HomeMy Public PortalAbout001-2020 - Establishing Adminstrative Processing Expenses - Unsafe Buildings BOARD OF PUBLIC WORKS AND SAFETY CITY OF RICHMOND, INDIANA RESOLUTION NO. 1-2020 A RESOLUTION ESTABLISHING ADMINISTRATIVE PROCESSING EXPENSES FOR ENFORCING COMPLIANCE WITH UNSAFE BUILDING AND UNSAFE PREMISES ORDERS AND ESTABLISHING SCHEDULE OF MAXIMUM AMOUNT OF PERFORMANCE BONDS APPLICABLE TO UNSAFE BUILDING AND UNSAFE PREMISES ORDERS ISSUED BY UNSAFE BUILDING COMMISSION WHEREAS, Indiana Code 36-7-9-12 provides that the City may assess reasonable processing expenses when recovering the costs of performing work ordered by the Director of the Department of Infrastructure and Development or ordered by the Director of the Department of Code Enforcement under Indiana Code 36-7-9 and Richmond Code Chapter 98; and WHEREAS, The following are average costs which are incurred enforcing such an order, as estimated by the Law Department: 1) Lien Search=$150.00 2) Certified Mail to Send Order= $6.00 3) Recording Fee for Order= $25.00 4) Publication Fee = $37.00 5) Recording Fee for Notice of Action Taken= $25.00 6) Certified Mail to Send Follow-up Letter= $6.00 7) Publication of Bid Notice= $36.00 8) Recording Fee for Release= $25.00 9) Certified Mail to Send Notice of Bid Letting= $ 6.00 WHEREAS, Such reasonable expenses may also include the salaries of those City employees involved in enforcing said orders; and WHEREAS, The following estimates have been submitted by City employees representing the average amount of time spent by each enforcing such an order: 1) Assistant City Attorney=7 hours 2) Executive Secretary, Law Department= 12 hours 3) Administrative Assistant, Infrastructure & Development= 6 hours 4) Building Commissioner= 12 hours 5) City Inspector=6 hours 6) Director of Infrastructure &Development or Director of Code Enforcement (as applicable) = 3 hours 7) Director of Purchasing= 3 hours 8) City Attorney=2 hours WHEREAS, The following formula, as previously submitted by.the City Controller, is used to calculate the hourly salary expense, including benefits, of each City employee: Page 1 of 3 Annual salary multiplied by 1.3 divided by 2080; and WHEREAS, Such costs have been incurred by the City in past years, and are expected to'be incurred in 2020; and WHEREAS, Indiana Code 36-7-9-12 provides that the average processing expense must be set by the Board of Public Works and Safety, and may be fixed at a full dollar amount that is a multiple of ten, which average processing expense has been calculated as the total amount of$1,740.00; and WHEREAS, Additionally, Indiana Code 36-7-9-7 provides that the City may adopt a schedule setting forth the maximum amount of performance bonds applicable to various types of ordered actions issued by the Unsafe Building Commission in connection with Unsafe Building and Unsafe Premises matters; and WHEREAS, The below schedule with proposed amounts for each type of ordered action as applicable to various structure type, as. estimated by the City Director of Code Enforcement, is set forth as follows: Demo Bonds MAXIMUM BOND AMOUNT 1) Structures under 1500 sq. ft. of floor space $5,000.00 2) Structures between 1501 and 3000 sq. ft. of floor space $10,000.00 3) Structures between 3001 and 4500 sq. ft. of floor space $15,000.00 4) Structures over 4501 sq. ft. of floor space $20,000.00 Repair Bonds MAXIMUM BOND AMOUNT 1) Structures under 1500 sq. ft. of floor space $5,000.00 2) Structures between 1501 and 3000 sq. ft. of floor space $10,000.00 3) Structures between 3001 and 4500 sq. ft. of floor space $15,000.00 4) Structures over 4501 sq. ft. of floor space $20,000.00 WHEREAS, Indiana Code 36-7-9-7 provides that the schedule setting forth the maximum amount of performance bonds applicable to the Unsafe Building and Premises Orders must be set by the Board of Public Works and Safety. NOW, THEREFORE, be it resolved by the Board of Public Works and Safety for the City of Richmond,Indiana,that an average processing expense of$1,740.00,calculated as set forth above, shall be added to the costs assessed pursuant to I.C. 36-7-9 and Richmond Code Chapter 98 for work performed in the calendar year 2020. NOW, THEREFORE, be it also resolved by the Board of Public Works and Safety for the City of Richmond, Indiana, that the below schedule setting forth the maximum amount of performance bonds applicable to the Unsafe Building and Premises Orders shall be utilized by the Unsafe Building Commission in the event a performance bond is required as a condition in the event an Unsafe Building or Premises Order is not complied with, pursuant to Indiana Code 36-7-9-7: Page 2 of 3 DEMO BONDS MAXIMUM BOND AMOUNT 1) Structures under 1500 sq. ft. of floor space $5,000.00 2) Structures between 1501 and 3000 sq. ft. of floor space $10,000.00 3) Structures between 3001 and 4500 sq. ft. of floor space $15,000.00 4) Structures over 4501 sq. ft. of floor space $20,000.00 REPAIR BONDS MAXIMUM BOND AMOUNT -1) Structures under 1500 sq. ft. of floor space $5,000.00 2) Structures between 1501 and 3000 sq. ft. of floor space $10,000.00 3) Structures between 3001 and 4500 sq. ft. of floor space $15,000.00 4) Structures over 4501 sq. ft. of floor space $20,000.00 This Resolution is duly passed and adopted this 020- day of � ...,bi(Glcy , 2020.
