AN ORDINANCE ALLOWING A VARIANCE for a SIDE YARD SETBACK FROM 15
FEET TO 4 FEET FOR THE PROPERTY LOCATED AT 509 W. MAIN STREET IN
THE VILLAGE OF PLAINFIELD, WILL COUNTY, ILLINOIS
WHEREAS, Dunn, Martin and Miller have requested a variance for side yard
setback from 15 feet to 4 feet for the east lot line, a variance to reduce the required parking
drive aisle width from twenty-six feet to twenty-four feet, a variance to reduce the required
parking stall dimensions from 18.5' x 9' to 18' x 9', a variance for the required fifteen (15)
foot yard set back and ten (10) foot landscape buffer between a BTD and a residential
area; and
WHEREAS, the Zoning Board of Appeals have made the following findings based
upon the evidence presented to it:
A. The variance is in harmony with the general purpose and intent of this chapter.
B. Strict enforcement of the chapter would result in practical difficulties or impose
exceptional hardships due to special and unusual conditions which are not generally found
on other properties in the same zoning district.
C. The property cannot yield a reasonable use if permitted only under the conditions
allowed by this chapter.
D. The variance, if granted, will not alter the essential character of the neighborhood
and will not be a substantial detriment to adjacent property.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF PLAINFIELD, AS FOLLOWS:
Section 1.The President and Board of Trustees of the Village of Plainfield hereby
adopt the findings of the Zoning Board of Appeals as its own and that the petition
requesting a variance from setbacks as requested by Dunn, Martin & Miller to the real
estate hereinafter described be granted.
Territory Described.
LOT 2 AND LOT 3 (EXCEPT THE NORTHEASTERLY 5 FEET THEREOF)
IN O.L. GAYLORD'S SUBDIVISION OF PART OF LOT 10 IN ARNOLD'S
SUBDIVISION OF PART OF THE SOUTHEAST '/4 OF SECTION 9,
TOWNSHIP 36 NORTH, RANGE 9, EAST OF THE THIRD PRINCIPAL
MERIDIAN, IN WILL COUNTY, ILLINOIS.
Section 2. There is hereby granted a variance for side yard setback from 15
feet to 4 feet for the east lot line, a variance to reduce the required parking
drive aisle width from twenty-six feet to twenty-four feet, a variance to reduce
the required parking stall dimensions from 18.5' x 9' to 18' x 9', and a
variance for the required fifteen (15) foot yard set back and ten (10) foot
landscape buffer between a BTD and a residential area to four (4) feet.
