RESOLUTION NO. 7-2020
A RESOLUTION TO APPROVE THE TRANSFER
OF A PERMANENT RIGHT-OF-WAY
WHEREAS, The Board of Public Works and Safety (hereinafter "Board") is the disposing
agent for property owned and to be acquired or transferred by the City of
Richmond, Indiana (hereinafter "City"), pursuant to the provisions of Indiana
Code (IC) 36-1-11, et seq. and IC 5-22-22, et seq. (hereinafter"Acts"); and
WHEREAS, The City of Richmond,. Indiana, is the owner of certain real estate located near
New Paris Pike and near North 24th Street adjacent to the bridge known as Bridge
No. 266 over the East Fork Whitewater River, which bridge is on North 201
Street and is owned and operated by Wayne County, Indiana (hereinafter "subject
bridge"); and
WHEREAS, The Wayne County Board of Commissioners of Wayne County, Indiana
(hereinafter "County"), is undertaking a road improvement along North 24th
Street, and is seeking a permanent fee-simple right-of-way from the City; and
WHEREAS, The permanent right-of-way is outlined in the documentation prepared by the
engineering firm for the County and is known as Parcel 3, which contains 0.103
acres, of which 0.026 acres is existing right-of-way under pavement; and
WHEREAS, The permanent right-of-way is located as shown on the attached highlighted map
with the permanent right-of-way area shown in highlighted yellow marking,
which map is marked as Exhibit A to this Resolution; and
WHEREAS, After careful consideration, it is in the best interest of the City of Richmond to
proceed with the transfer of the permanent right-of-way in accordance with
Indiana Code (IC) 36-1-11-8.
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works and Safety of
Richmond, Indiana, that said Board hereby approves of the transfer of the permanent right-of-
way (Parcel 3)to the Board of County Commissioners of Wayne County, Indiana, as said Parcel
is outlined in the documentation prepared by the engineering firm for the County and as shown
on the attached map designated as Exhibit A to this Resolution.

NOW, THEREFORE, BE IT ALSO RESOLVED by the Board of Public Works and Safety that
the Mayor, David M. Snow, Vicki Robinson, President of the Board of Public Works and Safety,
and Greg Stiens, Director of the Department of Public Works and Engineering, shall be
authorized to execute the formal transfer documents or related documents contained in the
documentation prepared and submitted by the Wayne County Board of Commissioners through
its engineering firm as previously reviewed by the Richmond Law Department and the
Richmond Engineering Department and wherein this approval is also provided retroactively due
to any issues or delays occurring as a result of the COVID-19 health emergency measures that
have been taken or are being taken by the City of Richmond in accordance with all state, federal,
and/or CDC guidelines as appropriate or applicable.
