HomeMy Public PortalAboutResolution 99-1932 PC 5637 Santa Anita Avenue" " " RESOLUTION NO. 99- 1932PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY APPROVING MODIFICATION OF CONDITIONAL USE PERMIT 92 -1133, A REQUEST BY FIELD UNION LLC TO PERMIT THE TWENTY -FOUR (24) HOUR OPERATION OF AN EXISTING SERVICE STATION IN THE C -2 ZONE AT 5637 SANTA ANITA AVENUE (ORIENTAL ROYAL INVESTMENT, INC.)(CUP 92 -1133) The Planning Commission of the City of Temple City does hereby resolve: Section 1. Based upon a public hearing for the above Modification of Conditional Use Permit 92 -1133, the Planning Commission hereby finds: MODIFICATION OF CONDITIONAL USE PERMIT 1. That the site for the proposed use is adequate in size, shape, topography and �circumstances in that the subject site consists of 24,170r, square feet of land area; the site is relatively flat, 'anduis easily 'accessible; and 2. That the site does have sufficient access to streets and highways, adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use in that Santa Anita Avenue is a primary street with one hundred (100) feet of right -of -way and eighty (80) feet of roadway; service station customers can easily access the site and safely exit onto the abutting roadway; and 3. That the proposed use will not have an adverse effect upon the use, enjoyment or valuation of adjacent and /or neighboring property or upon the public welfare in that the subject site is rather isolated from other properties and separated by major roadways; the site abuts a high density residential development to the south, however, there is an adequate separation so as to greatly minimize any adverse impacts. Section 2. This project is Categorically Exempt from CEQA. Section 3. Accordingly, Modification of Conditional Use Permit 92 -1133 is hereby approved; provided, however, if within the first year of operation there is a substantial number of documented complaints, the Planning Commission shall have the right to review this matter and modify the hours of operation, if necessary, in order to address documented complaints and /or neighborhood concerns. Section 4. All conditions relative to the original Conditional Use Permit as contained in Resolution No. 92- 1452PC shall remain in full force and effect, except as modified at a noticed public hearing.
