HomeMy Public PortalAbout005-2015 - Entering into contract for legal services for Manor Drive ProjectCITY OF RICHMOND, INDIANA BOARD OF PUBLIC WORKS & SAFETY RESOLUTION NO. 5-2015 A RESOLUTION TO ENTER INTO CONTRACT FOR LEGAL SERVICES IN CONNECTION WITH MANOR DRIVE PROJECT WHEREAS, The City of Richmond, Indiana (hereinafter "City "), by and through its Department of Public Works and Engineering is currently carrying out the City's Manor Drive Extension Project (hereinafter "Project ") and is in the process of acquiring certain portions and/or parcels of real estate for said Project; and WHEREAS, Certain condemnation proceedings in connection with a certain property located in Richmond, Indiana, need to take place in order that the Project can proceed in a timely manner and pursuant to all applicable rules and guidelines; and WHEREAS, The law firm of Boston Bever Klinge Cross and Chidester cannot undertake the condemnation proceedings at this time due to a conflict of interest; and WHEREAS, It is in the best interest of the City that the law firm of Yasmin L. Stump Law Group, PC be retained by the City, which law firm is a certified Women Owned Business (WBE) with pending certification as Disadvantaged Business Enterprise (DBE); and WHEREAS, The rates of compensation for said law firm will be at the rates of $225.00 per hour for Yasmin L. Stump, $195.00 per hour for associate attorneys' services, and $75.00 per hour for paralegal services; and WHEREAS, The City's Law Department will work with the law firm of Yasmin L. Stump Law Group, PC, to an agreed contract consistent with the hourly fee set forth above and, once approved by the City Law Department, the President of the Board of Public Works and Safety shall sign the contract on behalf of the City of Richmond, Indiana; and WHEREAS, After careful consideration, it is the desire of the City to proceed with the retention of the Yasmin L. Stump Law Group, PC to assist the City with the condemnation proceedings in connection with the Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF RICHMOND BOARD OF PUBLIC WORKS AND SAFETY that the City of Richmond, Indiana will enter into a formal agreement to retain the legal services of the Yasmin L. Stump Law Group, PC and that Vicki Robinson, President of the Board of Public Works and Safety, shall be authorized to execute the final agreement for legal services upon final approval by the Richmond Law Department.
