HomeMy Public PortalAbout026-2020 - Grant - From Various Agencies for Covid Relieve FundingCOMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA ORDINANCE NO.26-2020 AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF GRANTS FROM VARIOUS SOURCES DUE TO EMERGENCY CIRCUMSTANCES (COVID 19) WHEREAS, The Common Council ("Council") of the City of Richmond, Indiana, acknowledges that under appropriate circumstances, a political subdivision may determine that a "disaster" exists, as defined by the Indiana Code, which includes, but is not limited to, the following: "an occurrence or imminent threat of widespread or severe damage, injury, or loss of life or property resulting from any natural phenomenon or human act", which definition includes an "epidemic" and "public health emergency"; and WHEREAS, On January 30, 2020 the World Health Organization ("WHO") declared that the Coronavirus ("COVID-197) outbreak to be a pandemic due to reaching a phase characterized by widespread human infection; and WHEREAS, On January 31, 2020, Health and Human Services Secretary, Alex M. Azar II, declared a public health emergency for the United States; and WHEREAS, On March 6, 2020 the Governor, Eric Holcomb, issued Executive Order 20-02, declaring a public health emergency in the State of Indiana due to the COVID-19 pandemic; and WHEREAS, The Mayor of the City of Richmond, Indiana issued an Executive Order on March 16, 2020 wherein he declares a local disaster emergency due to the COVID-19 pandemic; and WHEREAS, The Board of Commissioners of Wayne County, Indiana and the Mayor of the City of Richmond, Indiana issued a Joint Executive Order on March 20, 2020 which implements certain procedures designed to assist in limiting the transmission of COVID-19.; and WHEREAS, Council desires to have in place appropriate "emergency management" measures due to the emergency declarations referenced above; and WHEREAS, A political subdivision may make, amend, and rescind orders, rules, and regulations as necessary for emergency management; and Page l of 3 WHEREAS, In accordance with Indiana Code (IC) 36-1-4-10, a municipality may execute any documents necessary to receive money from the state or federal government or any other source, and said documents are prepared and executed by the City executive administration, provided that the Common Council of the City of Richmond as the legislative body of the City approves an ordinance for the appropriation of any monies received in accordance with IC 36-4-6-18; and WHEREAS, Various federal, state, local, and/or private agencies or philanthropic funders, such as and including, but not limited to, the Federal Emergency Management Agency ("FEMA"), and the Indiana Office of Community and Rural Affairs ("OCRA"), are anticipated to have expedited funds available on a "first come, first serve" application basis to assist communities with cash flow and/or reimbursements pertaining to the COVID 19 responses; and WHEREAS, It is not yet known how local matches will be applied for the various opportunities and due to the "first come/, first serve" nature of the applications, it is in the best interest of the City for the Common Council to temporarily provide a blanket approval to permit the City administration to seek the funds that become available as described above and for the Common Council to approve and appropriate any funds that are received as approved and applied for by the Mayor with the understanding that the Mayor and administration will later submit confirmatory ordinances to verify amounts received and seek an additional confirmatory retroactive appropriation of any and all specific amounts award in addition to the blanket appropriations permitted pursuant to this Ordinance due to the emergency actions currently being taken by the City; and WHEREAS, The proposed actions outlined above should be permitted and approved for. the duration of the 2020 calendar year for said expedited funds potentially available pertaining to the COVID 19 responses. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that in accordance with Indiana Code (IC) 36-4-6-18, the Common Council approves the appropriation of any monies received during the 2020 calendar year from any grant sources outlined' in the preambles to this Ordinance in the event the Mayor applies for said funds in accordance with IC 36-1-4-10, and where said grant and/or assistance opportunities pertain to the COVID 19 responses in order that the funds can be immediately appropriated and used upon receipt and the Common Council and Mayor agree future confirmatory ordinances shall be submitted to verify amounts received and to seek confirmatory retroactive appropriation of said sums due to the "first come, first serve" nature of the applications anticipated to become available. NOW, THEREFORE, be also it ordained by the Common Council of the City of Page 2 of 3 Richmond, Indiana, that said funds, if awarded, shall be appropriated to the applicable City accounts, and shall be appropriated to fund or reimburse activities connected to the COVID 19 responses performed by the City and its Departments.
