HomeMy Public PortalAbout2012.195 (10-16-12) RESOLUTION NO. 2012.195 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD MANDATING ALL LEGALLY - REQUIRED FINANCIAL DISCLOSURE STATEMENTS FILED WITH THE CITY OF LYNWOOD BY ELECTED OFFICIALS OR CANDIDATES FOR CITY OFFICE OR COMMITTEES TO SUPPORT OR DEFEAT ANY CITY MEASURE OR CANDIDATE FOR CITY OFFICE BE POSTED ON THE CITY OF LYNWOOD WEBSITE WHEREAS, The Political Reform Act (Gov. Code Sections 81000 - 91014) and related regulations of the Fair Political Practices Commission ( "FPPC ") require most local government officials to publicly disclose their personal assets and income as well as financing for campaigns for City office or in support or opposition of ballot measures; WHEREAS, although the FPPC makes many of these statements available on its website, the City may nevertheless post these and other financial disclosure statements on the City website; WHEREAS, to uphold the City Council's goal of providing greater transparency for City government, easier access to public records, while safeguarding private information, the Council is desirous of having all required FPPC financial disclosure statements filed with the City available to the public on the City's website; and WHEREAS, the City Council hereby finds that the public interest and convenience requires greater access to public records and hereby finds that the approval of this Resolution serves the aforementioned key goals. NOW, THEREFORE, BE IT RESOLVED, THAT THE CITY COUNCIL OF THE CITY OF LYNWOOD HEREBY FINDS, ORDERS AND RESOLVES AS FOLLOWS: Section 1. That the City Council finds that the above recitals are true and correct. Section 2. The City Council adopts the requirement that all FPPC financial disclosure statements required to be filed with the City Clerk, including, but not limited to, FPPC Forms 700 and 460 by elected officials, or candidates for City office or committees to support or defeat any City ballot measure or candidate for City office be posted on the City of Lynwood website. The requirement shall include uploading such financial disclosure statements since 2006, beginning within 120 days, if not sooner, of the effective date of this Resolution. Thereafter, not including the then current year, at least six prior years' statements shall always be available on the website. Any information contained in such disclosure statements required by law to be redacted or as necessary to protect the privacy of the filer in accordance with the requirements of State law under the Public Records Act at Government Code section 6250 et seq. shall be redacted before placing such document on the City's website in a form viewable by the public. Section 3. This Resolution shall take effect immediately upon its adoption. Section 4. The City Clerk shall certify to the passage and adoption of this Resolution.
