HomeMy Public PortalAboutResolution 98-1881 PCRESOLUTION 98- 1881PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY RECOMMENDING APPROVAL OF A REQUEST BY THE REORGANIZED CHURCH OF JESUS CHRIST OF LATTER DAY SAINTS FOR A MODIFICATION OF CONDITIONAL USE PERMIT 83 -688 AND ZONE VARIANCE 98 -1338 TO EXPAND AN EXISTING CHURCH USE WITH THE ADDITION OF 3,088 SQUARE FEET AND A PARKING VARIANCE LOCATED IN THE SINGLE FAMILY RESIDENTIAL (R -1) ZONE AT 9468 BROADWAY AVENUE; THE PROPERTY IS DESIGNATED INSTITUTIONAL ON THE CITY'S GENERAL PLAN (THE REORGANIZED CHURCH OF JESUS CHRIST OF LATTER DAY SAINTS) The Planning Commission of the City of Temple City does hereby resolve: Section 1. Based upon a public hearing for the above Modification of Conditional Use Permit 83 -688 and Zone Variance 98 -1338, the Planning Commission finds: MODIFICATION OF CONDITIONAL USE PERMIT 1. That the site for the proposed use is adequate in size, shape, topography and circumstances in that the subject site has been utilized for several years as a church use; the proposed modifications and addition would allow for optimal use of the available land and building area. Furthermore, the subject site is situated in an ideal location, furnishing adequate access without possible adverse impacts on neighboring properties; and 2. That the site does have sufficient access to streets, adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use in that the site is served by Cloverly Avenue, a secondary street with a 40 foot roadway and a 60 foot right -of -way and Broadway Avenue, a secondary street with a 40 foot roadway and a 60 foot right - of -way; and 3. That the proposed use will not have an adverse effect upon the use, enjoyment or valuation of adjacent or neighboring properties or upon the public welfare in that the addition of the a second floor for sleeping quarters and the additional building modifications maintains the current use of the property. The subject property is designated as Institutional on the City's General Plan; therefore, the use is consistent with the City's General Plan. ZONE VARIANCE 1. That there are exceptional and extraordinary circumstances or conditions applicable to the property involved or to the intended use of such property which generally apply to other Resolution 98- 1881PC Modification of Conditional Use Permit 83 -688 Zone Variance 98 -1338 Page 2 properties in the same zone in that the lot is 250 feet by 200 feet; which provides for a total lot size of 50,000 square feet; and 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property similarly situated but which is denied to the property in question in that the subject lot is comparable in size, shape and proposed use to other properties in and around the immediate area; other institutional uses including churches have been granted similar approvals based upon the fact that all available space is not occupied at any single time; and 3. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the adjacent or neighboring properties in that the church use at this location has been in existence for many years and the proposed expansion will primarily accommodate dormitory type sleeping for attendees at youth retreats which will be sponsored by the facility. Said sleeping accommodations are not likely to result in any additional parking or traffic problems at this location; and 4. That there are special circumstances as provided in Section 65906 of the California Government Code in that the proposed expansion would not conflict with either the Zoning Code or the General Plan of the City of Temple City. Section -2. This project should result in no significant affects upon the environment and a negative declaration has been prepared in accordance with the State CEQA guidelines. The initial statement as prepared indicates that there is no potential for adverse impact to the environment as it relates to all wild animals, birds, plants, fish, amphibians and related ecological communities, including the habitat upon which the wildlife depends for its continued viability. Section 3. Accordingly, the Modification of Conditional Use Permit 83 -688 and Zone Variance 98 -1338 is approved subject to the following conditions: 1. The proposed development shall be in substantial compliance with the submitted development plans, except as modified herein. 2. Building permits shall be obtained for all demolition work and all new construction. 3. The exterior building facade shall match the coloring and design indicated on the submitted colored elevations. Disposal of Construction Waste: No construction activity waste material of any kind, including plaster, cement, paint, mud, or any other type of debris or liquid shall be allowed to be disposed of in the street or gutter, storm drain or sewer system. Failure to comply with this condition will result in charges being filed with the District Attorney. (TCMC 3400- 3411) 5. The conditions of approval contained in this Resolution may be enforced by the Sheriff's Office as well as City staff. Any violation of any condition is a misdemeanor and may be processed directly by criminal complaint. Section 4. The Secretary shall certify to the adoption of this Resolution.
