A RESOLUTION FOR THE CITY OF RICHMOND, INDIANA TO
ACCEPT THE CONVEYANCE OF A PERPETUAL EASEMENT INTEREST IN
CONNECTION WITH CERTAIN REAL ESTATE FROM RICHMOND POWER
& LIGHT TO THE CITY OF RICHMOND, INDIANA
WHEREAS, The Board of Public Works and Safety of Richmond, Indiana (`Board ") is
the disposing agent for real property owned and to be transferred or
acquired by the City of Richmond, Indiana ( "City ") pursuant to the
provisions of Indiana Code (IC) 36 -1 -11, et. Seq. (the "Act "); and
WHEREAS, City is engaged in a project ( "Project "), number 0800343, for road
widening on Salisbury Road, Richmond, Indiana, and needs to acquire an
easement for a certain real estate parcel for the Project; and
WHEREAS, Richmond Power & Light ( "RP &L ") owns certain real estate that abuts
the current right -of -way of a portion of the Project on Salisbury Road that
is located within the incorporated area of the City; and
WHEREAS, The real estate consisting of approximately .212 acres known as Parcel 9
that RP &L owns that abuts the current right -of -way of a portion of
Salisbury Road is more particularly described in Exhibit "A ", which is
attached hereto to this Resolution and incorporated herein by reference;
and
WHEREAS, RP &L is granting to the City a perpetual easement interest in the real
estate consisting of approximately .212 acres, known as Parcel 9,
described in attached Exhibit "A "; and
WHEREAS, It is in the best interest of the City of Richmond to accept from RP &L the
conveyance of a perpetual easement interest of Parcel 9, consisting of the
approximately .212 acres, described in Exhibit "A ", as the acquisition of
said interest is essential to the initiation and completion of the Project.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS
AND SAFETY OF RICHMOND, INDIANA, that the City of Richmond, by and through
its Board of Public Works and Safety, accepts the conveyance of a perpetual easement
interest in the real estate known as Parcel 9, consisting of approximately .212 acres,
granted by RP &L and described in attached Exhibit "A" in order that the subject real
estate may be used by the City to initiate and complete the road widening Project on
Salisbury Road, Richmond, Indiana.
BE IT FURTHER RESOLVED that the President, or her designee, of the Board of
Public Works and Safety of Richmond, Indiana, be, and hereby is, authorized to take all
action necessary to effectuate the transfer from Richmond Power & Light of the perpetual
easement interest of the subject real estate known as Parcel 9, consisting of
approximately .212 acres, as described in Exhibit "A" to the City of Richmond, Indiana.
This Resolution is duly passed and adopted this 28 day of February, 2013.

A parcel of land situated in the Southwest Quarter of Fractional Section 36, Township 14 North, Range 2
West, Wayne County, State of Indiana, being described as follows:
Commencing at the apparent Southwest corner of the Fractional Southwest Quarter of Section 36,
Township 14 North, Range 2 West, Wayne County, Indiana; said point also being on the apparent westerly
line of aforesaid Fractional Section 36 and Line "A" on the attached right -of -way Parcel Plat (Exhibit B),
said point also being P.O.T. Station 33 +48.81 Line "A" and P.O.T. Station 10 +00.00 Line "S -1 -A" on the
attached right -of -way Parcel Plat (Exhibit B); thence North 10 degrees 28 minutes 54 seconds East, along
said Line "A ", and the apparent centerline of Salisbury Road (60' r /w) and the apparent westerly line of
said section, 657.45 feet, to P.O.T Station 40 +06.25 Line "A" and P.O.T. Station 10 +00.00 Line "S -3 -A"
on the attached Right -of -Way Parcel Plat (Exhibit B) said point also being the apparent intersection of the
centerline of said Salisbury Road with the apparent centerline of College Corner Road (65' r /w) on the
attached Right- of-Way Parcel Plat (Exhibit B); thence North I I degrees 02 minutes 16 seconds East, along
said Line "A ', the apparent centerline of Salisbury Road (60' r /w) and the apparent westerly line of said
section, 18.66 feet, said point being the apparent southwesterly corner of Deed Book 452, page 401
recorded .tune 20, 1988, in the Official Records, of the Office of the Recorder, Wayne County, Indiana,
said point also being designated ##100 on the attached Right -of -Way Parcel Plat (Exhibit B) and located at
the Point of Beginning; thence continuing North 11 degrees 02 minutes 16 seconds East, along said
apparent centerline of Salisbury Road (60' r /w) and the apparent westerly line of said section, 304.98 feet,
to an intersection with the apparent northerly line of said property, said point also being designated 9101 on
the attached Right -of -Way Parcel Plat (Exhibit B); thence South 89 degrees 47 minutes 27 seconds East,
along said apparent northerly line, 30.48 feet, to a point designated #102 on the attached Right -of -Way
Parcel Plat (Exhibit B); thence South 11 degrees 02 minutes 16 seconds West, 305.16 feet, to an
intersection with the apparent southerly line of said property described in Document 332, Page 47, said
point also being designated #103 on the attached Right -of -Way Parcel Plat (Exhibit B); thence North 89
degrees 53 minutes 06 seconds West, along said apparent northerly line, 30.44 feet, to the Point of
Beginning containing 0.212 acres of land (including 0.100 acres of Present Existing Right -of -Way).
