HomeMy Public PortalAbout020-2020 - extending executive orders - local disaster emergencyCOMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA ORDINANCE 20-2020 AN ORDINANCE EXTENDING EXECUTIVE ORDERS DELCARING A LOCAL DISASTER EMERGENCY WHEREAS, the Mayor, as the Principal Executive of the City of Richmond, Indiana, issued an Executive Order on the 16th day of March, 2020 wherein it was declared that there exists a local disaster emergency as contemplated by I.C. 10-14-3 et. seq.; and WHEREAS, the above -referenced Indiana Code Section provides that a political subdivision -may make, amend, and rescind orders, rules and regulations as necessary for emergency management, and such orders, rules, and regulations have the full force and effect of law when filed in the office of the clerk of the adopting or promulgating political subdivision; and WHEREAS, the March 16, 2020 Executive Order provides for certain procedures relative to the operation of City Departments during the public health emergency associated with the transmission of COVID-19; and WHEREAS, the Wayne County, Indiana Commissioners, and the Mayor of Richmond, Indiana issued a Joint Executive Order on March 20, 2020 in an effort to further protect the safety of the public during the public health emergency; and WHEREAS, the Joint Executive Order executed by the Wayne County, Indiana Board of -Commissioners and the Mayor of Richmond, Indiana provides, in pertinent part, that: (1) all citizens subject to the jurisdiction of the County and the City are directed to cease all non- essential interaction, including but not limited to social gatherings and. interactions; (2) the Level Two travel restrictions declared by the Board of Commissioners of Wayne County, Indiana is adopted by the Mayor of the City of Richmond, Indiana; (3) all employers within the City and the county are. asked to affect a reduction in their usual in -place workforce of at least thirty percent (30%) in order to reduce the transmission rate of COVID-19; and (4) the actions of the Wayne County Local Health Officer temporarily closing certain identified businesses within the County are re -affirmed by the Mayor and the Board, as well as those closures heretofore directed by Governor Eric Holcomb in Executive Order 20-04 dated March 19, 2020; and WHEREAS, I.C. 10-14-3-29 provides that a local disaster emergency may be declared only by the principal executive officer of the political subdivision; and may not be continued or renewed for more than seven (7) days except by or with the consent of the governing board of the political subdivision; and WHEREAS, the Richmond Common Council, as the governing board of the City or Richmond, Indiana, has been requested to extend the March 16, 2020 and March 20, 2020 Executive Orders pertaining to the COVID-19 public health emergency until such time that the City of Richmond, -Indiana, in consultation with local and state government and health officials, determines that the same are no longer necessary to protect the health and safety of the citizens of Richmond, Indiana; and WHEREAS, the Common Council of the City of Richmond, Indiana now determines that it is in the best interest of the City of Richmond, Indiana that the Executive Orders referenced herein shall be extended until further notice. NOW, THEREFORE, BE IT ORDAINED by the Richmond, Indiana Common Council, as follows: The Executive Order issued by the Mayor of the City of Richmond, Indiana on March 16, 2020 is hereby continued and renewed until further notice. 2. The Joint Executive Order issued by the Mayor of the City of Richmond, Indiana and the Board of Commissioners of Wayne County, Indiana on March 20, 2020 is hereby continued -and renewed until further notice.
