HomeMy Public PortalAboutOrdinance 2660 ORDINANCE N0.266U AN ORDINANCE ALLOWING A VARIANCE TO PERMIT PLACEMENT OF A FENCE FOR THE PROPERTY LOCATED AT THE NORTHWEST CORNER OF GATEWAY CIRCLE AND 135T" STREET IN THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS WHEREAS, Jeffrey Austin has requested a variance to permit placement of a fence in the corner side yard setback; and WHEREAS, the Zoning Board of Appeals have made the following findings based upon the evidence presented to it: A. The variance is in harmony with the general purpose and intent of this chapter. B. The plight of the owner is due to unique circumstances and thus strict enforcement of the Zoning Ordinance would result in practical difficulties or impose exceptional hardships due to the special and unusual conditions that are not generally found on other properties in the same zoning district. C. The property cannot yield a reasonable use if permitted only under the conditions allowed by this chapter. D. The variance, if granted, will not alter the essential character of the neighborhood and will not be a substantial detriment to adjacent property. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, WILL AND KENDALL COUNTIES AS FOLLOWS: Section 1. The President and Board of Trustees of the Village of Plainfield hereby adopt the findings of the Zoning Board of Appeals as its own and that the petition requesting a variance to permit placement of a fence in the corner side yard setback as to the real estate hereinafter described be granted. Territor Described. LOT 53, IN NATURES CROSSING UNIT 1, BEING A SUBDIVISION OFPART OF THE WEST HALF OF THE SOUTHWEST QUARTER OF SECTION 32, TOWNSHIP 37 NORTH, RANGE 9 EAST OF THE PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED NOVEMBER 12,1997, AS DOCUMENT NO. R97-100122, IN WILL COUNTY, ILLINOIS. Section 2. There is hereby granted a variance to permit placement of a fence in the corner side yard setback. Section 3. That the variance shall be subject to the following conditions: 1. The fence shall not exceed east of the front wall of the house. PASSED THIS 2nd DAY OF JULY, 2007.
