MINUTES OF THE SELECT BOARD REGULAR SESSION MINUTES
DATE : November 2, 2020
TIME : 6 : 00 PM
PLACE : Remote Teleconference
ALL PARTICIPANTS ARE PARTICIPATING REMOTELY : Chair Chaffee, Selectperson deRuyter, Selectperson

Call to Order & Declaration of a Quorum, Meeting Participation Statement and Recording Statement
Chair Chaffee called the meeting to order at 6 : 01pm , conducted a roll call vote of attendance, declared a
quorum present, and read the meeting participation and recording statements .
Executive Session — To consider the purchase, exchange , taking, lease, or value of real property if such
discussion may have a detrimental effect on the negotiating position of the governmental body : 1848
Main St, Brewster, MA ( Historic Preservation Restriction )
Chair Chaffee stated that the Board would be going into executive session to discuss strategy with respect to

Selectperson deRuyter moved that the Board go into executive session at 6 : 00 pm consider the purchase,
exchange, taking, lease, or value of real property if such discussion may have a detrimental effect on the

and every party present declared that no other person is present and /or able to hear the discussion at the
remote location .
Select Person Bingham moved to end Executive Session and return to open meeting at 6 : 13pm , Selectperson {

Public Announcements and Comment ' Members of the public may address the Select Board on matters not on the meeting's agenda for a
maximum 3 5 minutes at the Chair's discretion Under the Open Meeting Law, the Select Board is unable to reply but may add items presented to a future
agenda.

Town Administrator' s Report
Mr . Lombardi reviewed the latest state initiatives issued by Governor Baker as of the meeting . A new stay at
home advisory was put in place from 10pm -5am . Executive Order 53 orders the closure of businesses by
9 : 30pm , Order 54 sets limitations on indoor and outdoor gatherings, and Order 55 makes face coverings
mandatory in all public spaces . These orders are intended to give local officials the ability to respond to local
spreader events, and as a means to avoid broader shut downs . A " Partnerships for Recovery" plan was
announced , to allocate state funding to economic development and recovery response . Thanksgiving holiday
guidance will be sent out, once updated from the State . The ABCC issued clarifying advisory statements that
were sent to the local businesses . County wide CovicI49 data is trending up slightly, but not as severe as in
other parts of the State . The Cape Cod Reopening Task Force continues to meet . Brewster cases are up
slightly, 5 cases in the past two weeks, but the Town remains in the low risk category . There were no issues
or incidents in Town related to Halloween . The Brewster Ladies Library opened for grab and go service, as
well as for in - person limited capacity use on Wednesdays, Fridays and Sundays . Monday, Tuesdays and
Saturdays will remain as days for curbside pickup . The Covid Relief Fund working group met for the first time
last week, to begin to allocate the $ 32, 000 . 00 in the Covid Relief Fund . A donation from Friends of Brewster
Elders in the amount of $ 5 , 000 . 00 was recently made . A Brewster for the Holidays event will be sponsored
by the Chamber to promote to shop local this holiday season . The Presidential Election will be held
tomorrow, and all mail in ballots received by Friday the 6th will be counted . The ballot drop off box has been
moved inside nightly for security . In person voting will take place tomorrow at the Brewster Baptist Church .

The culvert project at Crosby beach is continuing and access is restricted to the parking lot until the end of
the month . The Cyprus Lane storm water project is continuing and they are now installing drainage to
improve water quality at Owl Pond and improve the water run - off. The Conservation Commission is looking 1
to change the hunting policy on some town owned lands . After initial public input meeting, it will now be on
the agenda at a future water commissioners meeting and at a Select Board meeting . Chair Chaffee asked that

Discuss & Vote on Historic Preservation Restriction for Brewster Baptist Church
Mr . Lombardi summarized the Church ' s award and use of Community Preservation funds several years ago .
One of the requirements of the Community Preservation Act is that a historic restriction be placed on the
project . This will be on the chapel itself, not the whole building . The remainder of the funds authorized that
were unused will be returned . Selectperson deRuyter moved to approve the preservation restriction for the
Brewster Baptist Church, Selectperson Bingham second . A roll call vote was taken . Selectperson Whitney-yes,
Selectperson Chatelain -yes, Selectperson deRuyter-yes, Selectperson Bingham -yes , Chair Chaffee -yes . The
Board vote was 5 -yes, 0 - No .
Discuss & Vote on Special Act Conveying Parcel of Nickerson Park Land to Town of Brewster for Millstone
Road Project (Select Board FY21 -22 Strategic Plan Goal CI - 6)
This home rule petition was included in the design process for the Millstone road project . Approximatly
10, 000sq feet of the project runs on the frontage of Nickerson State Park . Town meeting approved the Select
Board to engage in the process and file the petition . Town Counsel has been involved , as well as the Local
and State delegation . The overall goal of this land acquisition is to widen the road and make it safer for j
walkers and bicyclers on Millstone Road . This will connect with the trail system within the park and will
provide better access to this use point . Rep . Peake will be in charge of working it through the legislative
approval process . Selectperson deRuyter asked why if this was approved at Town Meeting, the Select Board i
needs to authorize it . Town meeting approved the process of the home rule petition to be filed, the Select
Board will vote tonight on the detailed petition . Selectperson deRuyter moved to approve the Special Act
Petition , Selectperson Chatelain second . A roll call vote was taken . Selectperson Whitney-yes, Selectperson
Chatelain -yes, Selectperson deRuyter-yes, Selectperson Bingham -yes, Chair Chaffee-yes . The Board vote was
5 -yes, 0- No .

Discuss & Vote on Allocation of Proceeds from Solar Carport Project ( s ) I
Mr . Lombardi gave the Board an update on the two solar projects at the Captains Golf Course . The current j
plan will be to revise the initial application with a comprehensive storm water management plan , peer
reviewed , to the Planning Board to hold a hearing in January . This special permit requires a super majority of
votes in favor of the Planning Board . The revenues have been locked in to Block 4 of the special State

incentives . Taking into account financial considerations with the delays, the Town would net approximately
$44, 000 . 00 annually from each lease agreement . The allocation of the revenue was discussed by Mr .
Lombardi . He proposed $ 20, 000 . 00 with a 2 % escalator payment, to fund an energy manager position . The
balance of revenues would be directed to the Golf Course, approximetly $ 65, 000 annually . Ms . Bingham
commended Mr . Ellsworth for his foresight of solar arrays at the Golf Course many years ago . She spoke with
Mark O' Brien and he feels that the panels will be essentially paying for the golf course' s electric invoices .
Selectperson deRuyter and Selectperson Chatelain are in favor of the proposal from Mr. Lombardi .
Selectperson Chatelain feels that the Golf Course has a funding source currently and would like to see more
of the funds from the solar projects to relieve pressure elsewhere in the town budget . If the funds were
directed to the General Fund , they could be spent on items of than the Golf Course , if directed to do so by
Town Meeting , Mr . Lombardi asked the Select Board if they would like to create a policy for use of the funds .
This could be determined as a general policy decision, which could be formally memorialized and voted on
after the Planning Board decision . Chair Chaffee supports the proposal from Mr . Lombardi . Public comment
email was read to the Board from Jeff O' Dell . Mr . Lombardi and the Select Board further discussed the best
use of the fund for the specific revenues . Selectperson deRuyter moved to approve the allocation of funds
from the Solar Carport projects as recommended by administration, Selectperson Whitney second . A roll call
vote was taken . Selectperson Whitney-yes, Selectperson Chatelain - no, Selectperson deRuyter-yes,
Selectperson Bingham -yes, Chair Chaffee-yes . The Board vote was 5 -yes, 1 - No .
Review Proposed FY22 Budget Calendar
Mr . Lombardi reviewed the Budget Calendar process including; department head planning, capital planning
committee review, and a review and presentation to the Select board in January . February 1 begins the first
in a series of joint meetings with the Finance Committee and Select Board , On February 16, the Capital
Planning Committee will give their recommendations, and February 17 is the dead line for Town Meeting
warrant articles . February 24th will be the school budget presentations from Nauset and Cape Cod Tech .
March 19 and 29th are deadlines for finalizing warrant articles and recommendation votes . April 12th is the
dead line to post the warrant, April 13 is final date to place questions on the warrant . May Yd is the target
