800343, for road
widening on Salisbury Road, Richmond, Indiana, and needs to acquire
certain real estate parcels for the Project; and
WHEREAS, William M. Legear and Mandee K. Legear ( "Legears ") own certain real
estate that abuts the current right -of -way of a portion of the Project on
Salisbury Road that is located within the incorporated area of the City; and
WHEREAS, The real estate know as Parcel 1 that Legears own that abuts the current
right-of-way of a portion of Salisbury Road is more particularly described
in Exhibit "A ", which is attached hereto to this Resolution and
incorporated herein by reference; and
WHEREAS, Legears are conveying Parcel I to the City for the price of $38,000.00 for
the real estate described in attached Exhibit "A "; and
WHEREAS, It is in the best interest of the City of Richmond to accept from Legears the
purchase price of $38,000.00 for the real estate known as Parcel 1 and
described in Exhibit "A ", as the acquisition of said real estate is essential
to the initiation and completion of the Project.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS
AND SAFETY OF RICHMOND, INDIANA, that the City of Richmond, by and through
its Board of Public Works and Safety, accepts the real estate known as Parcel 1 from
William M. Legear and Mandee K. Legear for the purchase price of $38,000.00 and
described in attached Exhibit "A" in order that the subject real estate may be used by the
City to initiate and complete the road widening Project on Salisbury Road, Richmond,
Indiana.
BE IT FURTHER RESOLVED that the President, or her designee, of the Board of
Public Works and Safety of Richmond, Indiana, be, and hereby is, authorized to take all
action necessary to effectuate the transfer from Willam M. Legear and Mandee K. Legear
to the City of Richmond, Indiana, of the subject real estate known as Parcel 1 and
described in Exhibit "A ".
This Resolution is duly passed and adopted this ll zay of February, 2013

A parcel of land situated in the Northeast Quarter of Fractional Section 22, Township 16 North, Range 14
East, Wayne County, State of Indiana, being described as follows:
Beginning at a 518" copper rod found and accepted as the apparent Southwest corner of the Fractional
Southwest Quarter of Section 36, Township 14 North, Range 2 West, Wayne County, Indiana said point
also being on the apparent easterly line of the aforesaid Fractional Section 22, the apparent intersection of
Salisbury Road (60' r /w) and West Main Street (70' r /w) and Line "A ", said point also being located at
F.O.T. Station 33 +48.81 of said Line "A ", P.O.T. Station 10 +00.00 Line "S -1 -A "and P.O.T. Station

P.O.T. Station 31 +50.68 Line "A ", being designated point #101 on the attached Right -of -Way Parcel Plat
(Exhibit B) and being located at the point of curvature of a 750.00 foot radius curve to the left, said curve
being concave westerly, having a chord bearing and distance of South 09 degrees 59 minutes 40 seconds
West, 55.15 feet respectively; thence run southwesterly along said curve, an arc distance of 55.17 feet, to
P.O.T. Station 30 +95.51 Line "A ", and being designated point #102 on the attached Right -of -Way Parcel
Plat (Exhibit B); thence North 82 degrees minutes 46 seconds West, 30.00 feet to an intersection with
the westerly right -of -way line of the aforesaid Salisbury Road at a point designated 9103 on the attached
Right -of -Way Parcel Plat (Exhibit B) and being located at the point of curvature of a 780.00 foot radius
curve to the right, said curve being concave easterly, having a chord bearing and distance of North 09
degrees 59 minutes 40 seconds East, 57.36 feet respectively; thence run northeasterly along said curve and
with said right- of-way line, an arc distance of 57.37 feet, to a point designated 9104 on the attached Right -
