HomeMy Public PortalAboutOrdinance 2688Local Agency State Agreement for Jurisdictional Transfer Village of Plainfield Location: Lockport Street from the east edge of pavement of IL Route 126 to the west edge of pavement of IL Route 59, in its entirety Wlll Connty ORDINANCE N0.2b88 AN ORDINANCE PROVIDING FOR THE ADDITION OF LOCKPORT STREET FROM THE EAST EDGE OF PAVEMENT OF IL ROUTE 126 TO THE WEST EDGE OF PAVEMENT OF IL ROUTE S9 TO THE SYSTEM OF THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS PASSED AND APPROVED BY THE MAYOR AND BOARD OF TRUSTEES THE 17TH DAY OF SEPTEMBER, 2007 Published in pamphlet fnrrn by authority of the corporate authorities of the Village of Plainfield, Illinois, the 18th day of September, 2007 Page2of4 8LR 05211 (Rev. 7/05) Printed on 9/18/2047 11:09:33 AM Local Agency State Agreement for Jurisdictional Transfer 'Village of Plainfield Location: Lockport Street from the east edge of pavement of II., Route IZ6 to the west edge of pavemeut of IL Route 59, in its entirety Will County ORDINANCE N0.2688 AN ORDINANCE PROVIDING FOR THE ADDITION OF LOCKPORT STREET FROM THE EAST EDGE OF PAVEMENT OF IL ROUTE 126 TO THE WEST EDGE OF PAVEMENT OF IL ROUTE 59 TO THE SYSTEM OF THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS WHEREAS, the Village of Plainfield, Will County, Illinois (hereinafter the "Village") is a duly constituted and existing municipality and a home rule unit pursuant to Section 6 of Article VII of the Constitution of the State of Illinois; and WHEREAS, Section 7-101 of the Illinois Highway Cade (60S ILCS S/1-101 et seq.) provides that the Village may make changes to the Municipal Street System; and WHEREAS, Lockport Street from IL Route 12b to IL Route 59 ("Roadway Section") lies within the Village and is maintained by the State Department of Transportation ("Department"); and WHEREAS, it is in the best interest of the Village to obtain jurisdiction aver the entire length of Lockport Street, including the Roadway Section; and WHEREAS, the Department has proposed a Local Agency State Agreement for Jurisdictional Transfer of the Roadway Section ("Agreement"), a copy of which is attached hereto and incorporated herewith as Exhibit "A," which provides in pertinent part that 21 calendar days after execution of the Agreement and the notification by the District Engineer, the Village will assume jurisdiction of the Roadway Section; NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS PURSUANT TO ITS HOME RULE AND STATUTORY AUTHORITY, AS FOLLOWS: SECTION 1. INCORPORATION That the preambles to this Ordinance be, and the same hereby are incarporated by this reference as if set out in full at this place. SECTION 2. AUTHORITY That the Mayor is hereby authorized and directed to execute the Local Agency State Agreement for Jurisdictional Transfer attached hereto and incorporated herewith as Exhibit "A." ADDITION TO MUNICIPAL STREET SYSTEM Lockport Street from the east edge of pavement of IL Route 126 to the west edge of pavement of IL Route 59 shall be added to the municipal street system of the Village, effective twenty-one (21) calendar days following execution of the Agreement by the State. SECTION 4. REPEALER All Ordinances approved by the Village of Plainfield which are inconsistent herewith, to the extent of such inconsistency and na further, are hereby repealed upon the effective date hereof. SECTION 5. SEVERABILITY Should any section, subsection or other provision of the Ordinance for any reason be held invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the Ordinance as a whole or any part not declared invalid. SECTION 6. EFFECTIVE DATE This Ordinance shall take effect immediately upon its passage and approval in accordance with law. WITNESSETH: WHEREAS, the STATE and the VILLAGE in order to facilitate the free flow of traffic and insure safety to the motoring public, are desirous of jurisdictional transfers between the VILLAGE and STATE of Lincoln Highway from 143rd Street to IL Route 126, Lockport Street from IL Route 126 to IL Route 59 and 143'd Street from US Route 30 to IL Route 59, by re-routing of US Route 30 along 143 Street said section of highway, and by performing all other work necessary to complete the improvement in accordance with the approved plans and specifications; and WHEREAS, the improvement of 143rd Street froln US Route 30 to IL Route S9 project has been accomplished; and WHEREAS, the STATE and the VILLAGE are desirous of said improvement in that same will be of immediate benefit to the community residents and permanent in nature; NOW, THEREFORE, in consideration of the mutual covenants contained Herein, the parties hereto agree as follows: The VILLAGE agrees to make the surveys, obtain all necessary rights of way, prepare plans and specifications, receive bids, and award the contract, furnish engineering inspection during construction, and cause the improvement to be built in accordance with the plans, specifications and contract. The VILLAGE also agrees to pay, or provide for the payment of, all right-of--way if necessary, construction and engineering costs. The VILLAGE agrees to be financially responsible for all costs associated with required land acquisition as well as all preliminary engineering, construction engineering, and construction costs associated with non-participating items. The VILLAGE and the STATE have agreed to the jurisdictional transfer of the portion of highway described in the Local Agency -State Jurisdictional Transfer document, attached hereto as "Exhibit A, Exhibit B & Exhibit C" and made a part hereof. The said transfers of jurisdiction become effective the day IDOT District One re-marks US 30. Page I of I G Printed un 1 1/1 7/2007 7:54:51 AM The VII..LAGE agrees to prepare the plans and specifications, in accordance with the STATE's Bureau of Local Roads Standards. The VILLAGE shall maintain, for a minimum of 3 years after the completion of the Project, adequate books, records, and supporting documents to verify the amounts, recipients, and uses of all disbursements of funds passing in conjunction with this Agreement. All books, records, and supporting documents related to the Project shall be available for review and audit by the Auditor General. and other STATE auditors and the VILLAGE agrees to cooperate fully with an audit conducted by the Auditor General and other STATE Auditors and to provide full access to all relevant materials. Failure to maintain the books, records, and. supporting docurrzents required by this paragraph shall establish a presumption in favor of the STATE for the recovery of any funds paid by the STATE under this Agreement for which adequate books, records, and supporting documentation are not available to support their puzported disbursement. The VILLAGE, agrees to comply with all applicable Executive Orders and Federal Highway Acts pursuant to the Equal Employment Opportunity and non-discrimination regulations required by the Illinois Department of Transportation. Upon acceptance by the STATE of the jurisdictional transfer included herein, the financial responsibility for maintenance and electrical for the operation of the traffic signals shall remain as outlined in the Master Agreement executed between the VILLAGE and the STATE an June 3, 2002. The STATE will maintain the signalized intersections through its electrical maintenance contractor. The financial responsibility for the Erraergency Vehicle Pre-Emption equipment at the signalized intersections shall be borne by the applicant. The STATE retains the right to control the sequence and timing of the traffic signals and interconnect. It is mutually agreed, if, in the future, the STATE adapts a roadway or traffic signal improvement passing through the traffic signals at the intersection of US Route 30 and IL S9 & IL 126 which requires modernization ax reconstruction to said traffic signals then the VILLAGE agrees to be financially responsible for all costs to relocate emergency vehicle pre-emption equipment, and proportionate casts of the traffic signals in conjunction with the STATE's proposed improvement. The STATE also retains the right to restore combination traffic signal and lighting poles to separate traffic signal poles. It is mutually agreed that the VILLAGE shall be responsible for 100% costs associated with the operation, maintenance and payments against energy usage roadway lighting at the intersection of US30 and TL126 (Lockport Street). The VILLAGE shall also receive invoices directly from utility company for the payments without any STATE involvement. Obligations of the STATE and VILLAGE will cease immediately without penalty or further payment being required if, in any f scal .year, the Illinois General Assembly or Federal funding source fails to appropriate or otherwise make available funds for this contract.
