Home My Public Portal AboutAddendum No. 1 to Contract No. 34-2020 - Code Enforcement - Reddog Enterprises - Mowing all City Right-of-Ways for 2020ADDENDUM THIS ADDENDUM,'(Number 1 to Contract No. 34-2020) is made and entered into this day of Ada 2020, by and between Richmond, Indiana, a municipal corporation acting through its Boat of Public Works and Safety with its office at 50 North 5'1' Street, Richmond, Indiana, 47374 (hereinafter referred to as "City"), and Reddog Enterprises Inc., 1216 Elks Country Club Road, Richmond, Indiana, 47374 (hereinafter referred to as "Contractor"). WHEREAS, City and Contractor entered into Contract No. 34-2020 on March 5, 2020, which Agreement retains Contractor to provide mowing services for the City -owned right-of- way properties for the Department of Code Enforcement for the City of Richmond, with the frequency of each location to be determined by the Director of the Department of Code Enforcement; and WHEREAS, The Parties have identified additional properties to be added to the original Exhibit list, as set forth within the scope of Contract No. 34-2020. NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained, including the above stated recitals, City and Contractor hereby agree as follows: The City and Contractor executed and entered into Contract No. 34-2020, on March 5, 2020, which Agreement is incorporated herein by reference. Pursuant to Contract No. 34-2020, Section XI (Miscellaneous), the Parties may alter or amend the Agreement in whole or in part at any time by filing with the Agreement a written instrument setting forth such changes signed by both Parties. The Parties agree that. the attached properties highlighted in yellow on the list as set forth on Contractor's quote, attached hereto as Exhibit A shall be added to the original list of right-of-way properties to be mowed at the flat -price rates listed next to the applicable yellow - highlighted right-of-way properties. Said services shall be performed in a manner consistent with Contract No. 34-2020, which is hereby incorporated by reference and made a part hereof. Compensation paid to Contractor shall remain as described in accordance with Section III (Compensation) of said Agreement as applied to the additional yellow -highlighted properties listed on. Exhibit A herein. For clarification purposes, said flat -price rates may acknowledge the staff and man-hours listed although payment is limited to the flat -price rates per property as requested in the request for quotes and compensation herein is not payable per man-hour or per hour as originally described in the Agreement. Additionally, as described above and for further clarification, the specific frequency of the mowing to take place for each additional yellow -highlighted location shall be determined by the Director of the Department of Code Enforcement as originally described in the Agreement. City and Contractor expressly agree that all other terms, conditions, and covenants contained in Contract No. 34-2020, shall be applicable to this Addendum, unless such term, condition or covenant conflicts with this Addendum Number 1, in which case this Addendum Number 1 shall be controlling. 3. Both Parties hereby agree that with the exception of the additional properties with the corresponding flat -price rates listed as highlighted in yellow on the attached Exhibit A pursuant to this Addendum as authorized by. Section XI (Miscellaneous) of said Agreement, Contract No. 34-2020 shall remain intact and unchanged and in full force and effect. 4. Both Parties agree that any person executing this Contract in a representative capacity hereby warrants that he or she has been duly authorized by his or her principal to execute this Addendum.
