Present for the Board Meeting were Mayor Protem Kenneth Chavious and Commissioners Frances Dancy, Evelyn Lloyd, Mark Sheridan, and Brian Lowen. Absent from the Meeting was Mayor Horace H. Johnson, Sr. Staff present were Town Manager "Eric Peterson, Town Clerk Donna Armbrister, Finance Director Sherry Carter, Planning Director Margaret Hauth, Town Engineer Keel, Management Intern Jim Klingler, Lead Meter Reader Ricky Clark, Police Officer Scott Foster, and Town Attorney Robert E. Hornik, Jr. 1. PUBLIC CHARGE Mayor Protem Kenneth Chavious read the Public Charge. 2. ADDING ITEMS TO THE PRINTED AGENDA By consensus, the Board added to the Printed Agenda a discussion of Mayor Horace H. Johnson, Sr.'s letter to NCDOT as Item 8.H. 3. AUDIENCE COMMENTS A. Matters on the printed agenda There were no audience comments B. Matters not on the printed agenda There were no audience comments 4. APPROVAL OF THE MINUTES OF THE FEBRUARY 12,2001 REGULAR BOARD MEETING AND CLOSED SESSION, THE FEBRUARY 26, 2001 BOARD WORKSESSION Commissioners Sheridan, Dancy, and Lowen noted changes to be made in the Minutes of the February 12,2001 Meeting on Page 2, Item 8.C to add the word "additional" before Christmas Wreaths; on Page 4, Item 9.D to add in for clarification that the Town agrees to incur the cost of the signs; on Page 4, Item 9.E reword to state "The Tourism Board requested an additional $12,000 for the Alliance for Historic Hillsborough to fund a Part-Time Position which will allow the Director for the Alliance to focus more attention toward downtown development activities."; and also on Page 5, Item 9.1 add omitted word "to" between volunteered and serve. Upon a motion by Commissioner Lloyd, seconded by Commissioner Dancy, the Board moved to approve the Minutes of the February 12,2001 Regular Board Meeting and Closed Session and the February 26,2001 Board Work Session with the aforementioned changes by a vote of5-0. REPORT FROM THE TOWN MANAGER Town Manager Eric Peterson informed the Board that the Town will be assisting with the cleanup where a tree had fallen during a storm last year in the cemetery on E. Tryon Street even though the property does not belong to the Town. Manager Peterson reported that he, the Mayor, and the Town Engineer had met with Representative Joe Hackney to discuss the Water Plan Expansion Grant. Representative Hackney was very helpful and contacted some representatives from the State, but the State staff did not feel that there was any way of increasing the grant. Peterson notified the Board ofthe North Carolina League of Municipality sponsored Legislative Update on April 4th, 2001 that will be held at the Friday Center. He asked that Board Members interested in attending contact him or the Town Clerk as soon as possible. Peterson reminded the Board of the State of the Economy Breakfast scheduled for March 27th, 2001 at 7:30 AM at the Friday Center. He explained that seating has been reserved for this breakfast and requested if any Board Member discovers that they cannot attend to notify him or the Town Clerk so that other staff may be able to fill their seats. Peterson updated the Board on the status of the Fairview Community Policing Station. He reported that the Architects are meeting with the Board of Adjustment this week to review the final site plan. 6. REPORT FROM THE TOWN ENGINEER Town Engineer Kenny Keel gave a status report on all current water/sewer projects. 7. ITEMS FOR DECISION - CONSENT AGENDA A. Approval of$12,500 to DPR Associates, Inc. to Perform a Downtown Streetscape Improvements Feasibility Study B. Consider endorsement of merging of the Orange Community Housing Corporation and the Community Land Trust in Orange County C. Consider approval of Budget Workshop and Public Hearing Dates D. Consider Ordinance to Amend Chapter 6, Section 6A-12 Speed Limits to assign a speed limit of25 mph to Alma Avenue, Daphine Drive, and Daphine Court Upon a motion by Commissioner Dancy, seconded by Commissioner Lloyd, the Board moved to approve items 7.A-7.D of the Consent Agenda as presented by a vote of5-0. The motion was declared passed. A copy of the Ordinance to Amend Chapter 6, Section 6A-12 Speed Limits to assign a speed limit of25 mph to Alma Avenue, Daphine Drive, and Daphine Court is hereby made a part of these Minutes as an Attachment. 2 ... ". 52 . 8. ITEMS FOR DECISION - REGULAR . . A. Representatives from Centex Homes will address recent meter tampering problems in Beckett's Ridge Subdivision and the Town Manager's decision to suspended all connections to this development Town Manager Eric Peterson presented this Item for the Board's consideration. He also asked that the Finance Director report to the Board on this Item. Finance Director Sherry Carter and Lead Meter Reader Ricky Clark reported to the Board on the recent meter tampering problems they were experiencing in the Beckett's Ridge Subdivision. They presented a written report to the Board of nine individual instances of violations and reviewed the difficulties they have had in their dealings with members of the Centex staff and workers contracted by Centex. Commissioner Sheridan requested that Finance Director Carter calculate for the Board an approximation of the cost in "man hours" these violations have caused Town Staff. Commissioner Lowen recommended that the Town Attorney draft an amendment to the Town Code regarding fines to be provided to the Board for their review before the March Work Session for consideration of a vote at that Work Session. Mr. Joe Jenkins and Alan Wells from Centex appeared before the Board. Mr. Jenkins apologized for the problems, which have occurred, and for the behavior to the Centex staff and contractors. He stated that Centex is putting steps in place to prevent this from happening again. Mr. Wells informed the Board that Centex is going to begin fining their subcontractors $1,000 for the first offense of meter tampering/water theft and $2,000 for any offense thereafter. Town Manager Eric Peterson recommended the Town Board direct Centex to prepare a written report detailing how they plan to prevent further abuses and violations of Town Code regarding connections to the Town's water system by their contractors, sub-contractors, as well as the Centex staff to be given to the Manager before April 2nd, 2001. If Centex's report is deemed to be adequate by the Town Manager, he will then authorize the placement of new meters by Centex. IfCentex's report is not deemed to be adequate, the report will be brought to the Board for consideration at their April 9th, 2001 meeting. Upon a motion by Commissioner by Commissioner Lowen, seconded by Commissioner Dancy, the Board moved to approve the Town Manager's recommendation and directed Centex to prepare a written report detailing how they plan to prevent further abuses and violations of Town Code regarding connections to the Town's water system by their contractors, sub- contractors, as well as the Centex staff to be given to the Manager before April 2nd, 2001 by a vote of 5-0. The motion was declared passed. B. Consideration of request from Sandy & Brian Phelps to resolve right-of-way issues on Hayes Street 3 . . . If' u' 53 Planning Director Margaret Hauth presented this request for the Board's consideration reporting that Hayes Street was originally built as a state road in 1966. When the Town annexed the area, maintenance responsibility was accepted and the road was added to the Town's system in 1967. Not all of the owners granted the right-of-way when the road was constructed and apparently the platted portion of Hayes Street was never closed. The Phelps request that the Town Board consider six requests that are outlined in their letter. A copy ofthis letter is hereby made a part of these Minutes as an Attachment. Upon a motion by Commissioner Lloyd, seconded by Commissioner Dancy, the Board moved to authorize the following responses to the Phelps requests: Request 1 - Authorize Police Department to investigate the need for a three way stop sign at the intersection of Lattimer and Hayes; Request 2 - Authorize placement of a budget request in the budget approval process for the erection ofa guard rail on the side of Hayes Street by the creek where the road previously has eroded; Request 3 - Authorize the Planning Director and Interim Public Works Director to investigate a hole caused by a drain pipe in the corner oftheir property; Request 4 - To be considered at the April Board Meeting; Request 5 - Authorize Planning Director and Town Attorney to proceed with scheduling a Public Hearing to formally close the existing right-of- way and provide public notice; and Request 6 - Authorize Planning Director and Town Attorney to draft an Encroachment Agreement for the Board's consideration at the April meeting by a vote of 5-0. C. Consideration of New Tree Ordinance Management Intern Jim Klingler presented an Ordinance Amending Chapter 7- Streets and Sidewalks in the Town Code to include a Tree Ordinance and an Ordinance Amending Chapter 3 - Administration in the Town Code to reference the Chapter 7 amendment. Upon a motion by Commissioner Lowen, seconded by Commissioner Lloyd the Board moved to adopt the Ordinance Amending Chapter 7- Streets and Sidewalks in the Town Code to include a Tree Ordinance with the elimination of any type of residency requirement by a vote of 5-0. The motion was declared passed. A copy of the approved Ordinance is hereby made a part of the Minutes as an Attachment. Upon a motion by Commissioner Lloyd, seconded by Commissioner Dancy, the Board moved to adopt an Ordinance Amending Chapter 3 - Administration in the Town Code to reference the Chapter 7 amendment as presented by a vote of 5-0. The motion was declared passed. A copy of the approved Ordinance is hereby made a part of the Minutes as an Attachment. D. Discuss revised plans for proposed Hampton Pointe development Planning Director Margaret Hauth presented the revised plans for the proposed Hampton Pointe development for the Board's consideration. Planning Director Hauth reported that the Planning Board members discussed the plans at both their February and March meetings. The issues they discussed related to the scale of the buildings, intensity of the use on the site, employment opportunities, shopping opportunities, need to protect the historic area on the site, walkability, the surrounding road network, and stormwater/impervious surface. The Planning Board recommended approval of the rezoning request by a vote of7-1. A motion to recommend 4 54 . approval ofthe special use permit/master plan received a 4-4 vote. Planning Board members Jim Boericke and Bryant Warren presented the views ofthe Planning Board to the Town Board. Hampton Pointe Developers fielded questions from the Town Board. E. Consideration of Courtesy Review Agreement with Orange County Planning Director Hauth presented the Courtesy Review Agreement for the Board's consideration. Hauth also presented four staff suggested modifications to the agreement. After some discussion, an by consensus, the Board agreed to table this Item for further discussion at both the upcoming joint meeting with the County and the March Board Work Session. Town Manager Eric Peterson recommended forwarding a copy of the Planning Director's letter to the County for their information and the Board authorized staff to do so. F. Direction to staff regarding invitation to join Durham/Chapel Hill Workgroup Planning Director Margaret Hauth reminded the Board of the invitation to join the Durham/Chapel Hill Workgroup. . Commissioners Sheridan and Lowen volunteered to serve on this Workgroup. G. Discuss what the "HOT TOPIC" will be for the March 26th Worksession By consensus, the Board agreed that the Hot Topics for the March 26th Work Session would be the Courtesy Review Agreement, Hampton Pointe, and to have Town Attorney Mike Brough to make a presentation on the Schools and Land Use Ordinance. Added Item H. Discussion ofletter to NCDOT from Mayor Horace Johnson Board Members discussed their feelings that although the Mayor may have only been voicing his personal opinion of the location ofa bypass for Hillsborough, he wrote it on Office of the Mayor Letterhead and signed it as Mayor which gives the impression to others that he was speaking on the Board's behalf. After some discussion, the Board agreed to have Commissioner Sheridan write another letter to NCDOT from the Board stating their stance on this issue. 10. APPOINTMENTS A. Re-appoint Larry Carroll to serve 2nd term on Board of Adjustment with term expiring March 2004 . B. Appoint Pam Blue-Thompson to 1 st full term on Planning Board with term expiring March 2004 5 . . . 55 Upon a motion by Commissioner Sheridan, seconded by Commissioner Dancy, the Board approved the re-appointment of Larry Carroll to serve a 2nd term on the Board of Adjustment with a term expiring March 2004 and the appointment of Pam Blue-Thompson to serve a 1st full term on the Planning Board with a term expiring March 2004. 11. CLOSED SESSION A. Closed Session for the purpose of discussing potential litigation Upon a motion by Commissioner Sheridan, seconded by Commissioner Dancy, the Board moved to go into Closed Session for the purpose of discussing potential litigation by a vote of 5- O. The motion was declared passed. 12. ADJOURN Upon returning to Open Session, and upon a motion by Commissioner Dancy, seconded by Commissioner Lowen, the Board moved to adjourn at approximately 10:45 PM by a vote of 4-0. Annbrister, CMC Town Clerk 6 . . . 56 AN ORDINANCE AMENDING CHAPTER SEVEN OF THE TOWN CODE OF THE TOWN OF HILLSBOROUGH THE BOARD OF COMMISSIONERS OF THE TOWN OF HILLSBOROUGH ORDAINS: Section 1. Section 7-36, Town Trees, is hereby added to the Hillsborough Town Code and reads as follows: Section 7-36. Town Trees (a) Purpose The purpose of this ordinance is to regulate the planting, maintenance, and removal oftrees on Town owned public property and rights-of-way within the Town and on municipally owned property wherever located. In order to protect and conserve trees on public property and rights-of-way, this ordinance provides for the pruning, treatment and removal or trees and shrubs as is deemed necessary by the Town or any person acting under the authority of the Town. This ordinance is also intended to provide for the trimming or removal oftrees on public land when they obscure street lights, interfere with utility lines, or constitute a hazard to pedestrian or vehicular traffic, or otherwise endanger the public health, safety or welfare. Another purpose of this ordinance is to encourage the protection of trees and express the Town's intent to use trees to create a more natural and amenable human environment. This ordinance shall further provide for the establishment of an advisory committee known as the Tree Board, which shall be responsible for promoting trees and tree care throughout the Town. (b) Definitions (1) Street trees: "Street trees" are herein defined as trees, shrubs, and bushes on land lying within rights-of-way on either side of all public streets, avenues, or ways within the Town. (2) Park trees: "Park trees" are herein defined as trees, shrubs, and bushes in Town parks having individual names, and all other areas owned by the Town, or to which the public has free access as a Town park. 57 (c) Creation and Establishment ofa Town Tree Board . There is hereby created and established a Tree Board for the Town of Hillsborough, North Carolina, which shall consist offive (5) members who shall be appointed by the Board of Commissioners. (NOTE: Ex-officio members may be appointed as necessary; Public Works Director, Street Supervisor, etc.) (1) Term of Office The term of the five persons to be appointed by the Board of Commissioners shall be three (3) years except that the term of two of the members appointed to the first Tree Board shall be for only one year and the term of two members of the first Tree Board shall be for two years. In the event that a vacancy shall occur during the term on any member a successor shall be appointed by the Board of Commissioners for the unexpired portion of the term. (2) Compensation Members of the Tree Board shall serve without compensation. (3) Duties and Responsibilities . a. The Tree Board shall hear all requests for planting, maintenance, and removal of street trees and park trees by the citizens of Hills borough. The Town maintains the right to review any requests, and the tree(s) in question, in determining whether to satisfY such requests. b. The Tree Board, when requested by the Board of Commissioners, shall consider, investigate, make findings, report and recommend upon any special matter or question coming within the scope of its work. C. The Tree Board shall furthermore serve as an advisory board to the Board of Commissioners with the following duties and responsibilities: 1 to facilitate the planting, growth, protection, and removal of trees within the Town; 2 to foster the communication among the citizens of Hillsborough that would provide the needed protection of trees and to coordinate active measures to support their health and growth within the Town; 3 to conduct an annual tree safety audit of existing trees along streets and on public property within the Town, for the purpose of determining needed pruning and tree removal; . 58. . 4 to investigate available grants, loans or contributions from other governmental agencies, public or private corporations, or individuals; and to recommend the expenditure of any proceeds toward the accomplishment of the Tree Board's purpose; 5 to conduct continuing research, planning, and feasibility studies required to support the purpose stated herein. d. The Tree Board will be responsible for establishing guidelines for the spacing of Town trees on Town property. These guidelines will cover spacing between street trees, the distance street trees may be planted from curbs or curblines and sidewalks, the distance street trees may be planted from any street corner, the location of the street trees relative to overhead and underground water line, sewer lines, transmission line, or other utility, and any other areas involving the spacing of street trees, park trees, or Town owned trees. e. The Tree Board shall submit an annual report of its activities and recommendations to the Board of Commissioners and shall submit copies of its minutes and proceedings of its regular and special meetings. . (4) Operation The Tree Board shall adopt rules for transaction of its business and shall keep a record of its members' attendance and of its resolutions, discussions, findings, and recommendations, which record shall be a public record. The Tree Board shall set a regular schedule for meetings and the Chairperson may call a special meeting upon request ofa majority of members of the Board. A majority of the members shall be a quorum for the transaction of business. (d) Public Tree Care The Town shall have the right to plant, prune, maintain and remove trees, plants and shrubs within the lines of all public streets, alleys, avenues, lanes, squares and public grounds, as may be necessary to ensure public safety or to preserve or enhance the symmetry and beauty of such public grounds. The Tree Board may remove or cause or order to be removed, any tree situated on Town property or part thereof which is in an unsafe condition or which by reason of its nature is injurious to sewers, electrical power lines, gas lines, water lines, or other public improvements, or is affected with any injurious fungus, insect or other pest. This Section does not prohibit the planting of Street Trees by adjacent property owners providing that the selection and location of said trees is in accordance with the . 59 . guidelines for planting and spacing developed by the Tree Board. (NOTE: The Tree Board may reserve the right to approve any plantings that take place in right-of-way areas.) (e) Tree Topping It shall be unlawful as normal practice except as described below for any person, firm, or Town department to top any street tree, park tree, or other tree on public property. Topping is defined as the severe cutting back of limbs to stubs larger than three inches in diameter within the tree's crown to such a degree so as to remove the normal canopy and disfigure the tree. Trees severely damaged by storms or other causes, or certain trees that interfere with or are an imminent threat to utility wires or other obstructions where other pruning practices are impractical may be exempted from this ordinance at the determination of the City Tree Board. (f) Removal of Stumps All stumps of street trees and park trees shall be removed below the surface of the ground so that the top of the stump shall not project above the surface of the ground, where the stump is accessible. (g) Interference with Tree Board . It shall be unlawful for any person to prevent, delay or interfere with the Town Tree Board, or any of its agents, while engaging in and about the planting, cultivation, mulching, pruning, spraying, or removing of any streets trees, park trees, or trees on public grounds, as authorized in the ordinance. (h) Restrictions on Tree Maintenance and Removal It shall be unlawful for any person or firm to prune, treat, or remove any street tree or park tree within the Town. Exempt from this restriction are Town employees and firms performing tree maintenance services for or on behalf of the Town. Also exempt from this restriction are Electrical Utility Firms performing tree maintenance services that protect electrical power lines. (i) Review by City Council The Board of Commissioners shall have the right to review the conduct, acts and decisions of the Tree Board. Any person may appeal from any ruling or order of the Tree Board to the Board of Commissioners who may hear the matter and make final decision. . . . . 60 G) Penalties (1) Any person willfully violating any provision of this ordinance shall be, upon conviction or plea of guilty, subject to a fine not to exceed $1000.00. (2) Any other violation of this ordinance shall result in a civil penalty consisting of one, or both, ofthe following: a. a fine offifty dollars ($50.00); b. for cases in which a street tree or park tree is severely damaged or removed, replacement of the tree with a nursery tree deemed site appropriate by the Tree Board. (h) Severability The provisions of this Ordinance are severable and if any section or part shall be held invalid or unconstitutional, such decision shall not affect the validity ofthe remaining portions ofthe Ordinance. Section 2. All Provisions of any Town Ordinance in conflict with this Ordinance are repealed. Section 3. This Ordinance shall become effective upon adoption. Section 3-24 on the Tree Board of the Hillsborough Town Code is hereby amended to change the following wording: Section 3-24 Tree Board There shall be a Town Tree Board, whose establishment, powers and duties are provided for in the Town Tree Ordinance, adopted on February 11, 1983 Chapter 7 of the Hillsborough Town Code, amended on March 12, 2001. Section 2. All Provisions of any Town Ordinance in conflict with this Ordinance are repealed. Section 3. This Ordinance shall become effective upon adoption. D 62 AN ORDINANCE AMENDING CHAPTER 6, MOTOR VEHICLES AND TRAFFIC APPENDIX A, SECTION 6A-12 OF THE HILLSBOROUGH TOWN CODE The Board of Commissioners of the Town of Hillsborough ordains: SECTION 1. All section references below refer to the Town of Hillsborough Code, Chapter 6, Appendix A, Section 6A-12 Speed Limits. SECTION 2. Section 6A-12 Speed Limits In accordance with Subsection 6-20(b), the following speed limit is established at 25 MPH for the streets indicated below: SPEED LIMIT (MPH) ON STREET FROM TO 25 Alma Avenue Nash Street Terrell Road 25 Daphine Drive Alma Avenue Terrell Road 25 Daphine Court Daphine Drive End Section 2. Armbrister, Town Clerk . . ~ 63 February 25, 2001 Margaret Hauth Town OfHillsborough Hillsborough, N.C. 27278 Dear Margaret, Thank you for taking time from your schedule on Friday to speak with us. Per your request I am sending a brief list of our discussion. First and foremost our goal is to get this settled as quickly as possible. We understand that the Town of Hillsborough needs to fonnalize the right of way and easement on Hayes Street. Our request before signing such documents are as follows: 1. We would like for the Board to consider placing a three way stop sign at the intersection of Lattimer and Hayes. As you are aware Central Elementary School is located on Hayes and this stop sign would help to slow the traffic on this street. 2. We would like for the Board to also consider erecting a guard rail on the side of Hayes Street by the creek where the road previously has eroded. This could possibly prevent a serious situation with our school buses and out school children as well, 3 . You stated that someone would be looking into the matter of a hole caused by a drain pipe in the corner of our property. Please let us know your findings and the Towns intention toward correcting this problem. As I expressed in our meeting, this hole creates a safety hazard for my grandchildren and needs to be addressed I did not mention at our meeting but this seems to be causing a drainage problem on Hayes Street. The water stand in a pool almost year round at the end of our drive way. 4. As I mentioned in the meeting, we have spent in excess of $1100 for what started as a simple survey, Currently I am unable to obtain the loan I need to improve our property due to the findings on the survey. We would like for the Town to assume the cost of the survey plus the remaining amount to get this completed 5. We will obtain the signatures necessary and request that the old Hayes Street or Sunset Ext be formally closed and the land that it covers be deeded back to the Wood Property completely. The old road connects to property owned by Joseph and Myrna Grasty and Henry and Cleon Scarlett, we will ask for their written consent to have the land deeded back to us. 6. There is also an encroachment situation on the south side of our property. As discussed we would like to have this grandfathered by the Town. We look fonvard to hearing from you, and once again thank you for your time. Also, could you tell me how to obtain a copy of the state drawing that you had during our meeting? Sincerely, ~ {J.f4pCJ ~7:~ Town of tfIilJl~ 64 gh A RESOLUTION OF INTENT TO PERMANENTLY CLOSE STREET IT IS HEREBY RESOLVED, by the Town of Hillsborough Board of Commissioners on this 12th day of March 2001 that the Town of Hillsborough intends to officially close that portion of a public right-of-way formerly known as Hayes Street lying between Sunset Circle (to the South) and Latimer Street (to the North), such portion of the former Hayes Street no longer being in use; and it further RESOLVED that the Town of Hillsborough Board of Commissioners shall conduct a public hearing to consider closure of the aforesaid portion of Hayes Street described above on the 24th day of April, 2001 at 7 o'clock p.m. at the Town Barn, at which public hearing any person may be heard on the question of whether or not the closing would be detrimental to the public interest or to the property rights of any individual; and it is further . RESOLVED that a copy of this Resolution shall be published once a week for four successive weeks prior to the public hearing and a copy of this Resolution shall be sent by certified mail to all owners of property adjoining that portion of Hayes Street which is proposed to be closed, as shown on County Tax Record, that a Notice of Public Hearing shall be prominently posted in at least two places along Hayes Street, and that a map showing the portion of the former Hayes Street that is proposed to be closed is available for review at the office of the Town Clerk.
