THE CITY OF BEL AIRE, KANSAS ORDINANCE NO. 33;( AN ORDINANCE ESTABLISHING AND PROVIDING FOR SEVERANCE PAY FOR CERTAIN OFFICERS OF THE CITY OF BEL AIRE, KANSAS AND REPEALING ALL CONFLICTING ORDINANCES. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL AIRE, KANSAS: Section 1. Severance Pay Except for conviction of any felony, any crime involving personal gain or any crime of moral turpitude, in the event the Governing Body of the City of Bel Aire, Kansas, within three months next following the date on which any member or members of the Governing Body of the City commences a regular term of office following election thereto, either: (1 ) reduces the salary or other monetary benefits of the Officer by a percentage in excess of that applicable across-the-board to the City's other staff; (2) fails to reappoint the Officer; or (3) suggests, formally or informally that the Officer resign; notwithstanding the Officer's willingness to continue performing his/her official duties for the City, the City shall pay the Officer severance pay. Severance pay shall consist of a lump sum cash payment equal to the total of three month's aggregate salary, accrued vacation and all other benefits available to management employees. In addition to severance pay, the City shall, for a period of three months following such action by the Governing Body of the City, continue to underwrite the Officer's participation in the City's health care plan to the same extent as prevailed immediately prior to such action. 1 Section 2. However, any section of an existing ordinance not in conflict herewith is not repealed and remains in full force and effect. Section 4. Effective Date This Ordinance shall take effect and be in force from and after its publication in the official city newspaper.
