A RESOLUTION TO CORRECT A CLERICAL ERROR IN TOWN OF FRASER'S PREVIOUSLY
APPROVED RESOLUTION NO. 2023-03-02 APPROVING A PARTIAL REDUCTION IN THE
SURETY PURSUANT TO THE SUBDIVISION IMPROVEMENT AGREEMENT (SIA) FOR THE
ELK CREEK CONDOMINIUMS AT GRAND PARK — LOT 3
WHEREAS, at the regular meeting of the Fraser Board of Trustees held on March 1,
2023, Elk Creek Condominiums at Grand Park — Lot 3 was granted a partial reduction in surety
required under the terms of the Subdivision Improvement Agreement (SIA), which was
evidenced by the passage of Resolution No. 2023-03-02;
WHEREAS, Resolution No. 2023-03-02 stated that "The Town Board of Fraser,
Colorado hereby authorizes a partial reduction in the surety required under the terms of The
Meadows at Grand Park Filing NO. 1 SIA from $150,798 to $30,159.60," but due to a clerical
error should have read "The Town Board of Fraser, Colorado hereby authorizes a partial
reduction in the surety required under the terms of Elk Creek Condominiums at Grand Park —
Lot 3 SIA from $150,798 to $30,159.60;;" and
WHEREAS, through this resolution, the Board of Trustees desire to amend and restate
the resolution contained within Resolution No. 2023-03-02 in order to correct the clerical error.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF
FRASER, COLORADO THAT:
1. Resolution No. 2023-03-02 is hereby amended and restated to say: "The Town Board of
Fraser, Colorado hereby authorizes a partial reduction in the surety required under the
terms of Elk Creek Condominiums at Grand Park — Lot 3 SIA from $150,798 to
$30,159.60."
