A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, SUPPORTING
EFFORTS OF FIREARMS' RETAILERS TO REDUCE GUN
VIOLENCE AND ILLEGAL TRAFFICKING IN FIREARMS
THROUGH INDUSTRY SALES AND MARKETING BEST
PRACTICES; DIRECTING THE VILLAGE MANAGER TO
COORDINATE WITH THE CHIEF OF POLICE AND WITH
OTHER MUNICIPALITIES IN SUPPORT OF THIS
INITIATIVE AND TO WORK WITH FIREARM SUPPLIERS
TO ENCOURAGE SALES AND MARKETING SAFEGUARDS;
AND DIRECTING THE VILLAGE CLERK TO TRANSMIT A
COPY OF THIS RESOLUTION TO OTHER SOUTH
FLORIDA MUNICIPALITIES, THE MIAMI-DADE AND
FLORIDA LEAGUE OF CITIES, INC. AND TO MEMBERS
FLORIDA'S CONGRESSIONAL DELEGATION.
WHEREAS, according to the Florida Center for Investigative Reporting, the incidence of
homicides involving the use of firearms has risen dramatically in recent years, including cases
involving multiple victims; and
WHEREAS, firearms may fall into criminal hands by means of "straw purchases" in which
a friend or family member passes the required background check imposed by federally -licensed
dealers, and purchases a gun for a third -person who could not pass the background check; and
WHEREAS, according to a recent study published in the Journal of Public Policy and
Marketing, responsible practices by gun manufacturers and distributors help to prevent guns from
falling into criminal hands, thus helping to reduce the incidence of gun violence; and
WHEREAS, Village of Key Biscayne Mayor Franklin H. Caplan is a member of Mayors
Against Illegal Guns, a bi-partisan coalition of more than 800 mayors nationwide, representing more
than 58 million Americans, that supports the Fix Gun Checks Act; and
WHEREAS, Mayors Against Illegal Guns and Wal-Mart developed the Responsible
Firearms Retailer Partnership, a comprehensive plan to curb the illegal trafficking of firearms
through more responsible gun sales and marketing practices, including sensible safeguards such as
the videotaping of gun sales, increased store security, and employee training and background checks;
and
WHEREAS, the voluntary code applicable to participants in the Responsible Firearms
Retailer Partnership requires participating retailers to maintain a computerized crime -gun trace log
and alert system, to require purchaser declarations and identification checking mechanisms, to
provide point -of -sale signage alerting customers of their legal responsibilities, and to prohibit sales
without background check results; and
WHEREAS, the Village Council of the Village of Key Biscayne, joining other Miami -Dade
County municipalities, commends the voluntary efforts of responsible gun manufacturers and
distributors who contribute to reducing gun violence and gun -related crimes in our communities, and
supports the growing coalition of municipalities in support of initiatives to reduce gun violence and
illegal firearms trafficking.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. The recitals stated above are adopted by reference and confirmed.
Section 2. The Village Council supports efforts to reduce gun violence and illegal
firearms trafficking through responsible gun sales and marketing practices.
Section 3. The Village Manager is directed to coordinate with the Chief of Police to
partner with other municipalities in support of this initiative and to work with gun and ammunition
suppliers to encourage broader adoption of best practices safeguards associated with firearm and
ammunition sales and marketing.

Section 4. The Village Clerk is directed to transmit a copy of this Resolution to other
South Florida municipalities, the Miami -Dade and Florida League of Cities, Inc., members of
Florida's Congressional Delegation and federal or state authorities as directed by the Village
Manager.

Attached please find a copy of Resolution 2014-4, a resolution supporting efforts to reduce gun violence and illegal
firearms trafficking through more responsible gun sales and marketing practices, directing the Village Manager to
Coordinate with the Police Chief to partner with other municipalities to create a coalition in support of this initiative and
to work with gun and ammunition suppliers to encourage the consideration of sales and marketing safeguards.
This Resolution was unanimously passed and adopted by the Mayor and Village Council of the Village of Key Biscayne on
January 28,2014. The Village Council of the Village of Key Biscayne urges your municipality to adopt a similar resolution.
