HomeMy Public PortalAboutOrdinance 2638VILLAGE OF PLAINFIELD ORDINANCE NO. 2638 AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIAL USE FOR A PLANNED DEVELOPMENT FOR PROPERTY LOCATED AT VAN DYKE ROAD NORTH OF 127TH STREET AND EDWARD HOSPITAL, PLAINFIELD, ILLINOIS. PUBLISHED IN PAMPHLET FORM BY THE AUTHORITY OF THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL AND KENDALL COUNTIES, ILLINOIS, THIS 25TH DAY OF MAY, 2007. ORDINANCE NO. 2638 AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIAL USE FOR A PLANNED DEVELOPMENT FOR PROPERTY LOCATED AT VAN DYKE ROAD NORTH OF 127" STREET AND EDWARDS HOSPITAL, PLAINFIELD, ILLINOIS WHEREAS, the Village of Plainfield Plan Commission has recommended that the application for a special use for a Planned Development be granted and has made certain findings based on the evidence presented to it in said case that: a. The special use will not be injurious to the use and enjoyment of other property in the immediate area for the purposes already permitted, nor substantially diminish and impair property values within the neighborhood; and b. The establishment of the special use will not impede the normal and orderly development and improvement of the adjacent property for uses permitted within the district. c. The PD fulfills the objectives of the comprehensive plan and the land use policies of the Village and presents an innovative and creative approach to the development of land and living environments. d. The proposed land uses fulfill, or can reasonably be expected to fulfill, a need or demand for such uses within the Village. e. The physical design of the PD efficiently utilizes the land, adequately provides for the transportation and public facilities, and preserves natural features of the site, and the property is suitable for the proposed purposes and land uses. Any exceptians to bulk and density regulations of the underlying zoning shall be solely far the purpose of promoting an efficient and coordinated site plan, no less beneficial to the residents or occupants of such development, as well as the neighboring property, than would be obtained under the build and density regulations of this ordinance for buildings developed on separate zoning lots. g. The PD meets the requirements and standards of the planned development regulations. h. Open spaces and recreational facilities are provided. The PD is compatible with the adjacent properties and the neighborhood, and along the periphery of the PD, yards or setbacks shall be provided that meet or exceed the regulations of the district in which the PD is located. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL AND KENDALL COUNTIES, ILLINOIS AS FOLLOWS: Section 1. The President and Board of Trustees of the Village of Plainfield hereby adopt and incorporate as their own, the above findings made by the Plan Commission. Section 2. That the President and Board of Trustees of the Village of Plainfield hereby approve the application by the owner for a special use for a Planned Development to for the following tract of land to wit: LEGAL: PARCEL 1: THE SOUTHEAST 1/4 OF THE NORTHEAST 1/4 OF THE SOUTHWEST 1/4 OF SECTION 28, TOWNSHIP 37 NORTH, RANGE 9, EAST OF THE THIRD PRINCIPLE MERIDIAN, EXCEPTING THEREFROM THE NORTH 25 FEET THEREOF: PARCEL 2: THE NORTH 25 FEET OF THE NORTHEAST 1/4 OF THE SOUTHEAST 1/4 OF THE SOUTHWEST 1/4 OF SECTION 28, TOWNSHIP 37 NORTH, RANGE 9 EAST OF THE THIRD PRINCIPLE MERIDIAN, ALL IN WILL COUNTY ILLINOIS. Section 3. That said special use shall be subject to the following conditions: 1. Compliance with the requirements of the Village Engineer . 2. Compliance with the requirements of the Plainfield Fire Protection District. 3. Extending and constructing Prairie Grove Road to the subject site's western perimeter at the time of the first final plat or site plan within this development. 4. Dedicating fifty (50) feet along Van Dyke Boulevard. Section 4. This Ordinance shall be numbered as Ordinance No. 2638. This Ordinance shall be in full force and effect from and after its passage, approval, and publication as required by law. PASSED THIS 16th DAY OF APRIL, 2007.
