HomeMy Public PortalAbout015-2015 - WCTV - Franchise Revenue FeesBOARD OF PUBLIC WORKS & SAFETY CITY OF RICHMOND, INDIANA RESOLUTION NO. 15 -2015 A RESOLUTION RECONFIRMING THE COMMITMENT TO WCTV IN CONNECTION WITH CABLE FRANCHISE AGREEMENT REVENUE FEES WHEREAS, Cable franchise fees are currently regulated by the Indiana Utility Regulatory Commission (hereinafter "IURC ") and state statute provides how franchise fees are paid quarterly to municipal units; and WHEREAS, On December 5, 1991, the City of Richmond, Indiana (hereinafter "City "), by and through its Board of Public Works and Safety, entered into a certain Cable Franchise Agreement with TCI of Indiana, Inc. (hereinafter "Cable Franchise Agreement "), in connection with the grant of a franchise for the installation and operation of television cable systems within the City; and WHEREAS, Pursuant to said Cable Franchise Agreement, the City agreed to dedicate a total of forty percent (40 %) of its annual franchise fee revenue to help support Public, Educational, and Governmental (hereinafter "PEG") access operations; and WHEREAS, On August 4, 1997, the Common Council of the City of Richmond, Indiana, passed Resolution Number 9 -1997 to recognize and designate Whitewater Community Television (hereinafter "WCTV") as the PEG access facility for the City and WCTV continues to be the only entity capable of providing such services for the City; and WHEREAS, As the result of WCTV's above - described designation by the Richmond Common Council as the PEG access facility for the City, and notwithstanding any preemption of franchise fee regulation by the IURC, the City has had an ongoing commitment to WCTV to pass on forty percent (40 %) of said revenue funds to WCTV in order that WCTV is able to manage and control the PEG access facility (which duties include, but are not limited to, the planning and development of programming, operation, and maintenance of the access facility); and WHEREAS, It is in the best interest of the City of Richmond, Indiana, that the Board of Public Works and Safety continues to recognize the valuable service provided to the Richmond Community by WCTV as the City's authorized and designated PEG access facility by reaffirming the City's commitment to WCTV to provide and pass on to WCTV forty percent (40 %) the PEG access annual franchise fee revenue as earmarked and set out in the Cable Franchise Agreement. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works and Safety of the City of Richmond, Indiana, that said Board hereby continues to recognize the valuable service provided to the Richmond Community by WCTV as the City's authorized and designated PEG access facility by reaffirming the City's commitment to WCTV to provide WCTV with the forty percent (40 %) of the PEG access annual franchise fee revenue as earmarked and set out in the Cable Franchise Agreement.
