HomeMy Public PortalAboutResolution 03-2057 PC" " " RESOLUTION NO. 03-2057PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY DENYING A REQUEST TO ALLOW THE CONSTRUCTION OF AN ATTACHED SECOND DWELLING UNIT ON AN R -3 ZONED LOT. THE PROPOSED SECOND DWELLING WOULD BE TWO STORIES AND WOULD BE ATTACHED TO THE EXISTING FRONT DWELLING, WHICH HAS A 5 FOOT 6 INCH SIDEYARD SETBACK (INSTEAD OF THE REQUIRED 10 FOOT SETBACK). THE SUBJECT PROPERTY IS LOCATED AT 6003 ROSEMEAD BOULEVARD IN THE MULTIPLE FAMILY (R -3) RESIDENTIAL ZONE (TO) (ZV 03 -1529) The Planning Commission of the City of Temple City does hereby resolve: SECTION 1. Based upon,- a public hearing for the above Zone Variance, the Planning Commission finds: ZONE VARIANCE 1. That there are no exceptional and extraordinary circumstances or conditions applicable to the property involved or to the intended use of such property which do not generally apply to other properties in the same zone in that the subject property is level in grade and contains 6,900 square feet of land area; the lot is comparable to many other Tots throughout the neighborhood and throughout the City; and 2. That such variance is 'not necessary for the preservation and enjoyment of a substantial property right possessed by other properties similarly situated but which is denied the property in question in that the property owner has other development options such as adding to the existing dwelling, building a second single -story dwelling, which only requires a five foot side yard setback or demolishing the existing dwelling and building a new two -story project; and 3. That the granting of the variance will be materially detrimental to the public welfare or injurious to adjacent or neighboring properties in that the addition of an attached second dwelling unit to the existing house would result in incompatibility with other new development along Rosemead Boulevard; and 4. That there are no special circumstances as provided in Section 65906 of the California Government Code in that the subject lot is of a relative standard size; the lot is not significantly unique or unusual in comparison to other R -3 zoned properties along this portion of Rosemead Boulevard. This project should not result in significant effects upon the environment and a Negative Declaration has been prepared in accordance with the State CEQA Guidelines. The initial statement as prepared indicates there is no potential for adverse impact to the environment as it relates to all wild animals, birds, plants, fish, amphibians, and related ecological communities, including the habitat upon which the wildlife depends for its continued viability. SECTION 3. Accordingly, Zone Variance 03 -1529 is hereby denied. SECTION 4. The Secretary shall certify to the adoption of this Resolution.
