A RESOLUTION FOR THE CITY OF RICHMOND, INDIANA TO
SELL CERTAIN REAL ESTATE TO THE STATE OF INDIANA AND TO
PERMIT THE STATE OF INDIANA A TEMPORARY RIGHT OF WAY
WHEREAS, The Board of Public Works and Safety of Richmond, Indiana ( "Board ") is
the disposing agent for real property owned and to be transferred or
acquired by the City of Richmond, Indiana ( "City ") pursuant to the
provisions of Indiana Code (IC) 36 -1 -11, et. Seq. (the "Act "); and
WHEREAS, City owns, and the State of Indiana ( "State ") needs to acquire and buy,
certain real estate of approximately 1,806 square feet, more or less, located
on the south side of South "A" Street in Richmond, Indiana (also known
as U.S. 40), for a Fee Simple acquisition for a right -of -way, with said real
estate being legally described in Exhibit "A ", which Exhibit "A" is
attached to this Resolution hereto and incorporated herein by reference;
and
WHEREAS, City owns, and State needs to acquire and buy, certain real estate of
approximately 1,563 square feet, more or less, located on the south side of
South "A" Street in Richmond, Indiana (also known as U.S. 40), for a
temporary right-of-way, with said real estate being legally described in
Exhibit "B ", which Exhibit "B" is attached to this Resolution hereto and
incorporated herein by reference; and
WHEREAS, City is selling the subject real estate described in Exhibit "A" to State for
the sum of $12,950.00, and City is permitting the State a temporary right -
of -way for the subject real estate described in Exhibit "B" to State for the
sum of $1,300.00, for a total purchase price of $14,250; and
WHEREAS, It is in the best interest of the City of Richmond to sell to State the real
estate of approximately 1,806 square feet described in Exhibit "A" for
$12,950.00 and to permit State a temporary right -of -way of approximately
1,563 square feet for $1,300.00, for a total price of $14,250.00.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS
AND SAFETY, that it authorizes Sarah L. Hutton, Mayor of Richmond, Indiana, or her
designee, expressly subject to approval by the Law Department of the City of Richmond,
to execute any and all documents to complete the transaction for the sale of the real estate
described in Exhibit "A" of approximately 1,806 square feet to the State of Indiana, for
$12,950.00, as well as for a temporary right -of -way of approximately 1,563 square feet
for the real estate described in Exhibit "B" to the State of Indiana for $1,300.00.
BE IT FURTHER RESOLVED that Mayor Sarah L. Hutton, or her designee, be, and
hereby is, authorized to take all other action necessary to effectuate the transfer of the
subject real estate described in Exhibit "A" and Exhibit "B" to the State of Indiana.
This Resolution is duly passed and adopted this / day of April, 2013.
