SPECIAL COMMISSION MEETING
FY 2016—2017 BUDGET AMENDMENT
Monday, February 27, 2017 5:30 P.M.

1. CALL TO ORDER:
Vice Mayor Joseph L. Kelley called the meeting to order at 5:30p.m. on Thursday, February 27,
2017 in the Auditorium at Sherbondy Village, 215 President Barack Obama (Perviz) Avenue,
Opa-locka, Florida.
2. ROLL CALL:
The following members of the City Commission were present: Vice Mayor Joseph L. Kelley,
Commissioner Timothy Holmes, Commissioner John B. Riley and Commissioner Matthew A.
Pigatt. Also in attendance were: Acting City Manager Yvette Harrell, City Attorney Vincent T.
Brown, and City Clerk Joanna Flores. Mayor Myra L. Taylor was not in attendance.
3. INVOCATION:
The invocation was delivered by Vice Mayor Kelley.
4. PLEDGE OF ALLEGIANCE:
The Pledge of Allegiance was recited in unison.
5. SECOND READING ORDINANCES/PUBLIC HEARINGS:
1. AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA-
LOCKA, FLORIDA, AMENDING ORDINANCE NO. 16-16 BY AMENDING THE
ANNUAL ADOPTED GENERAL FUND BUDGET FOR THE FISCAL YEAR 2016-2017,
COMMENCING OCTOBER 1, 2016, THROUGH SEPTEMBER 30, 2017; PROVIDING
FOR THE EXPENDITURE OF FUNDS ESTABLISHED BY THE BUDGET;
AUTHORIZING THE CITY MANAGER TO TAKE CERTAIN ACTIONS; PROVIDING
FOR APPROPRIATION OF ALL BUDGET EXPENDITURES; PROVIDING FOR FEES
CONSISTENT WITH APPROPRIATION AND AMENDMENT; PROVIDING FOR
CONFLICT AND REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR
INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE.

The above ordinance was read by title by Attorney Brown.
Vice Mayor Kelley opened the floor for a public hearing, there being no persons to speak on the
public hearing, and the public hearing was closed.

It was moved by Commissioner Pigatt, seconded by Commissioner Holmes for discussion.
Commissioner Pigatt said that he does not come from a family of politicians, but he stepped up
because it needed to be done. He said that he as a new commission does not have the resources to
do what is necessary being that he is a newly elected official. It is unfortunate that he has stepped
up to the plate with nothing. He said that he has to come out of his pocket to handle certain
things that should have been provided to him being a commissioner.
Commissioner Riley said that he is concerned about the cuts from the City Clerk's Office. He
asked the city manager to transfer the funds from his line item to make up the deficit in salaries
in the clerk's office.
City Manager Harrell told Commissioner Riley that since the City is six months into the fiscal
year, he does not have the full amount to give; his current amount is at $3,300.00 and $4,500.00
is needed to make up the salary difference. She also informed Commissioner Riley that it would
affect the overall cut that was done across the board for all employees.
Commissioner Riley said that will not affect the other employees and he would like to amend the
budget to reflect zero on his line item and go into the city clerk's line item under regular salaries.
Vice Mayor Kelley asked the city manager if the series of emails that were sent earlier regarding
the salaries in question were resolved.
City Manager Harrell said that she did address the emails that were sent earlier to the best of her
ability, but she does not know if the issue was resolved; that information has to come from the
originator of the email.
Vice Mayor Kelley asked the city clerk if the issues that were addressed earlier were resolved.
He said that this is the 11th hour, but he wants to make sure that issues are resolved before
presenting the budget amendment to the state.
City Clerk Flores said that one of the concerns that she had which was in the email from page
Roman numeral iii from the budget amendment. It shows that the employees in the city clerk's
office had a higher amount reduced from their pay then everyone else and she did not know why.
Although she did receive an explanation, the issue at hand has not resolved.
Vice Mayor Kelley asked Commissioner Riley to repeat his motion?
Commissioner Riley made a motion to amend the resolution to zero out his line item and the
transfer the funds into the city clerk's office.
Vice Mayor Kelley asked the city manager what the process was for amendments to this budget
amendment.
City Manager Harrell informed the vice mayor that an amendment would have to be made to this
amendment to reflect any changes in the current document.
Vice Mayor Kelley asked the city manager if there is a process in place in case the numbers were
calculated wrong. Can the employees come back after the amendment has been approved and

there is a process that they can go through to question or straighten out their salaries. Employees
need to know that there are steps they can take or forms they can filled out to cover this. He
would like for this to be done without legislation.
City Attorney Brown said that the amendment can be made and then presented to the oversight
board for approval.
Vice Mayor Kelley said that he something in place once the budget is set and employees become
disgruntled.
City Manager Harrell said that there is already a payroll process in place for those employees
with concerns. If the commission wills it, then she will put something in writing.
Vice Mayor Kelley said that if there is already a process in place then fine, but he wants to make
sure the employees have somewhere to go with their grievance.
City Attorney Brown repeated Commissioner Riley's motion, it was seconded by Commissioner
Pigatt to pass the amendment.
There being no further discussion, the motion on the amendment passed by a 4-0 vote.

Vice Mayor Kelley said that everyone realizes that is a challenging budget and it will have an
impact on everyone. The City has to do the best that it can until things get better.
Commissioner Holmes asked if the change that was made with this amendment good for the
budget and how big of a change was it.
City Manager Harrell said that Commissioner Riley's decision does not affect the actual
numbers, but she thinks that there will be a fairness issue brought up and it will affect morale. It
is the will of the commission and if that is what happens then so be it. The are those of us in the
city that are burdened by the 2, 5, and 10, it is not fair, but she will leave it up to the employees.
Commissioner Holmes said that he does not want numbers to change that will affect the budget.
City Manager Harrell said that it will not affect the budget.
City Clerk Flores said that she does not have a problem with the 2, 5, and 10. The issue that the
employees have is that their salaries were reduced and then they were given the 2, 5, and 10 on
top of that.
Vice Mayor Kelley said that Commissioner Riley did of his salary and that should cover the
deficit. This is why he wanted something in place for employees after the amendment has been
approved.

AND SPECIAL REVENUE FUND BUDGET FOR THE FISCAL YEAR 2016-2017,
COMMENCING OCTOBER 1, 2016, THROUGH SEPTEMBER 30, 2017; PROVIDING
FOR THE EXPENDITURE OF FUNDS ESTABLISHED BY THE BUDGET;
AUTHORIZING THE CITY MANAGER TO TAKE CERTAIN ACTIONS; PROVIDING
FOR APPROPRIATION OF ALL BUDGET EXPENDITURES; PROVIDING FOR FEES
CONSISTENT WITH APPROPRIATION AND AMENDMENT; PROVIDING FOR
INCORPORATION OF RECITALS; PROVIDING FOR REPEAL OF ALL
ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR

The above ordinance was read by title by Attorney Brown.
Vice Mayor Kelley opened the floor for a public hearing.
Ricky James, 1156 Jann Avenue, asked the city manager if she is talking about cutting the
employees' salaries by 15% across the board. He said that he is already working at thirty two
(32) hours a week and is struggling to pay his bills. The morale is already low; how much lower
can it go. He works in the hot sun and it is not right. He is at the bottom and he cannot afford a
15% cut to his current salary.
Vice Mayor Kelley said that with the budget being, passed, all employees will go back to forty
(40) hours and then the 2, 5, and 10 will be based on the salary range.
Mr. James said that even if he is brought back to forty hours and then receive the 2, 5, and 10
reductions he will still be unable to pay his bills.
Vice Mayor Kelley reiterated that there will be a crunch that everyone is going to feel, but the
city is trying to work through it. He asked the city manager to explain in case he didn't explain it
correctly.
City Manager Harrell informed the vice mayor that he explained it correctly.
Vice Mayor Kelley said that it is a tough space that everyone is in including the city commission
who has taking reductions to cover the budget as well.
Commissioner Pigatt informed Mr. James that his check will go up once the budget amendment
is approved.
Mr. James asked if there would be any more layoffs.
City Manager Harrell said, "No."

Commissioner Riley said that from the beginning of the process there has been a balanced
budget. After state recommendations and cuts, this is where we are. We are trying to keep the
City afloat.
There being no persons to speak on the public hearing, and the public hearing was closed.
It was moved by Commissioner Riley, seconded by Commissioner Pigatt for discussion.
Vice Mayor Kelley asked the city manager for an update on where the City is with the waste
haulers contracts?
City Manager Harrell said that they are still negotiating the contracts.
Vice Mayor Kelley said that in previous budgets, there was funding for Code Enforcement to
fine properties. He asked where the city was with that since the county is a part of the process.
City Manager Harrell said that would have to be done through an amendment since there is no
current ordinance for that.
Vice Mayor Kelley said that he does not want any potential funds to be missed because the city
cannot fine certain properties.
City Manager Harrell said that can be done once the city commission adopts an ordinance.

7. ADJOURNMENT:
There being no further business to come before the Commission, it was moved by
Commissioner Riley, seconded by Commissioner Pigatt to adjourn the meeting at 7:44 p.m.
