CITY OF RICHMOND, INDIANA
ORDINANCE NO. 19-2020
ORDINANCE PERMITTING REDUCTION OF DAILY DEPOSITS
DUE TO EMERGENCY CIRCUMSTANCES
WHEREAS, The Common Council ("Council") of the City of Richmond, Indiana, acknowledges
that under appropriate circumstances, a political subdivision may determine that a
"disaster" exists, as defined by the Indiana Code, which includes, but is not limited
to, the following: "an occurrence or imminent threat of widespread or severe damage,
injury, or loss of life or property resulting from any natural phenomenon or human
act", which definition includes an "epidemic" and "public health emergency"; and
WHEREAS, On January 30, 2020 the World Health Organization ("WHO") declared that the
Coronavirus ("COVID-19") outbreak to be a pandemic due to reaching a phase
characterized by widespread human infection; and
WHEREAS, On January 31, 2020, Health and Human Services Secretary, Alex M. Azar II,
declared a public health emergency for the United States; and
WHEREAS, On March 6, 2020 the Governor, Eric Holcomb, issued Executive Order 20-02,
declaring a public health emergency in the State of Indiana due to the COVID-19
pandemic; and
WHEREAS, The Mayor of the City of Richmond, Indiana issued an Executive Order on March
16, 2020 wherein he declares a local disaster emergency due to the COVID-19
pandemic; and
WHEREAS, The Board of Commissioners of Wayne County, Indiana and the Mayor of the
City of Richmond, Indiana issued a Joint Executive Order on March 20, 2020
which implements - certain procedures designed to assist in limiting the
transmission of COVID-19; and
WHEREAS,' Council desires to have in place appropriate "emergency management" measures due
to the emergency declarations referenced above; and
WHEREAS, A political subdivision may make, amend, and rescind orders, rules, and regulations
as necessary for emergency management; and
WHEREAS, Indiana Code 5-13-6-1 addresses procedures for deposit of public funds, which
provides in pertinent part that, "[a]ll public funds paid into the treasury of the
state or the treasuries of the respective political subdivisions shall be deposited
not later than the business day following the receipt of funds on business days of
the depository..." I.C. 5-13-6-1(a); and
WHERAS, The Indiana State Board of Accounts issued State Examiner Directive 2020-1 on
March 19, 2020 wherein it is stated that the State Board of Accounts will not take
audit exception if the governing body approves the frequency for deposit of public
funds to be limited to two times per week, with such approval mandating that the
deposits be made on Tuesdays and Thursdays; and
WHEREAS, Council desires to permit all City Departments to reduce the deposits taken daily to
the City's bank depository location to two (2) times per week on Tuesdays and
Thursdays and public funds shall be kept secured per the standard and regular
processes on those days when a deposit is not made, all of which is in accordance
with the State Board of Accounts Examiner Directive 2020-1 implemented due to the
declared emergency circumstances.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Richmond,
Indiana', that all Departments of the City of Richmond, Indiana, are permitted to reduce the
deposits taken daily to the City's bank depository location to two (2) times per week, on Tuesday
and Thursdays and public funds shall be kept secured per the standards and regular processes on.
those days when a deposit is not' made, all of which is in accordance with the State Board of
Accounts examiner directive 2020-1 implemented due to the declared emergency circumstances,
which permitted reduction shall take effect immediately upon the adoption of this Ordinance and
which shall remain in effect for the duration of declared emergency matter.
Passed and adopted this 23rd day of March, 2020, by the Common Council of the City of Richmond,
Indiana.
