A RESOLUTION APPROVING PURCHASE DONATION OF REAL ESTATE
AND ACCEPTING THE CONVEYANCE OF CERTAIN REAL ESTATE FROM
NEW LOOK PROPERTIES, LLC, TO THE CITY OF RICHMOND, INDIANA
WHEREAS, The Board of Public Works and Safety of Richmond, Indiana ( "Board ") is
the disposing agent for real property owned and to be transferred or
acquired by the City of Richmond, Indiana ( "City ") pursuant to the
provisions of Indiana Code (IC) 36 -1 -11, et. Seq. (the "Act "); and
WHEREAS, City is engaged in a project ( "Project "), number 0800343, for road
widening on Salisbury Road, Richmond, Indiana, and needs to acquire
certain real estate parcels for the Project; and
WHEREAS, New Look Properties, LLC ( "New Look ") owns certain real estate that
abuts the current right -of -way of a portion of the Project on Salisbury
Road that is located within the incorporated area of the City; and
WHEREAS, The real estate known as Parcel 3 that New Look owns that abuts the
current right -of -way of a portion of Salisbury Road is more particularly
described in Exhibit "A ", which is attached hereto to this Resolution and
incorporated herein by reference; and
WHEREAS, New Look is conveying to the City for the price of $3,400.00 the real
estate known as Parcel 3 and described in attached Exhibit "A"; and
WHEREAS, It is in the best interest of the City of Richmond to accept from New Look
the purchase price of $3,400.00 of the real estate known as Parcel 3 and
described in Exhibit "A ", as the acquisition of said real estate is essential
to the initiation and completion of the Project.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS
AND SAFETY OFRICHMOND, INDIANA, that the City of Richmond, by and through
its Board of Public Works and Safety, accepts the real estate known as Parcel 3 from
New Look for the purchase price of $3,400.00 and described in attached Exhibit "A" in
order that the subject real estate may be used by the City to initiate and complete the road
widening Project on Salisbury Road, Richmond, Indiana.
BE IT FURTHER RESOLVED that the President, or her designee, of the Board of
Public Works and Safety of Richmond, Indiana, be, and hereby is, authorized to take all
action necessary to effectuate the transfer from New Look Properties, LLC, to the City of
Richmond, Indiana,
Richmond, Indiana, of the subject real estate known as Parcel 3 and described in Exhibit

A parcel of land situated in the Northeast Quarter of Fractional Section 22, Township 16 North, Range 14
East, Center Township, Wayne County, State of Indiana, being described as follows:
Commencing at a 518" copper rod found and accepted as the apparent Southwest corner of the Fractional
Southwest Quarter of Section 36, Township 14 North, Range 2 West, Wayne County, Indiana; said point
also being on the apparent easterly line of aforesaid Fractional Section 22 and on Line "A" on the attached
right -of -way Parcel Plat (Exhibit B), said point also being P.O.T. Station 33+48.81 Line "A ", P.O.T.
Station 10 +00.00 Line "S-1 -A" and P.O.T. Station 10 +00.00 Line "S -2 -A" on the attached right -of -way
Parcel Plat (Exhibit B); thence North 10 degrees 28 minutes 54 seconds East, along said Line "A ", also
being the apparent centerline of Salisbury Road (a 60' r /w) and the apparent east line of said Fractional
Section 22, 179.65 feet, to P.O.T Station 35 +28.46 Line "A" on the attached Right -of -Way Parcel Plat

designated #100 on the attached Right-of-Way Parcel Plat (Exhibit B) and the Point of Beginning; thence
South 89 degrees 16 minutes 14 seconds West, along the apparent southerly line of said property, 30.62
feet, to an intersection with the apparent westerly right -of -way line of the aforesaid Salisbury Road (a 60'
r /w), said point being designated #101 on the attached Right -of -Way Parcel Plat (Exhibit B); thence North
10 degrees 28 minutes 54 seconds East, along said apparent westerly right -of -way line, I41.82 feet, said
point being designated #102 on the attached Right -of -Way Parcel Plat (Exhibit B); thence South 83 degrees
30 minutes 06 seconds East, 30.10 feet, to an intersection with the apparent easterly line of said property
and the aforesaid easterly line of said Fractional Section 22, said intersection point being located at P.O.T.
Station 36 +66.44 Line "A ", on the attached Right -of -Way Parcel Plat (Exhibit B), said point also being
designated #103 on the attached Right -of -Way Parcel Plat (Exhibit B); thence South 10 degrees 28 minutes
54 seconds West, along said apparent easterly line, and said Line "A ", also being the centerline of the
