SPECIAL MEETING - JULY 13, 2011
A Special Meeting of the Bal Harbour Village Council was held on Wednesday, July 13, 2011,
at the Bal Harbour Village Hall Council Chambers (655 — 96th Street, Bal Harbour, Florida).
1. CALL TO ORDER/ROLL CALL: The meeting was called to order at 9:07
a.m. by Mayor Rosenfield. The following were present:
Mayor Jean Rosenfield
Assistant Mayor Joni D. Blachar
Councilwoman Patricia Cohen
Councilman Martin Packer
Alfred J. Treppeda, Village Manager
Ellisa L. Horvath, MMC, Village Clerk
Matthew Pearl, Village Attorney
Absent: Councilman Jaime M. Sanz
As a quorum was determined to be present, the .meeting commenced.
2. PLEDGE OF ALLEGIANCE: The Pledge was led by Mayor Rosenfield.
3. ORDINANCE . SECOND READING/PUBLIC HEARING: The
following Ordinance was read by title by Mrs. Horvath:
AN ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA, AMENDING THE
BAL HARBOUR VILLAGE CODE OF ORDINANCES BY AMENDING ARTICLE
III "BOARDS, commITTEES AND COMMISSIONS" OF CHAPTER 2
"ADMINISTRATION" BY AMENDING SECTION 2-87 "COMPOSITION; TERM;
COMPENSATION; QUALIFICATIONS; VACANCY" OF DIVISION III "GATED
RESIDENTIAL SECTION ADVISORY COM1VIITTEE"; PERMITTING THE
APPOINTMENT OF INDIVIDUALS RESIDING IN AND POSSESSING AN
OWNERSHIP INTEREST IN A COOPERATIVE OR OTHER ENTITY HOLDING
LEGAL TITLE TO REAL PROPERTY WITHIN THE GATED RESIDENTIAL
SECTION OF THE VILLAGE TO THE GATED RESIDENTIAL SECTION
ADVISORY COMMITTEE; AND BY AMENDING SECTION 2-88
"ORGANIZATION" PERMITTING THE GATED RESIDENTIAL SECTION
ADVISORY COMMITTEE TO CONDUCT ADDITIONAL MEETINGS AS
DEEMED NECESSARY BY THE VILLAGE MANAGER; PROVIDING FOR
SEVERABIIdTY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING
FOR AN EFFECTIVE DATE.
A motion was offered by Assistant Mayor Blachar and seconded by Councilman Packer to
approve the Ordinance.
Mayor Rosenfield opened the public hearing. There being no comments, Mayor Rosenfield
closed the public hearing.
The motion carried (4-0), with the roll call vote as follows: Mayor Rosenfield ves; Assistant Mayor
Blachar yes; Councilwoman Cohen ves; Councilman Packer ves; Councilman Sanz absent; thus
becoming Ordinance No. 2011-551.
4. OTHER BUSINESS: Mr.Treppeda distributed Bal Harbour Village
Resolution No. 667, regarding meeting decorum. Councilwoman Cohen reviewed the
Resolution and suggested that discussion among the Councilmembers be less formal at
meetings, to encourage more dialogue. She clarified that Councilmembers should not have
to ask for permission from the Mayor to speak, which she deemed unnecessary.
Councilman Packer discussed a Mayor's Committee meeting he attended in Surfside,
which was an open meeting and was very informal. He explained how it worked, but didn't
know if another layer of government was needed in the Village. He was happy with the way
the Mayor ran the meetings providing for time limits, etc.
Councilwoman Cohen clarified that she was strictly referring to discussion among the
Councilmembers at meetings. Councilman Packer explained that, the members were
allowed to speak for as long as they wanted. Councilwoman Cohen didn't think that
Councilmembers were allowed to offer rebuttals. Mayor Rosenfield disagreed. Assistant
Mayor Blachar clarified that Councilmembers were allowed to speak, but that permission
needed to be requested by the Mayor, who served as the Chair. She explained that was
needed for decorum purposes and to keep the meeting running smoothly. Councilman
Packer agreed that permission should be requested from the Mayor, in order to keep order
and to avoid chaos. He clarified that Councilmembers were allowed to speak for as long as
they would like.
Councilwoman Cohen clarified that the Councilmembers should be allowed, for discussion
purposes, to speak freely without requesting permission. She requested that the
Councilmembers consider a less formal style for Council discussion at meetings, which the
Resolution allowed for. Assistant Mayor Blachar thanked Councilwoman Cohen for bringing
the issue up and suggested that the Council think about it. She noted that it was ultimately
up to the Mayor to decide what she wanted to do. Mayor Rosenfield reviewed the meeting
process that was followed. She didn't remember when Councilwoman Cohen or another
Councilmember was not given ample opportunity to speak. Councilman Packer agreed.
Mayor Rosenfield spoke on the importance of meeting decorum. .
5. ADJOURN: There being no further business, a motion was offered by
Councilman Packer and seconded by Assistant Mayor Blachar to adjourn. The motion carried .(4-
0) and the meeting was adjourned at 9:28 a.m.
