HomeMy Public PortalAboutResolution 03-2061 PC" " " RESOLUTION NO. 03 -2061 PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY APPROVING A REQUEST BY MR. AND MRS. ROBERT HEPLER TO ALLOW THE CONSTRUCTION OF A SECOND DWELLING UNIT CONSISTING OF APPROXIMATELY 2,000 SQUARE FEET ON AN R -2 ZONED LOT WHICH IS CURRENTLY IMPROVED WITH A SINGLE FAMILY DWELLING. THE EXISTING DWELLING IS TWO STORY AND HAS A SIDE YARD SETBACK OF 9 FEET FOR THE FIRST AND SECOND FLOORS (INSTEAD OF THE REQUIRED 10 FEET FOR THE FIRST FLOOR AND 15 FEET FOR THE SECOND FLOOR AS REQUIRED IN THE R -2 MULTIPLE FAMILY RESIDENTIAL ZONE). (6002 CLOVERLY /ZV 03- 1539 /HEPLER) The Planning Commission of the City of Temple City does hereby resolve: SECTION 1. Based upon a public hearing for the above Zone Variance, the Planning Commission finds: ZONE VARIANCE 1. That there are exceptional and extraordinary circumstances or conditions applicable to the property involved or to the intended use of such property which do not generally apply to other properties in the same zone in that the subject lot was improved with a dwelling in conformance with applicable setbacks at the time of construction; however, the existing dwelling does not comply with the side yard setback which is now required for the R -2 zone; and 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other properties similarly situated but which is denied to the property in question in that the subject property is designated as being medium density residential on the City's General Plan and is zoned R -2; there is ample land to accommodate a second dwelling unit and the proposed new dwelling will comply in all regards with the current development criteria; while the existing house does not strictly comply with the first and second story setbacks as currently required by the Code, there is a long- standing 9 foot setback from the north property line, therefore, denial of this variance is rather technical rather than substantive; and 3 That the granting of the variance will not be materially detrimental to the public welfare or injurious to adjacent or neighboring properties in that the existing house is already setback approximately 9 feet from the property line; several other properties in the immediate area are improved with comparable side yard setbacks; the proposed new dwelling on this R -2 zoned lot will be in compliance with all applicable development standards, including setbacks; and N:\ Word\ Department \CDD \RESO \Planning\Zone Variance (ZV) \2003 \PC 03 -2061; ZV 03 -1539; 6002 Cloverly Avenue.doc Resolution 03 -2061 PC Page 2 Zone Variance 03 -1539 4. That there are special circumstances as provided in Section 65906 of the California Government Code in that the existing house on the lot was constructed prior to the current setback criteria, thus creating an unusual circumstance. Additionally, the existing house provides a side yard area along the north side of approximately 9 feet, which is long- standing and ample in comparison to typical side yard setbacks within this neighborhood. SECTION 2. This project should not result in significant effects upon the environment and a Negative Declaration has been prepared in accordance with the State CEQA Guidelines. The initial statement as prepared indicates there is no potential for adverse impact to the environment as it relates to all wild animals, birds, plants, fish, amphibians, and related ecological communities, including the habitat upon which the wildlife depends for its continued viability. SECTION 3. Accordingly, Zone Variance 03 -1539 is hereby approved, subject to the following conditions. 1. The proposed development shall be in substantial compliance with the submitted development plans, dated September 2, 2003, except as modified herein. 2. Building permits must be obtained for all new construction. 3. An encroachment permit shall be obtained for all work within the public right -of -way. 4. All trees shall be preserved on the lot, including those in the public right -of- way, unless removal is specifically authorized by the Community Development Department and the Public Services Department. If a tree is removed, a replacement tree(s) shall be planted as may be required by the Public Services Department. 5. Construction and demolition work shall be limited to between 7:00 a.m. and 6:00 p.m. 6. Noise shall not exceed the limits of the City's Noise Ordinance. During any construction and /or demolition, noise will be controlled by limiting work on the site to 7:00 a.m. through 6:00 p.m. 7. Disposal of Construction Waste: No construction activity waste material of any kind, including plaster, cement, paint, mud, or any other type of debris or liquid shall be allowed to be disposed of in the street or gutter, storm drain or sewer system. Failure to comply with this condition will result in charges being filed with the District Attorney. The building construction plans shall include a blue line sheet(s) showing each page of this Resolution including all conditions of approval contained herein. 9. The conditions of approval contained in this Resolution may be enforced by the Sheriffs Office as well as City staff. Any violation of any condition is a misdemeanor and may be processed directly by criminal complaint. 10. This Resolution shall not become valid until all responsible parties have signed and agreed to the aforementioned conditions of this Resolution. 11. Prior to the issuance of the building permit, the property shall be surveyed and all property lines shall be clearly delineated by a licensed surveyor or civil engineer. Property lines shall be appropriately delineated in the field so that the building inspector can easily confirm compliance with applicable setbacks. SECTION 4.
