HomeMy Public PortalAbout004-2020 - To allow the Leasing of 1501 NW 5th - Fire Station No. 6 t • CITY OF RICHMOND,INDIANA BOARD OF PUBLIC WORKS AND SAFETY RESOLUTION NO. 4-2020 A RESOLUTION MAKING CERTAIN FINDINGS AND AUTHORIZING THE CITY OF RICHMOND TO LEASE CERTAIN STRUCTURES ON A TRACT OF LAND PURSUANT TO INDIANA CODE 36-1-11-1 ET SEQ. WHEREAS, Indiana Code ("IC") Chapter 36-1-11-1 et seq. contains provisions in connection with the disposal of real or personal property which necessarily includes property leases within the definition of "disposal" and specifically IC 36-1-11-10 authorizes a disposing agent of a political subdivision to make a determination that certain real property may be leased instead of being sold; and WHEREAS, The Richmond Board of Public Works and Safety ("Board") is such a disposing agent on behalf of the City of Richmond, Indiana, ("City") with regard to real property consisting of approximately 1.56 acres, more or less, at 1501 NW 5th Street (PT SW SEC 29-14-1 TRI PC 1.56A *TIF*; State Parcel Number: 891629310104000030; and Local Map # 462931010400529), also commonly known as Fire Station No. 6 (non-operational), more particularly shown in the attached map and image views attached hereto as Exhibit A, and hereafter known as the "Property"; and WHEREAS, The above-described Property will not be sold or transferred by the City due to the permanent location of a Richmond Power and Light substation situated on a portion of the above-described tract and certain structures on the tracked as owned by the City are not utilized by Richmond Power and Light or the Fire Department, which circumstances create a practical condition advantageous to permitting certain structures on property to be leased for a period of time not to exceed three (3) years and, among other provisions, not to be leased to any person ineligible under IC 36-1-11-16; and WHEREAS, The Richmond Fire Department has consulted with the Richmond Law Department and specifically wishes to lease certain structures that are located on the above-described Property, as also shown on Exhibit A, due to the inability of the Property to be sold by the City, and the Fire Department has further complied with IC 36-1-11-4 by first obtaining two (2) appraisals to determine fair market rental value of the Property; and Page 1 of 3 WHEREAS, It is in the best interest of the City to conduct a public hearing to be held on April 16, 2020, which public hearing has been properly advertised one (1) time at least ten (10) days in advance of the scheduled public hearing in accordance with the above-described statutory provisions to receive any information in connection with said Property proposed to be leased; and WHEREAS, Upon the conclusion of the public hearing, it is also in the best interest of the City to notify the Mayor of the Board's recommendation in accordance with IC 36-1- 11-3(b) that the Property should be offered for lease to the highest and best bidder in accordance with IC 36-1-11-10. NOW, THEREFORE, BE IT RESOLVED by the Richmond Board of Public Works and Safety, the disposing agent of the City of Richmond, that: 1. The Board of Public Works and Safety of the City("Board") finds that subsequent to the above-described public hearing, and due to the permanent location of a Richmond Power and Light substation situated on a portion of the Property described in this Resolution, it is in the best interest of the City of Richmond, Indiana, and the best interest of the public for the brick station/garage and brick outbuilding structures located on said Property to be offered for lease instead of being sold or transferred in accordance with IC 36-1-11-1 et seq. 2. The Board hereby notifies the Mayor in accordance with IC 36-1-11-3 of its recommendation and approval of the lease of the brick station/garage and brick outbuilding structures located at 1501 NW 5th Street, known as Fire Station No. 6. (non-operational) as described in the preamble language of this Resolution and as further shown in the attached map and image views attached hereto as Exhibit A. 3. The fair market rental value of the property has been determined by first ordering two (2) appraisals in accordance with IC 36-1-11-4. 4. Representatives of the Fire Department and the Law Department of the City of Richmond, Indiana ("City"), are authorized and directed to take those actions necessary or authorized pursuant to law to offer the Property for lease pursuant to Indiana Code 36-1-11-10, with the determined fair market rental value being the minimum offering a person may submit for consideration. 5. All bids received in accordance with the above-described offer to be issued by the Richmond Fire Department shall be accorded fair and equal treatment with respect Page 2 of 3 , to the evaluation of the bids provided that the Board may lease the Property to the highest and best bidder or the Board reserves the right to reject all bids in accordance with IC 36-1-11-1 et seq.
