RESOLUTION NO. 17 -2015
A RESOLUTION TO TRANSFER REAL ESTATE LOCATED IN RICHMOND,
INDIANA TO NOAH'S ARK DAY CARE CENTER, INC.
WHEREAS, The Board of Public Works and Safety ( "Board ") is the disposing agent for real
property owned and to be transferred or acquired by the City of Richmond,
Indiana ( "City ") pursuant to the provisions of Indiana Code (IC) 36 -1 -11, et. seq.
(the "Act "); and
WHEREAS, The City of Richmond, Indiana, has been approached by Noah's Ark Day Care
Center, Inc., a non - profit domestic corporation registered with the Indiana
Secretary of State, in connection with the possible donation of a certain portion of
real property located at 105 NW 8`h Street, Richmond, Indiana; and
WHEREAS, The request of Noah's Ark Day Care Center, Inc., with its pledge that any fence
installed will not be located next to the property line, is attached hereto as Exhibit
A and incorporated herein by reference; and
WHEREAS, Exhibit B, attached to this Resolution, and incorporated by reference, sets forth
the legal description and survey plat of the portion of land to be split off and
donated from City property (hereinafter "real property "); and
WHEREAS, The real property is maintained by the Richmond Parks Department, and although
the property is not owned under the name of "Richmond Park Department" said
real property was approved to be split off and transferred by the Richmond Park
Board at its June 4, 2015 meeting; and
WHEREAS, The real property may be transferred by the Richmond Board of Public Works
and Safety in accordance with Indiana Code (IC) 36- 1- 11- 1(b)(7); and
WHEREAS, It is in the best interest of the City of Richmond that the Board of Public Works
and Safety approve of the transfer of the above - described properties to the Noah's
Ark Day Care Center, Inc.
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works and Safety of
Richmond, Indiana, that said Board hereby approves of the transfer of certain portions of real
estate set out and described in the attached Exhibit B to the Noah's Ark Day Care Center, Inc.
NOW, THEREFORE, BE IT ALSO FURTHER RESOLVED by the Board of Public Works and
Safety of Richmond, Indiana, that the Mayor, the Director of the Department of Metropolitan
Development, the City Attorney, and/or the Assistant City Attorney, be authorized to sign and/or
take all other action necessary including, but not limited to, signing any and all documents
required to effectuate the conveyance and transfer of the above - listed real estate.

We would like to request that the property (blacktop) next to Noah's Ark Day Care
Center, that is owned by the Parks Department be surveyed and donated to Noah's Ark Day Care
Center as a non -profit organization. We would like to eventually put a fence around the property.
We will not put the fence right up to the property line. Thank you for looking at our west and
hope to hear from you soon.

Exhibit "A"
LAND DESCRIPTION
for a 0.226 acre tract
Situated in the Southeast Quarter of Section 31, Township 14 North, Range 1 West, City
of Richmond, Wayne Township, Wayne County, Indiana, being part of a tract of land
described in Deed Record Book 161, Page 426 currently conveyed to the City of
Richmond, said tract being part of Lot Number 19 in the Levi C. Peacock's Addition as
shown in Plat Book Number 5, Page 19, part of vacated Northwest 8th Street in said
Addition and part of the Southeast Quarter of said Section 31 recorded in the Office of the
Wayne County Recorder, and being more particularly described as follows:
Commencing at a mag nail found at the southwest corner of said Southeast Quarter in
West Main Street;
thence North 890 43' 20" East 1226.79 feet along the south line of said Southeast Quarter
in said Road to a point with the southerly prolongation of the east line of Northwest 8th
Street;
thence North 000 34' 30" West 553.90 feet along the prolongation line of said Street to a
5/8 inch rebar and cap stamped "RLS 7955" found at the southwest corner of a 1.292 acre
tract described in Instrument Number 2003014962 on the east line of said Northwest 8th
Street being the TRUE POINT OF BEGINNING for this description herein described;
thence southward along a curve to the left having a radius of 271.25 feet, an arc length of
45.21, a chord direction of South 04146' 06" East, and a chord distance of 45.16 feet to a
set rebar and cap;
thence South 890 59' 37" East 216.26 feet along a new division line to a set rebar and cap
with the southward prolongation of the east line of said 1.292 acre tract;
thence North 000 14' 57" West 45.00 feet along a new division line and said prolongation
line to a found a 5/8 inch rebar and cap stamped "RLS 7955" at the southeast corner of
said 1.292 acre tract;
thence North 890 59' 37" West 219.82 feet along the south line of said 1.292 acre tract to
the point of beginning, containing an area of 0.226 acres.
SUBJECT TO: All legal easements of record.
All rebar and caps set at 5/8 inch reinforcing rod with yellow plastic cap stamped
"MCAVENE 20200050"
