AN ORDINANCE PROVIDING FOR THE REMOVAL OF 143 STREET FROM THE
EAST EDGE OF PAVEMENT OF US ROUTE 30 TO THE WEST EDGE OF
PAVEMENT OF IL ROUTE 59 FROM THE SYSTEM OF THE VILLAGE OF
PLAINFIELD, WILL COUNTY, ILLINOIS
WHEREAS, the Village of Plainfield, Will County, Illinois (hereinafter the "Village") is
a duly constituted and existing municipality and a home rule unit pursuant to Section 6 of
Article VII of the Constitution of the State of Illinois; and
WHEREAS, Section 7-101 of the Illinois Highway Code (605 ILCS 5/1-101 et seq.)
provides that the Village may make changes to the Municipal Street System; and
WHEREAS, 143rd Street from US Route 30 to IL Route 59 ("Roadway Section") lies
within the Village and is maintained by the Village; and
WHEREAS, it is in the best interest of the Village to transfer jurisdiction over the entire
length of 143rd Street, including the Roadway Section, to the State Department of
Transportation ("Department"); and
WHEREAS, the Department has proposed a Local Agency State Agreement for
Jurisdictional Transfer of the Roadway Section ("Agreement"), a copy of which is
attached hereto and incorporated herewith as Exhibit "A," which provides in pertinent part
that 21 calendar days after execution of the Agreement and the notification by the District
.Engineer, the Department will assume jurisdiction of the Roadway Section;
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF
TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS
PURSUANT TO ITS HOME RULE AND STATUTORY AUTHORITY, AS
FOLLOWS:
SECTION 1. INCORPORATION That the preambles to this Ordinance be, and the
same hereby are incorporated by this reference as if set out in full at this place.
SECTION 2. AUTHORITY That the Mayor is hereby authorized and directed to
execute the Local Agency State Agreement far Jurisdictional Transfer attached hereto and
incorporated herewith as Exhibit "A."

SECTION 3. REMOVAL FROM MUNICIPAL STREET SYSTEM 143rd Street
from the east edge of pavement of US Route 30 to the west edge of pavement of IL Route
59 shall be removed from the municipal street system of the Village, effective twenty-one
(21) calendar days following execution of the Agreement by the State.
SECTION 4. REPEALER All Ordinances approved by the Village of Plainfield which
aze inconsistent herewith, to the extent of such inconsistency and no further, are hereby
repealed upon the effective date hereof.
SECTION 5. SEVERABILITY Should any section, subsection or other provision of
the Ordinance for any reason be held invalid or unconstitutional by the decision of any
court of competent jurisdiction, such decision shall not affect the validity of the Ordinance
as a whole or any part not declared invalid.
SECTION 6. EFFECTIVE DATE This Ordinance shall take effect immediately upon
its passage and approval in accordance with law.

The Village has installed the new signage and removed the old signs for the re-route of US Route
30 on February 14th, 2008.
I spoke to Mr. Cory Jucius last week, and he was to schedule an inspection of the new signs and
will inform my department if any adjustnnents or changes need to be made.

AGREEMENT
Phis agreement entered into this 3RD day ofDEC. , A.D., 20 D7 , by and.
between the STATE OF ILLINOIS, acting by and through its DEPARTMENT OF
TRANSPORTATION hereinafter called the STATE, and the Village of Plainfield, of the
State of Illinois, hereinafter called the VILLAGE.
WITNESSETH:
WHEREAS, the STATE and the VILLAGE in order to facilitate the free flow of
traffic and insure safety to the motoring public, are desirous of jurisdictional transfers
between the VILLAGE and STATE of Lincoln Highway from 143'd Street to IL Route
126, Lockport Street from IL Route 126 to IL Route 59 and 143'd Street from US Route
30 to IL Route 59, by re-routing of US Route 30 along 143 Street said section of
highway, and by performing all other work necessary to complete the improvement in
accordance with the approved plans and specifications; and
WHEREAS, the improvement of 143rd Street from US Route 30 to IL Route 59 project
has been accomplished; and
WI~EREAS, the STATE and the VILLAGE are desirous of said ilnprovelxlent in
that same will be of immediate benefit to the community residents and permanent in
nature;
NOW, THEREFORE, in consideration of the mutual covenants contained herein,
the parties hereta agree as follows:
The VILLAGE agrees to make the surveys, obtain all necessary rights ofway, prepare
plans and specifications, receive bids, and award the contract, furnish engineering
inspection during construction, and cause the improvement to be built in accordance with
the plans, specifications and contract.
The VILLAGE also agrees to pay, or provide for the payment of, all right-of way if
necessary, construction and engineering costs.
The VILLAGE agrees to be financially responsible for all costs associated with required
land acquisition as well as all preliminary engineering, construction engineering, and
construction costs associated with non-participating items.
The VILLAGE and the STATE have agreed to the jurisdictional transfer of the portion of
highway described in the Local Agency -State Jurisdictional Transfer document,
attached hereto as "Exhibit A, Exhibit B & Exhibit C" and made a part hereof. The said
transfers of jurisdiction become effective the day IDOT District One re-marks US 30.

"The VILLAGE agrees to prepare the plans and specifications, in accordance with the
STATE's Bureau of Local Roads Standards.
The VILLAGE shall maintain,' for a minimum of 3 years after the completion of the
Project, adequate books, records, and supporting documents to verify the amounts,
reclplents, and Uses Of all disbursements of funds passing m con~unctlan with thls
Agreement. All books, records, and supporting documents related to the Project shall be
available for review and audit by the Auditor General and other STATE auditors and the
VILLAGE agrees to cooperate fully with an audit conducted by the Auditor General and
other STATE Auditors and to provide full access to all relevant materials. Failure to
maintain the books, records, and supporting documents required by this paragraph shall
establish. a presumption in favor of the STATE for the recovery of any funds paid by the
STATE under this Agreement for which adequate books, records, and supporting
documentation are not available to support their purported disbursement.
The VILLAGE, agrees to comply with all applicable Executive Orders and Federal
Highway Acts pursuant to the Equal Employment Opportunity and non-discrimination
regulations required by the Illinois Department of Transportation.
Upon acceptance by the STATE of the jurisdictional transfer included herein, the
financial responsibility for maintenance and electrical for the operation of the traffic
signals shall remain as outlined in the Master Agreement executed between the
VILLAGE and the STATE on .Tune 3, 2002.
Tlae STATE will maintain the signalized intersections through its electrical maintenance
contractor. The financial responsibility far the Emergency Vehicle Pre-Emption
equipment at the signalized intersections shall be borne by the applicant.
The STATE retains the right to control the sequence and timing of the traffic signals and
interconnect.
It is mutually agreed, if, in the future, the STATE adopts a roadway or trafflc signal
improvement passing through the traffic signals at the intersection of US Route 3q and IL
59 & IL 126 which requires modernization or reconstruction to said traffic signals then
the VILLAGE agrees to be financially responsible for all costs, to relocate emergency
vehicle pre-emption equipment, and proportionate costs of the traffic signals in
conjunction with the STATE's proposed improvement. The STATE also retains the right
to restore combination tz-afflc signal and lighting poles to separate trafflc signal poles.
It is mutually agreed that the VILLAGE shall be responsible for 100% costs associated
with the operation, maintenance anal payments against energy usage roadway lighting at
the intersection of US30 and IL126 (Lockport Street). The VILLAGE shall also receive
invoices directly fi-om utility company for the payments without any STATE
involvement.
Qbligations of the STATE and VILLAGE will cease immediately without penalty or
further payment being required. if, in any fiscal year, the Illinois General Assembly or
Federal funding source fails to appropriate or otherwise make available funds for this
contract.

This AGREEMENT and the covenants contained herein shall be null and void. in the
event the contract covering the construction work contemplated herein is not awarded
within the three years subsequent to execution o:F the agreement.
This agreement shall be binding upon and to the benefit of the parties hereto, their
successors and assigns.

The above local agency, hereinafter referred to as "LA", and the State of Illinois, acting by and through its Department of
Transportation, agree, to transfer the jurisdiction of the designated location in the manner indicated above under Type of
Systems Transfer.

NOW THEREFORE IT IS AGREED that the corporate authority of said municipality will pass an ordinance providing for the
transfer of the above location and shall attach hereto and make a part hereof a copy of a location map as Addendum No. 1
and a copy of the ordinance as Addendum No. 2, and .

WHERI=AS, the authority to make changes to the County Highway System is granted to the County by Section 5-105 of the
Illinois Highway Cade.
NOW THEREFORE IT IS AGREED that the County Board of said County will pass a resolution providing for the transfer of
the above location and shall attach hereto and make a part hereof a copy of a location map as Addendum No, 1 and a copy
of the resolution as Addendum Na. 2, and

WHEREAS, the authority to make changes to the Township/Road District System is granted to the Highway Commissioner
