Re: Purisima Creek Redwoods Open Space Preserve
Dear Mr. Gruver:
Thank you for your letter of July 21, 2005 regarding concerns about maintenance work done at
Purisima Creek Open Space Preserve.
The Board of Directors reviewed your correspondence at their regular meeting last night. We
share your concern about any activity that impacts native flora and fauna. However, in order to
effectively manage the over 50,000 acres of land that the District has responsibility for, including
approximately 213 miles of roads and trails, it is often necessary to utilize heavy equipment,
especially on roads. Sometimes this has an impact upon some of the beautiful flowers and other
vegetation that grace the preserves' roads and trails.
In this case the work being done was the removal of brush adjacent to a dirt roadway. This work
is necessary in order to maintain access for District patrol and maintenance, as well as
emergency fire and medical response vehicles. The work is done to a standard which is agreed
upon with local fire agencies to ensure that areas within the preserve can be accessed for
emergency situations and routine preventative patrols. Mowing is limited to specific roads
within the preserve and the vast majority of the preserve is left in a natural condition. Many
miles of trails throughout the District are maintained with hand tools.
Throughout our preserves we have surveyed and mapped locations of threatened and endangered
species. We have trained our field staff to be cautious when working in those areas. Although
the leopard lily is a beautiful plant, it is not a threatened or endangered plant. Unfortunately, it
is sometimes trimmed in the process of brushing District roads and trails.
The District has a program to control non-native invasive plants, both in Purisima and other
preserves. Projects are selected by highest priority regarding threat of the invasive plant and
available budget and labor force. In Purisima, we are currently focusing on removal of French
broom and acacia on Harkins Ridge Trail, In 2004, over 10,000 hours were spent controlling
invasive plants in all District preserves. A great deal of effort is also made to eradicate poison
oak in areas where people will be directly affected by the presence of this plant on or near trails.
District staff are very sensitive about damage to the local environment and they work hard to
minimize such damage.

I am writing to make a complaint.
First though, I want to ask if any of you have ever walked/hiked in Purisima Regional
Open Space Preserve. The reason I'm asking is that I do hike there almost daily, and my
wife hikes there whenever her busy schedule allows. It is one of the most beautiful
parks in California, and we are extremely lucky to live so close.
One of the very best hikes is the newly reopened Grabtown Gulch Trail. There are
animals, birds, Redwoods, and many varieties of native plants.

Yesterday (071905) as I was returning to my car down Purisima Creek Trail, I passed a
tractor/mower and a truck, both driven by your employees. I was hoping they were
going to get rid of many of the non-native species that have invaded Purisima, remove
the rampant poison oak from the Soda Gulch Trail, and clear the growth in the middle of
the trails to lessen the chance of picking up ticks as we hike. I had mild apprehension
as to their ability to navigate the roads/trails, however, as they had driven off the road
and were causing quite a bit of damage to the shoulder.
Today... well today I Found what I can only describe as wanton destruction of much of
the park's plants, and severe damage to the Grabtown Gulch Trail. I do not know if those
two fellows were told to actively remove native plants while leaving non-native
invaders, and to drive all over the place while destroying those native species, but that
is exactly what happened.

Ferns, flowers and trees are gone and the trail is damaged in many places, yet broom,
pampas grass, weeds„ and scruffy growth in the middle of the trail are still happily
plying their trade.
There must be someone who is to supervise/manage the young men who have been
tasked with keeping up the park... well, that someone has failed.
Please ensure that there is no repeat of this. Thank you.

Re: Trails at Windy Hill Open Space Preserve
Dear Windy Hill Open Space Preserve Visitors:
Thank you for your interest in the trails at Windy Hill Open Space Preserve. The District's Board
of Directors considered your recent letters at their regular meeting last night.
In your letter, you inquire specifically about an area where people have veered off the Spring Ridge
Trail just below the intersection with the Betsy Crowder Trail to connect to the Meadow Trail.
Although the area has no official trail designation, it has received a fair amount of use in the past, as
evidenced by the trampled vegetation and compacted ground surface. These impacts on the land
from use where there is no official trail prompted District Rangers to post signs indicating that the
area is closed for resource protection.
Our most recent trail projects at Windy Hill include the completion of the Meadow Trail, which I
am happy to know you enjoy, and the completion of draft design plans for an observation deck at
Sausal Pond. Currently, the District is in the midst of a busy construction season, managing a
number of new trail construction projects at various other Preserves. However, we will discuss
prioritization of pending trail projects, including your request for a trail connection at Windy Hill, at
our next Use and Management Committee meeting scheduled for August I 1 at 2:00 p.m. at the
District's Administrative Office. We understand that the District's General Manager has written
you a separate letter advising you of the Use and Management Committee meeting and enclosed an
agenda for that meeting. We will keep you apprised of the timing for consideration of new trails at
Windy Hill.

foot trail segment connecting Meadow Trail with Spring Ridge
Trail.
Why not name it the "Senior Trail"??
We love Windy Hill, and only WISH we could all climb to the top!

at the Sequoias because of its immediate access to the wonders of Windy Hill, I

that experience.

frustrated as we started up Spring Ridge from the intersection of the trail from the
parking lot, as the short link to the Meadow Trail, which has been closed for Resource
Protection, remains closed.
I anticipate that your staff has never considered what an impediment closure of this
short stretch has been to senior hikers. See enclosed map. Yes, some days we are peppy
enough to go to the top and come down Hamm's Gulch. But the majority of the days we
are lookingfor shorter hikes. Closure of this link to the Meadow Trail precludes our
getting to the Hamm's Gulch trail and other shorter loops. Hamm's Gulch is much
preferred in the summer months due to its shadiness, while the Spring Ridge has no
leafy cover and is exposed and sun baked.

Please implement your Good Neighbor policy by reopening this 149-foot trail segment.
All of us, who live at Sequoias, are enthusiastic supporters of the Open Space District.
In 1972 1 can recall doing the grass roots organizing for Los Altos, which led to the

As you are aware, on Windy Hill Preserve there is a short section
of trail between. Spring Ridge Trail and Meadow Trail now closed for
environmental reasons. This closing is a big disappointment to many
residents around here because it prevents making a loop which is
picturesque and within their abilities. j
Can't this few hundred feet stretch of trail be rebuilt in such a way
to maintain the landscape and still allow nature-lovers to get through?

please, Please, PLEASE. . .Reopen the 149-foot segment of trail that
connects Spring Ridge Trail with the Meadow Trail. The purpose of that
segment is in being a LINK. Its closure makes it a Barrier.
Its value as a Link is in greatly increasing the variety of loop-
trails accessible within a short hiking distance. This benefits people
with physical limitations and those who hike the trails frequently but
have a limited amount of time.
It now serves as a frustrating Barrier. When hiking on Spring Ridge
Trail, we look across the 149 feet to the trail where we wish we could
be and watch other hikers over there--so near and yet so far.
Thank you so much for your earliest possible action on this important
matter. I would also like to thank you more generally for the time you
put into the Open Space on our behalf. We greatly appreciate your

Approve the Side Letter Extension Agreement of the Memorandum of Agreement with
Midpeninsula Regional Open Space District Field Emplo es'Association for the period of April
1, 2005 through March 31, 2006
GENERAL MANAGER'S RECOMMEND S
1. Approve the Extension of the Memorandum of Agreement dated April 1, 2003 through
March 31, 2005 for the period of April 1, 2005 through March 31, 2006.
2. Award a 2.5 point salary increase for members of the Midpeninsula Regional Open Space
District Field Employees Association (MROSDFEA), effective April 1, 2005.
3. Appropriate an additional $48,500 for salaries and benefits in the 2005/2006 budget from the
Land Purchases account with the budget to be adjusted at mid-year.
4. Approve the attached amended Position Classification and Compensation Plan.
DISCUSSION
The District Rangers, Open Space Technicians, Lead Open Space Technicians and Equipment
Mechanic Operators had been represented by SEIU Local 715 for a number of years, In January
2005, the time period in which negotiations for a new contract would have normally begun, the
represented employees petitioned to decertify from SEIU and further petitioned to form
MROSDFEA. The process for de-certification and re-certification required an election, which
was certified by the State Mediation Department, and a 30 day waiting period. MROSDFEA
also requested Agency Shop status, and the District held a meet-and-confer on this status, which
was agreed to and has been included in the attached Extension Agreement.
It was July of this year, over three months past the existing contract expiration, before
MROSDFEA and management were able to sit down for the first negotiation session. In light of
the delay in beginning negotiations, the need for extended discussion and analysis regarding
health insurance and retiree medical benefits (further detail noted below), and the fact that the
office, supervisory and management employees have already received a 2.5 point (approximately
2.52%) annual salary increase, the District proposed and negotiated an extension to the existing

contract until March 31, 2006, with the following provisions: 1) a 2.5 point (approximately
2.52%) annual salary increase, retroactive to April 1, 2005; 2) an invitation for two members of
MROSDFEA to participate in a District-wide Health Insurance and Retiree Medical Task Force;
and 3) an agreement to begin negotiations for a new contract beginning no later than the second
week of January 2006. The District was notified on July 26, 2005 that the membership of
MROSDFEA voted to extend the contract with these three provisions.
Regarding the health insurance and retiree medical noted above, management has been aware
that retiree medical benefits are a primary concern of MROSDFEA. In fact, in the existing
contract, via Side Letter Agreement, the District agreed to conduct a feasibility study to address
enhanced retiree medical benefits, and share the study with the Union no later than six months
prior to the expiration of the Agreement. The District did provide the information, in compliance
with the Side Letter Agreement, to all District employees in the form of all-staff meetings and
numerous handouts. At the same time, and included in the same study, the District has expressed
to all staff the desire to contain the cost of increased health insurance premiums currently paid at
100% of the Kaiser premiums for all regular employees and their families (if applicable).
As a result of the study, it was very clear that the complexity and costs of enhanced retiree
medical benefits warranted more analysis. In addition, staff(MROSDFEA members as well as
the office, supervisory and management employees) had not yet had an opportunity to have
discussions about the various options for increasing retiree medical benefits. Therefore, the
District decided to form a Health Insurance and Retiree Medical Task Force to offer the
opportunity to more deeply explore the various options and learn from a cross section of staff
what is most important to employees regarding these two benefits. The task force will begin no
later than September 2005.
As a result of awarding a 2.5 point salary adjustment to the salary plan for these positions, a
minor modification to the District's point structure will be made for ease of administration. The
numbering system associated with the points will be adjusted to keep positions assigned to whole
numbers rather than fractions. There is no fiscal impact as a result of these changes. The
Extension Agreement and Position Classification and Compensation Plan will reflect this change
and staff will be notified, so they can easily see that the adjustment reflects the 2.5 point salary
adjustment. This adjustment is exactly what was done for the office, supervisory and
management positions when the 2.5 point salary adjustment was awarded at your March 23, 2005
meeting (see Report No. R-05-37).

SIDE LETTER EXTENSION AGREEMENT
PURPOSE: Extend the term of the current Memorandum of Agreement (MOA)
Effective April 1, 2003 through March 31, 2005 for the period of April 1,
2005 through March 31, 2006 under the following terms and conditions:
I The Midpeninsula Regional Open Space District (District) and the Midpeninsula
Regional Open Space District Field Employees Association (Association)
(formerly represented by SElU Local 715) agree that the term of the
Memorandum of Agreement (MOA) entered into between the District and SEIU,
Local 715 effective April 1, 2003 through March 31, 2005, shall be extended for
the period of April 1, 2005 through March 31, 2006 subject to the terms and
conditions set out in this Extension Agreement (MOA Extension).
2. The District and Association agree to implement the Agency Shop provisions
contained in Attachment "A" effective the first pay period in August 2005 and
incorporated by reference into this MOA Extension.
3. Within sixty (60) days of Association ratification and District Board approval of
this MOA Extension, District will convene a committee of District employees,
including two (2) Association representatives for the purpose of researching and
reviewing retiree medical and health insurance options for future District-wide
implementation recommendations.
4. Effective April 1, 2005 and payable as soon as possible after Association
ratification and District Board approval of this MOA Extension, Association Unit
members will receive a two and one-half point, (approximately 2.52%), wage
increase. (Note: Due to the awarding of a 2.5 point salary adjustment to the
salary plan, a minor modification to the District's point structure will be made for

fees or employee dues which are applicable to public sector labor
organizations. Prior to a non-member unit employee having any

financial information to unit employees and the District on or before
September I of each calendar year. This financial information must
itemize and adequately describe all categories of expenses. This financial j
information must cover local expenditures as well as uses made by
county, state, national and international organizations with which the
Association is directly or indirectly affiliated and to whom the
Association transmits a portion of its dues and/or representation service
fee funds.
2. The Association shall make available, at its expense, an expeditious
administrative appeals procedure to non-member unit employees who
object to the payment of any portion of the representation service fee.
Such procedure shall provide for a prompt decision to be made and the
impartial decision-maker jointly selected by the union and the objecting
employee(s). The Association shall make available a copy of such
procedure to non-member unit employees and the District prior to the
time that any non-member unit employee becomes subject to the
payment of representation service fees.
3. When an authorized agent of the District is served with written notice by
a non-member unit employee or employees, or by the Association, that a
dispute exists involving employee rights with respect to: 1)
representation service fee expenditures or associated Association
obligations; or 2) the employee exemption described in this section, the
Association shall thereafter deposit such disported dues or fees in an j
interest bearing escrow or comparable account pending final resolution
of the dispute, and shall so advise, in writing, the other and the
complaining employees. The District shall not be obligated to take any
other or further action pending the resolution of the dispute. Final
resolution as used in this subdivision shall mean resolution of the dispute
by way of legally binding settlement agreement between the employee(s)
and the Association, or non-appealable final judgment of an
administrative agency, the Public Employment Relations Board and/or
court of competent jurisdiction. The sole obligation of the District with

respect to such disputes is as set forth in this paragraph. The District
shall not be made a party to administrative or court proceedings, except
to the limited extent when such administrative body and/or court
determine such to be necessary purpose for the ur ose of enforcing its order or
judgment. In such event, the Association shall pay the District's
attorneys' fees and costs,as further described in this section.
E. Revocation of Agency Shop
The agency shop provisions of this Article may be revoked by the Union
membership in the manner provided under Section 3502.5(b) of the California
Government Code. In the event of revocation, provisions for Maintenance of
Membership shall remain in force. Notwithstanding any of the above, Agency
Shop and Maintenance of Membership provision shall also expire at any point
when the Association ceases to be the recognized collective bargaining
representative for the unit.
F. Acknowledgement
The parties acknowledge that the Association does not contain management
employees and that the law precludes the parties from applying agency show
requirements to such employees.
SECTION 2.6 - HOLD HARMLESS
H. Indemnity
The Association hereby agrees to defend, indemnify and hold harmless the
District and its officers and employees from any claim, loss, liability or cause of
action of any nature whatsoever arising out of the operation of this Article.

Visitor Satisfaction Survey Results
GENERAL MANAGERS RECOMMENDAMN
Accept this informational report on the online Visitor Satisfaction survey.
BACKGROUND
Earlier this year, with input from the Legislative, Finance and Public Affairs Committee, District
staff conducted its first online survey of preserve visitors as a way to enable constituents to provide

feedback about the District's preserves and programs. The goals of the survey were to use a new
method for gathering information, to ask questions regarding the District's reputation and provide a
vehicle for visitors to comment and rate the District.
DISCUSSION
The District received 360 responses from survey participants via the District Web site. It is
important to note that the informational survey was intended to allow the public to share impressions
of the District. The survey is qualitative and not statistically relevant.
Participants in the survey come from a broad range of cities and are frequent visitors to the
preserves: 38% report visiting 1 to 5 preserves each year; 38%report visiting 11 to 15 preserves per
year.
Awareness of the District is very high with 97% saying they are aware that the District manages
various open space preserves. Familiarity with the District is also high with 70% reporting being
"very familiar" with the District; 29% were familiar with more than 15 preserves.
When asked how participants obtain infonnation about the District, 70%reported logging on to the
District's Web site, 33% said they get their information from Preserve Bulletin Boards, and 22%
from the District Newsletter. Other methods mentioned were District staff/volunteers and
membership organizations.

Participants were also asked to rate the importance of District activities. The top three District
activities are: constructing and maintaining trails (79%), acquiring open space lands (75%) and
protecting and restoring natural environment (62%).
When rating the District's current performance in a number of areas, 61% said the District did a
"good or excellent"job in protecting and restoring the natural environment; 56% of respondents
rated the District as "good to excellent" in both acquiring open space lands and constructing and
maintaining trails.
Mountain biking was the activity 67% selected as most enjoyable when visiting a District open space
preserve. Favorite preserves mentioned were El Corte de Madera, Sierra Azul, Purisima, Long
Ridge and Montebello. Several respondents listed non-District areas such as Nicene Marks.
Responses from mountain bikers express a desire for more trails and access. It is interesting to note
that 67% of the respondents listed mountain biking as a top-rated activity, as it helps confirm staff s
belief that this user group is the most online savvy group.
Out of the 360 respondents, 144 provided open-ended responses for questions or ideas the District
should consider. Many comments indicate mountain bike riders who participated in the survey are
somewhat dissatisfied and feel unheard.
Of the survey respondents, 69% are not on the District mailing list. As a result of conducting this
survey, 86 individuals provided contact information and requested to be added to the District mailing
list.
CONCLUSION
District staff is learning to use the Web site as another way to gather input from the public. This
informal survey provides information about the impressions some members of the public have about
the District and serves to aid in confirming the success of and determining the need for adjustments
to current public outreach and District programs.

Notice of Contract Completion for Demolition Services and Construction of a Parking and Staging Area at
Pulgas Ridge Open Space Preserve
GENERAL MANAGER'S RECOMMENDATION
Authorize the General Manager to execute the attached Notice of Contract Completion for the Demolition
Services and Construction of a Parking and Staging Area Project at Pulgas Ridge Open Space Preserve.
DISCUSSION
At the Board meeting on December 15, 2004, you awarded a contract for the demolition of the former Hassler
Health Home waste treatment facility and construction of a new parking and staging area at Pulgas Ridge
Open Space Preserve to Casey Construction of Emerald Hills, CA, in the amount of $200,248, plus a
contingency amount of up to $30,037, for a total amount not to exceed $230,285 (see Report R-04-119B).
The new parking and staging area includes twenty-one(21) spaces for passenger vehicles, two(2)handicap
spaces, a"vault" restroom unit similar to those located at other District preserves, a pedestrian stile,two (2)
sets of new signboards,trail directional signs, and a new monument sign at the entrance to the lot.
Staff was pleased with Casey Construction's performance and accepted construction of this project as
complete in mid-May, but was unable to prepare the Notice of Completion until recently due to a delay in
receiving final sign-off from San Mateo County. Change orders were approved in the total amount of
$9,732.98 for minor additional work including the off-hauling of additional vegetation material, off-hauling
of excess concrete from one of the demolished buildings, excavation around an existing man-hole, and
removal of underground pipes. An additional change order was approved as a result of the District's desire to
install a manually operated pipe gate instead of the planned electric gate. This change order resulted in a
credit in the amount of$19,263.00. Therefore, change orders totaling a credit of$9,530.02 were approved for
this project. Since the bidding process made provisions for these adjustments to the project's scope,the
change order procedure proceeded smoothly. The total amount payable to Casey Construction for the project
is $190,717.98,which is $39,567.02 below the approved contract amount(including contingencies).
The District will pay the remaining 10% of the payments due to Casey Construction in accordance with the
contract documents 35 days following the date the Notice of Completion is filed with the County. Staff has
reviewed and determined that all payrolls, material bills, and other debts connected with the contract have
been addressed.

Recommendation for Referring the Issues of Controlling Sudden Oak Death and Slender False
Brome to the Use and Management Committee
DIRECTOR LITTLE'S RECOMMENDATION
Discuss and direct the Use and Management Committee to address two important resource
management issues: controlling sudden oak death and slender false brome on District lands.
DISCUSSION
I am requesting that the Board authorize the Use and Management Committee to meet as soon as
possible to address two important resource management issues: sudden oak death (SODS) and
slender false brome (SFB).
In my opinion, both SODS and SFB are serious ecological threats to District preserves for the
following reasons:
1. SODS appears to be eradicating a major native understory tree (tanoak), as well as the
many insect and other native species that form an intricate web of life dependent on
healthy tanoaks.
2. In Oregon, slender false brome is believed to be dramatically suppressing germination of
Douglas Fir in 10,000 acres of native forest infested by the grass. If SFB is allowed to
spread through California forests it may have the same effect on Douglas Fir, coastal
redwoods (which do not grow in Oregon), and other native woodland trees, wildflowers
and shrubs.
I recommend that the Use and Management Committee meet immediately to assess the District's
current protocols, resources, and approaches to controlling SODS and SFB and report back to the
full Board with recommendations for whether additional policies, resources, or measures are
necessary or desirable to deal with these problems in the most effective way the District can.
Finally, in a more general sense, I believe that we face a serious challenge: to insure that the
District's resource management policies and activities are truly effective in view of the biological
realities of these problems in the field. In my opinion, the District needs to develop additional
methods, resources and funding to remedy the resource management problems we face. SODS
and SFB are probably the most urgent of these problems, but there are many other critical issues
as well, which I will address in a longer memo to the full board and staff shortly.

Authorization to Execute a Contract with Jakaby Engineer' g to Provide Design Services in an Amount
Not to Exceed $60,000 for Five (5) Pedestrian Bridges at I Corte Madera Creek Open Space Preserve
GENERAL MANAGER'S RECOMMENDATION-
Authorize the General Manager to execute a contract with Jakaby Engineering of Campbell, California, in
an amount not to exceed $60,000 to provide design services for the development of five (5) pedestrian
bridges at El Corte de Madera Creek Open Space Preserve.
BACKGROUND
On January 21, 2004,the Board of Directors approved the El Corte de Madera Creek Open Space
Preserve Watershed Protection Program and Mitigated Negative Declaration (see Report R-04-10). The
purpose of the Watershed Protection Program is to protect and restore watershed integrity while
maintaining opportunities for year-round multiple use recreation and environmental education. The
Watershed Protection Program provides for substantial physical improvements to the preserve's trail
system for long-term erosion control.
Year Two of the El Corte de Madera Creek Watershed Protection Program is underway. On March 23,
2005, the Board approved the Planning Department budget for Fiscal Year 2005-2006, which included
$250,000 for sedimentation reduction and erosion control work in E1 Corte de Madera Creek Open Space
Preserve(see Report R-05-38). The project budget included planning and design funds for replacement
of existing bridges as well as new bridge construction.

2002 Road and Trail Erosion Inventory for the preserve. Both trails are quite popular with preserve
visitors and show evidence of erosion as a result of poor trail design that does not accommodate nor allow
for natural hydrologic function.
The current alignment of the El Corte de Madera Creek Trail follows a former logging road and is very
near, and for a significant length within,the stream corridor of El Corte de Madera Creek. Proposed
improvements include redesigning the road to trail width and replacing failing culvert crossings with
bridges. Three bridges will be constructed on this trail: two (2) short-span bridges of approximately 20
feet, and one(1) longer span bridge located at a confluence of El Corte de Madera Creek.
The fourth bridge will be located on Giant Salamander Trail. This longer-span bridge will replace a
rusted, failing culvert crossing currently in use by preserve visitors. This trail is one of the most popular
mountain biking trails in the preserve. The remainder of the Giant Salamander Trail is planned for
substantial upgrades and work has begun with volunteers to reroute a portion of it to reduce erosion.

ln July 2005, staff requested qualifications and proposals from various engineering firms for bridge
design services for E| Corte dc Madera Creek Open Space Preserve. Staff specifically looked for firms
| having relevant experience in providing all necessary engineering services including: |) geotcubnixu|
investigations, 2)geologic reports, 3) detailed construction documents, 4) preparation and acquisition Of �
San Mateo County building permits,and 5)construction administration. |
Of the two(2)proposals submitted, staff determined that Jakaby Engineering was best Suited to provide
| the necessary design, engineering, and permitting services. 1[he firm has ulong, positive history with the
District, having completed sixteen (16) past projects with tile District, including recent engineering �
services to install an identical bridge on Virginia Mill Trail in the same preserve. The firm has selected |
the munnc engineering geologist that onnnp|etedthe Road and Trail Erosion Inventory for the preserve to �
perform tile geologic report for the bridge footings. The engineering geologist will also be responsible for �
� erosion control associated with dlc project. This will u||ov continuity because he is already thoroughly �
familiar with the underlying geology and erosion potential of the preserve through his involvement with
the Watershed Protection Program. �
Staff recornmends retaining Jakaby Engineering for an amount not to exceed $60,000, which includes �
design services for five (5)bridge locations plus u 15% contingency. �
FUNDING
Tile Planning Department budget for Fiscal Year 2005-2006 includes $60,000 as part of the Water
Protection Program for all anticipated costs ofthis project, including all necessary engineering design
services to prepare construction plans, specifications, and complete Sun Mateo County building permit
applications.

Approval of Salary Adjustment and Meritorious Pay Award for the General Manager and
Approval of Amendment to General Manager's Employment Agreement
AD HOC BOARD APPOINTEE EVALUATION COMMITTEE'S RECOMMENDATIONS
1. As a result of the Board's evaluation of the General Manager's performance for the period
of March 10, 2004 through March 9, 2005 and compensation review for the position, the
Ad Hoc Board Appointee Evaluation Committee recommends a 5% meritorious pay
award based on the General Manager's performance, a 3.75 point salary parity adjustment
and a 2.5 point cost of living salary adjustment for Fiscal Year 2005-2006 (a total of 6.25
points or 6.42%), retroactive to March 9, 2005.
2. Adopt the attached resolution amending the General Manager's Employment Agreement
to reflect an adjusted salary of$157,997.48 and approving a 5% meritorious pay award
totaling $7,423.30.
DISCUSSION
The Board completed its annual evaluation of the General Manager's performance and
compensation for the position at its July 27, 2005 meeting. The Ad Hoc Board Appointee
Evaluation Committee, composed of Directors Hassett(Chair), Cyr and Hanko, met with the
General Manager to review his compensation.
The District General Manager's current salary is $148,465.97 annually. The compensation study
conducted for the District this year for all positions shows that figure is low for comparable
positions. The study indicated that this salary is 7.5 points (approximately 7.9%) below the
Labor Market median. (Note: The District's compensation plan is based upon a point system in
which each point is very close mathematically to one percent, but because of compounding it
results in an amount slightly higher than the total points award, i.e. a 5 point increase is
approximately 5.2%.) Based on the General Manager's performance and the results of the salary
survey, the Committee recommends that the Board approve a salary adjustment for the District
General Manager as follows: a cost of living adjustment (COLA) of 2.5 points, which is the
same COLA received by all District employees for Fiscal Year 2004-2005, as well as a salary
parity adjustment of 3.75 points to bring the position's total salary closer in line with positions of
comparable complexity in other local agencies. This would be a total salary adjustment of 6.25
points or 6.42%. By awarding one-half of the parity amount, this recommended adjustment is in
line with the parity increase of one-half of the recommended amount for the department

managers approved as part of the budget by the Board in March 23, 2005 (see Report No. R-05-
37). The General Manager's adjusted salary would therefore be $157,997.48 (a 6.42% increase).
This increase should be retroactive to March 9, 2005, the anniversary date for his Employment
Agreement. The Employment Agreement calls for an annual salary review and contemplates a
determination of an adjustment each anniversary date; therefore, a retroactive date for this
adjustment is appropriate.
Based on the Board's review of the General Manager's performance during the evaluation period,
the Committee also recommends that a 5% meritorious pay award ($7,423.30) be granted the
General Manager. This award is not a salary adjustment, but rather is granted as a one-time
award in recognition for performance during his year of service from March 10, 2004 through
March 9, 2005. The Board is very pleased with the General Manager's overall performance
during the past year. Significant District accomplishments included (*denotes direct

special districts, including passage of Proposition I A by the voters in November 2004.
• Worked with Senator Joe Simitian's office to extend the District's $325,000 Habitat Conservation
Fund Grant for the Perry Property addition to Purisima Creek Redwoods.*
• Worked with Assembly Member Rebecca Cohn's office on AB 1195 (Eminent Domain). This Bill
became law on April 1, 2004 and San Mateo County LAFCo initially approved the Annexation on
April 7, 2004 with their final affirmative action on September 7, 2004.*
Administration Department:
• Hired for 31 positions (including 8 promotions, 12 seasonals, I intern, I temporary and 8 permanent
staff). This is over the last 15 months. This year's turnover rate was 10.12%. (The previous year's
turnover rate was 11.5%.)
• The Workplace Enhancement Plan (WEP) implementation is ongoing, with regular department
meetings, as well as individual meetings and an ongoing WEP evaluation system incorporating a
review at each Management Team Meeting. There are also departmental meetings and
interdepartmental meetings that follow to increase communication opportunities. Additionally,
"one-on-one" meetings are scheduled within each department (including one-on-one meetings
between the General Manager and each Department Manager). Field staff meetings were attended
on several occasions, with the topics including: Coastal Annexation, State budget, and Ranger

authority relative to proposed legislation and a possible Attorney General's opinion. There were also
two staff presentation sessions from the health benefit consultant, plus written answers to the many
questions those presentations generated. As a result, a staff task force is being formed (including the
represented group)to receive additional input on the health benefit and health retirement issues.*

Approval of Salary Adjustment and Meritorious Pay Award for District General Counsel and
Approval of Amendment to District General Counsel's Employment Agreement
AD HOC BOARD APPOINTEE EVALUATION COMMITTEE RECOMMENDATIONS
I As a result of the Board's evaluation of the General Counsel's performance for Fiscal
Year 2004-2005 and compensation review for the position, the Ad Hoc Board Appointee
Evaluation Committee recommends a 5% meritorious pay award based on the General
Counsel's performance, a 3.5 point salary parity adjustment and a 2.5 point cost of living
salary adjustment for Fiscal Year 2005-2006 (a total of 6 points or 6.15%), retroactive to
April 1, 2005.
2. Adopt the attached resolution amending the District General Counsel's Employment
Agreement to reflect an adjusted salary of$116,960.89 and approving a 5% meritorious
pay award totaling $5,509.09.
DISCUSSION
The Board conducted its annual evaluation of District General Counsel's performance and
compensation for the position at its July 27, 2005 special meeting. The Ad Hoc Board Appointee
Evaluation Committee, composed of Directors Hassett (Chair). Cyr and Hanko, met with the
District's General Counsel to review her compensation.
The District General Counsel's current annual salary is $110,181.87 based on a 4/5 time position.
The compensation study conducted for the District this year for all positions shows that figure is
low for comparable positions. The study indicated that this salary is 7 points, or approximately
7.3%below the Labor Market median. (Note: The District's compensation plan is based upon a
point system in which each point is very close mathematically to one percent, but because of
compounding it results in an amount slightly higher than the total points award, i.e. a 5 point
increase is approximately 5.2%.) Based on the General Counsel's performance and the result of
its salary survey, the Committee recommends the Board approve a salary adjustment for District
General Counsel as follows: a cost of living adjustment (COLA) of 2.5 points, which is the same
COLA received by all District employees for Fiscal Year 2004-2005, as well as a salary parity
adjustment of 3.5 points (one-half of the parity amount) to bring the position's total salary closer
in line with positions of comparable complexity in other local agencies. This would be a total
salary adjustment of 6 points or 6.15%. By awarding one-half of the parity amount, this
recommended adjustment is in line with the parity increase of one-half of the recommended
amount for the department managers' parity increase approved as part of the budget by the Board

in March 23, 2005 (see Report No. R-05-37). The General Counsel's adjusted annual salary
would therefore be $116,960.89 (a 6.15% increase) retroactive to April 1, 2005.
Based on the Board's review of District General Counsel's performance during the past fiscal
year, the Committee also recommends that a 5% meritorious pay award ($5,509.09) be granted.
This award is not a salary adjustment, but rather is granted as a one-time award in recognition for
performance for her year of service during Fiscal Year 2004-2005. The Board is very pleased
with District General Counsel's overall performance during the past year. Significant
accomplishments of the Legal subprogram (General Counsel and Assistant General Counsel)
have included:
LITIGATION
• HALF MOON BAY COASTSIDE FOUNDATION V. MROSD
This lawsuit challenged LAFCo's approval of the District's application for expansion of its
boundaries to the Coast. This lawsuit sought to overturn LAFCo's approval on the following
grounds: 1) LAFCo's declining to reconsider its April 2004 approval after reconsideration
requests were filed and heard by LAFCo in June, 2004; 2) LAFCo's alleged failure to provide
public notice of the June 2004 annexation protest hearing and process as required by statute;
3) alleged failure to comply with the CEQA process; and, 4) alleged failure to conduct the
protest process and count and validate protests in the manner required by law.
General Counsel worked closely with outside counsel on all phases of this litigation to
successfully defend this suit. The suit involved two requests for temporary restraining orders
to halt the protest process, evidentiary hearings, and extensive briefing. The District
prevailed in August 2004 and the court declined to issue an injunction stopping the
annexation process. The litigation was subsequently dismissed.
• CITIZENS FOR RESPONSIBLE OPEN SPACE V. MROSD
Current litigation seeking to void LAFCo's approval was filed in November 2004 and is
pending. The current lawsuit is focused on the sufficiency of the protest hearing notice and
the legality of the protest process.
General Counsel continues to work closely with outside counsel on the case. Briefing will
likely occur from August to October with a hearing date in October.
• MROSD V. PORTOLA INVESTMENT COMPANY
This quiet title action was filed to obtain fee title to Dennis Martin Road in Thornewood
OSP. The case was successfully concluded and a default judgment obtained in May 2005.
The judgment has been entered and the case is concluded. Assistant General Counsel
provided important legal and historic parcel research.
• MROSD V. LANDI
This lawsuit sought damages for the restoration costs of an encroachment in Aldercroft Creek
at Bear Creek Redwoods OSP. The case was successfully settled, the site restored, and the
District recovered its damages. Assistant General Counsel provided important assistance in
this case.

• VANDEWEGHE V. MROSD
This lawsuit challenged the validity of a District access easement over property adjacent to
the Bishop-Krone area of El Sereno OSP. The title company accepted the District's tender of
defense and worked closely with District Counsel and Assistant General Counsel to prepare
for and litigate the case. The court ruled in the District's favor. An appeal is pending.
• FOGARTY V. MROSD
In this lawsuit the plaintiffs assert a right to an access easement over Coal Creek OSP and a
right to upgrade the status of a pre-existing road on a conservation easement the District
holds over a portion of the property. The District's title company is providing the defense to
plaintiffs' complaint. Trial is scheduled for September.
• SARATOGA COUNTRY CLUB V. MROSD
This lawsuit seeks to close the District's Fremont Older OSP staging area as a nuisance and
as allegedly operating in violation of Santa Clara County's Zoning Ordinance. The District's
demurrer to the lawsuit was granted in part and overruled in part. Settlement discussions are
underway. CJPIA is paying the major portion of the litigation costs.
• NRDA PROCEEDINGS REGARDING GUADALUPE RIVER WATERSHED
The Board approved the NRDA consent decree in December and it has been filed with the
court to obtain final approval.
MONITORING AND SELECTION OF OUTSIDE COUNSEL
In addition to General Counsel's duty as in-house counsel, she also assists the Board and General
Manager in determining whether their legal issue or project is such that it requires the expertise
or resources of outside specialized counsel. If outside counsel is retained, General Counsel
approves the selection of counsel (except where insurance coverage gives the insurer the sole
right to select counsel), advises regarding the appropriate cost and service factors to be
anticipated, collaborates with outside counsel so that in-house resources can reduce legal costs,
monitors the nature and quality of services provided, and seeks to control costs of outside
counsel. General Counsel also works with the Departments to establish yearly budgets for these
services.
This past year, outside legal costs have come in at or under budget and General Counsel has been
successful in obtaining insurance coverage to pay for legal costs in many cases. As a result, the
District's legal costs have been kept well controlled, given the amount of ongoing litigation.
General Counsel has also obtained pro bono services for two complex Real Property projects, so
that the District is obtaining a significant level of outside services while keeping legal
expenditures well under control.
COASTSIDE PROTECTION PROGRAM
This task was successfully completed and was the major legal task for Fiscal Year 2004-2005.
This task included: drafting documents for the LAFCo administrative process and public
hearings held in connection with LAFCo's reconsideration hearing in June 2004; drafting
documents and assisting staff in every aspect of the protest hearing and protest validation process
throughout the summer of 2004; assisting in obtaining the Certificate of Completion in
September 2004; and assisting in all implementation steps that followed. These steps included

the District ward redistricting process, Ombudsperson process, and advising the Real Property
and Planning Departments on preparing for acquisition and management projects on the Coast.
General Counsel worked in collaboration with Planning and Real Property to develop an
Implementation Plan for coastal acquisitions to serve as guidance and a template for acquisitions
on the Coast to insure compliance with the Service Plan and LAFCo requirements. This was part
of the process used in preparing for the District's first coast acquisition, the Forde property,
which occurred in April 2005. This Implementation Plan and the collaborative approach to the
acquisition process and staff report will serve as a valuable template for future acquisitions and
management agreements on the Coast, as it has done already for the Rapley Ranch and
Miramontes Ridge projects.
General Counsel also worked closely with Real Property in the summer and fall of 2004 to help
secure the Coastal Conservancy's $2 million grant for the Miramontes project. This involved
responding to numerous Public Records Act requests and working closely with Real Property and
Conservancy staff to enable the Board to approve the Grant Agreement and secure these funds so
Miramontes Ridge could be purchased.
REAL PROPERTY
• General Counsel has provided legal advice to the Real Property Department on major land
acquisitions and management agreements as reported in the Evaluation of the Action Plan for
Fiscal Year 2004 -2005 received by the Board on June 1, 2005. These acquisitions involved
approximately 1,000 acres. Key projects were the purchase of the Guadalupe Land
Company, the exchange agreement with the Sequoias at Windy Hill OSP, and continuing
work on a potential fee and easement exchange with Hanson Quarry adjacent to Rancho San
Antonio OSP. (Assistant General has been the lead attorney on this project).
• General Counsel worked closely with Real Property this year on certain coastal grant
applications, in view of the litigation and legal issues involved, including the Forde/Peery
grant (Arroyo Leon) and Connor (Rapley Ranch) grant.
• General Counsel advised Real Property on various encroachment issues.
•
Assistant General Counsel was key in developing a new communication lease at Pulgas
Ridge OSP for Metro PCS, and settling an encroachment and negotiating a new lease at
Pulgas with Cingular Wireless.
PLANNING
• The Legal Program's key project with Planning continued to be the Coastside Protection
Program. In addition, General Counsel worked with Planning on the Pulgas OSP staging
area and trail project, particularly the bidding and bid protest issues and petroleum issues.

On behalf of Midpeninsula Regional Open Space District(District), I am pleased to forward this report on
the District property purchases within San Mateo County(County)and the Coastside Protection Area, as
outlined in our March 2004 Agreement. The Agreement became effective on September 7,2004 when
the Certificate of Completion of Annexation was recorded extending the District boundary to the Pacific
Ocean

The District and County entered into the contractual Agreement for the provision of fire-related services
to District lands in the
Coastside Protection Area that are not curre
ntly provided within the State
Responsibility Area by the California Department of Forestry and Fire Protection(CDF). According to
the Agreement,the District will, in exchange for the Coun 's fire services compensate the County tY P h'by
means of a fire services fee.
The Agreement requires the District to report to the County any land purchases completed by the District
within the Coastside Protection Area during the prior twelve months between July 1 and June 30. This
letter constitutes that report.
As of June 30, 2005,the District has not purchased any properties within the Coastside Protection Area.
The District has however, entered into license and Management Agreements with the Peninsula Open
Space Trust(POST) for two properties within the Coastside Protection Area and will likely be closing
escrow on a third property by Aug 30, 2005. As a result, no fire services fees are due to the County at this
time because the District has not completed any property purchases within the Coastside Protection Area.
The Agreement between the County and District requires that by August I of each year,the County report
to the District the nature, scope and costs of the fire services, including a list and dates of all County
response calls to District-owned or managed land,that the County provided during its prior fiscal year.
Since no fire services fees were paid to the County during the prior fiscal year, we anticipate that we will
receive this report from you for next fiscal year or by August 1, 2006.
The Agreement also requires that the District undertake specific joint operations with the San Mateo
County Environmental Services Agency and Fire Department. This collaborative effort includes
consultation on site-specific fuel modification and management programs, and review of available dry
hydrant water resources during the District's Use and Management planning process for specific lands
purchased in the Coastside Protection Area. In addition,the Agreement requires that the District
formalize a Mutual Aid Agreement with the County and coordinate on the use of a District-owned 1,500-
2,000-gallon maintenance-style water truck for mutual aid calls. I am pleased to advise you that the

Mutual Aid Agreement was completed in March 2005 and that the water truck, currently on order, should
be available for use in January 2006. As the District purchases and prepares Use and Management plans
for lands in the Coastside Protection Area, we look forward to consulting with the County on site-specific
fuel modification and management programs.
Finally, I understand that District staff and County Fire representatives have met to explore training
opportunities and ways to enhance communications between both agencies. I anticipate that the training,
increased communication, and better coordination will greatly improve the fire service operations of both
the District and the County.

Dear Commissioners:
I urge you to reject appeal number A-2-05-009 and vote to approve the "Mel's Lane"
Coastal Access Project at Whaler's Cove.
A coastal development permit has been granted by San Mateo County for four walking
trails, an information kiosk,a seating area, and an overlook deck on the bluffs next to the
Pigeon Point Lighthouse on the San Mateo Coast.
The project seeks to restore public access to the small sandy beach and build new
blufftop trails for the public to enjoy the area's natural environment. Named Mel's Lane
for the first chairman of the Coastal Commission, Melvin B. Lane, these public trails and
overlook will complement the historic lighthouse and hostel next door.
Any potential conflicts between agricultural use of the field across Pigeon Point Road
and trail users have been worked out in an agreement between Peninsula Open Space
Trust and the San Mateo County Farm Bureau. The San Mateo County Planning
Commission and Board of Supervisors have unanimously approved the project.
Please follow your staff's finding that appeal number A-2-05-009 raises "No Substantial
Issue" and clear the way for public trails and beach access at Whaler's Cove to be built as
soon as possible.

During the week of September 12, 2005, www.openspace.org will be featured. We

SUBJECT: Monthly and Quarterly Investment and Security Transaction Report
Attached is the District's current portfolio of cash investments. All reserve and program funds
established pursuant to public debt issues continue to be invested through the offices of the
designated trustees. All instruments are in compliance with our latest Statement of Investment
Policy, last approved on May 11, 2005. The District receives and maintains complete monthly
reports of all investments managed by bond trustees.
Santa Clara County has reported the pooled fund yield at 2.98% as of June 30, 2005. This yield
remains below general market rates. Attached is the County's investment report for the June
quarter.
Our cash position, together with estimated near-term revenues, is adequate to cover cash
requirements over the next six months.

The yield of the pool on June 30, 2005 was 2.98%. As a comparison, on June 30, 2005 the yield of a
90-day Treasury Bill was 3.12 % and a 6-month Treasury Bill was 3.33%. A two- year Treasury Note
was 3.63%. The State of California Local Agency Investment Fund(LAIF) yield was 2.97%.
Attached with the current investment strategy is a schedule that lists the average maturities and yield for
the commingled funds over the past six months. A chart of investment concentration and maturity is
provided for the Treasury Pool. Also included is a chart showing the one-year history of the pool and
selected interest rates.
Securities are purchased with the expectation that they will be held to maturity, so unrealized gains or
losses are not reflected in the yield calculations.
The market values of securities were taken from the Wall Street Journal, quote screens, or an
independent pricing service.
The investment portfolio is in compliance with the current investment policy. A combination of
securities maturing, new revenues, and tax receipts will adequately cover the anticipated cash flow needs
for the next six months. Cash flows are continually monitored and are considered paramount in the
selection of maturity dates of securities.

SANTA CLARA COUNTY TREASURY COMMINGLED POOL
INVESTMENT REVIEW AND STRATEGY
June 30, 2005
During the 4 1h quarter, interest rates were strongly impacted both by continued increases in the
Federal Funds Rate and by robust demand for treasury securities with long maturities. The Federal
Open Market Committee(FOMQ voted to raise its rate twice, in increments of 25 basis points, shifting
the funds rate to 3.25%by the end of the period. Yields on treasury securities with short maturities(less
than I year) also increased in response to a higher Fed Funds Rate, a pattern consistent with market
history. Inversely, longer-term rates declined over the period. The two year and ten year treasury notes
dropped by 14 and 57 basis points respectively. The ten year yield at quarter end was lower than its
yield on 6/30/04, when the Fed began its tightening cycle. Such a decline is surprising and without
precedent in recent experience. Strong demand for treasury securities from foreign central banks with
large dollar stockpiles received from export sales to the US,undoubtedly helped push down yields.
Additionally, demand has grown from excess global savings stemming from certain Asian and oil
producing countries. More profoundly, shifting perceptions about inflation risk have lowered market
premiums required by investors to compensate for this type of risk.
As of June 30th, the portfolio posted a weighted average maturity of 289 days, as compared to the
maturity of 231 days reflected at the end of the prior quarter, 3/31/05. On 6/30/05 the portfolio's
weighted average yield to maturity (YTM)was 2.98%, a favorable comparison to the prior period's
2.5%.
We fully expect, given the results of recent economic statistics, the Federal Reserve to continue
raising rates over the next quarter to offset potential inflationary pressures. The US economy, with its
current strength, can withstand higher rates without increasing its vulnerability to a slow down.
Inflation remains in check, manufacturing growth has modestly exceeded expectations, housing is
strong, GDP is growing at 3.4%, consistent with historical trends, and higher oil prices have not
impeded consumer spending. Although by quarter end rates had declined,we expect yields to drift
higher going forward,but to remain within a trading range. We continue our strategy of identifying
attractive securities and opportunistically locking in higher yields as interest rates trend higher.

Dear Michael,
Thank you for the opportunity to visit the ranch property with you. When you get
the upper roads cleared I would greatly appreciate the opportunity to see that
portion of the property. I would be happy to go with you or on my own, whichever
works best for you.
I am enclosing the photograph and writeup that I told you about. The photo is of
the ranch house and outbuildings with my great grandfather, John Benton
Gilcrest, on his horse in front of the fence. The photo was taken approximately
1890. This is the photo we used to prepare the monument plaque on the ranch.
The writeup was prepared in 1904 and was written before my father, Cyril, and
my aunt, Claire, were born. Someone has written in the names of the children
born after 1904. Claire is the aunt that I told you about who now lives in the
Forum in Cupertino.
I hope this information is of some value to you. I am glad to see you will be doing
some work on maintaining and improving access to the ranch. If I can ever be of
assistance, please let me know.

budget. The $22 million budget noted in your report, probably refers to the total revenues
(including grants) received that year, derived from our audited financials. For fiscal year 2004-

As Will Rogers said, "The outside of a horse is good for the inside of a man."And you don't have to
own a horse to benefit from Bear Creek Stables. We use the healing power of these wonderful animals to
help people in need.
�€ Last year, a local family was involved
in a car crash in which the husband
was killed. The wife and daughter
` were terribly traumatized. Without
` hesitation, the people at Bear Creek
Stables embraced this unfortunate
family. The mother was given a safe
horse to help care for and ride. This
experience was an important part of
the healing process for both mother
and daughter.

Another local family has a father
who is very sick with cancer. For
the past two years, a Bear Creek
Stables volunteer has taken the
family's two boys riding on the trails
every weekend. This has let them get
away for a while from the heaviness
of their lives and just be children.

We APt✓ GOOD STDWARDS OF TFfe LAND
The stables were built in the early 1900s, and have been run by Paul and Glenda Smith since 1997.
The Smiths have spent considerable time and money improving the facilities, while still keeping the
boarding fees affordable. Glenda and Paul have cooperated with MidPen to minimize the stables'
impact on the environment.
At MidPen's request, they have:
• Closed several paddocks that were too close to the creek
• Fenced off other areas that might cause erosion problems
•Added rain gutters to paddocks
•Trucked manure offsite, where it's used to make compost
• Improved drainage by adding culverts, percolation areas, and so on
On their own initiative, they have:
• Redesigned paddock roofs to reduce water contamination
• Rotated pastures to minimize the impact on vegetation
•Gotten rid of non-native plants such as broom and thistles
• Cleared grass and brush around buildings to cut down on fire danger
•Added tons of baserock and asphalt to the roads and driveways
•Torn down many dilapidated paddocks and built new ones
• Installed sprinklers in the large arena to keep the dust down
•Attended a class on livestock management, where they learned ways to minimize erosion
and water pollution, restore native vegetation, and manage manure

We feel very protective of the trails. On several occasions, Bear Creek Stables riders have reported
problems or dangers to Midpen rangers, including:
•A smoldering campfire beside a remote trail
•A hiker with dogs running loose
• Unauthorized vehicles
• Suspicious people
• Downed trees
Glenda and her volunteers were recently commended by MidPen's head ranger for capturing three
feral wolf-dog hybrids that had been wandering the Preserve, and relocating them to a sanctuary.

Glenda I wanted to write to you to express our appreciation of the
effort that you, your staff and volunteers put into the successful effort to
capture and find a good home for the Husky dogs that were loose in,Bear
Creek Preserve. Given our staffing and time restraints,we would never have
been able to mount the effort that you put forth. The dogs were first sighted
in Bear Creek Preserve by our staff in December of 2004. It was our
responsibility to try and trap the loose dogs, which posed a threat to wildlife,
neighbors and the stables. We tried trapping for approximately a month and
were unsuccessful. I was glad to have you come forward and offer to
attempt to catch them. It was only through your patient and gentle methods,
which showed a deep concern over the dogs' fate, that you were able to be
successful. You kept at it for six months until you caught the final dog in
June, congratulations. I know that numerous people at the stables and
outside volunteers helped with the effort so please pass on our thanks.

While we already watch over the trails, some of us plan to formalize the process by
becoming certified MidPen mounted patrol volunteers.

A number of boarders have also expressed an interest in volunteering for other projects, such
as docent-led hikes, educational programs, or tours of the stables. We'd like to work with Mid-
Pen to see how we could further benefit visitors to the Preserve when it's open for hiking and
equestrian use.

Korses have been stabled on this land since the early part of the last century. We hope MidPen has the
vision to preserve a place that's not only rich in history, but is also a community of people who respect and
