Sherbondy Village Auditorium 215 Perviz Avenue Opa-locka, FL 33054 1. CALL TO ORDER: Vice Mayor Joseph Kelley called the meeting to order at 5:30 p.m. on Monday, April 03, 2017 in the Auditorium at Sherbondy Village, 215 President Barack Obama (Perviz) Avenue, Opa-locka, Florida. 2. ROLL CALL: The following members of the City Commission were present: Vice Mayor Joseph L. Kelley, Commissioner Timothy Holmes, Commissioner John B. Riley and Commissioner Matthew A. Pigatt. Also in attendance were: City Manager Yvette Harrell, City Attorney Vincent T. Brown, and City Clerk Joanna Flores. Mayor Myra L. Taylor was not in attendance. 3. INVOCATION: The invocation was delivered by Vice Mayor Joseph Kelley. 4. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance was recited in unison. 5. PUBLIC INPUT: Agenda Items Only Vice Mayor Kelley asked the city attorney for guidance in regards to item 6-a. City Attorney Brown said that the ordinance was approved and forwarded to the oversight board for their input. They received the comments back from the state earlier today and have not had a chance to go through it and review and make any recommended changes. He is recommending that the meeting be recessed and brought back at a date certain so that they can make the changes and give it to the commission for review. Once it has been approved by the commission, the oversight board will adopt the changes as well. Vice Mayor Kelley asked the dais if they wanted to take the recommendation from the attorney and come up with a date to meet and decide upon the item. City Manager Harrell recommended that the commission add the item to the agenda for the next regular meeting. Special Commission Meeting Minutes—4/03/2017 1 Vice Mayor Kelley said that means the meeting cannot be recessed. City Attorney Brown said that the item needs to be to the clerk by Wednesday, April 5th for the April 12th regular commission meeting. Commissioner Riley said that he will also defer his items until that date. Commissioner Pigatt asked how the delay of this meeting will affect the trash pickup on the commercial side. City Manager Harrell said that it will not affect anything with the franchise as they had already started the pickups weeks ago. There have already been around three hundred (300) contract agreements signed on the commercial end and she does not see any affects from this delay. A motion was made to recess the meeting until Wednesday, April 12, 2017 or soon thereafter. It was moved by Commissioner Riley, seconded by Commissioner Holmes to recess the meeting. SECOND READING ORDINANCE/PUBLIC HEARING: a) AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA, TO AWARD A FRANCHISE CONTRACT FOR COMMERCIAL SOLID WASTE COLLECTION AND DISPOSAL, PURSUANT TO AN EMERGENCY PROCEUREMENT, AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT IN SUBSTANTIALLY THE FORM ATTACHED HERETO AS EXHIBIT "A", SUBJECT TO APPROVAL AS TO FORM BY THE CITY ATTORNEY, PAYABLE FROM ACCOUNT 34-534340; A BUDGETED ITEM; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR CONFLICT AND REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE (first reading held on March 08, 2017); Sponsored by City Manager 7. RESOLUTION: a) A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA- LOCKA, FLORIDA, AMENDING THE CITY ATTORNEY RETAINER AGREEMENT WITH THE BROWN LAW GROUP, LLC; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE; Sponsored by Commissioner Riley 8. DISCUSSION ITEMS: 1. Status report on all litigation 2. Report on the cost of litigation (hired outside attorneys billing cost to date) Special Commission Meeting Minutes—4/03/2017 2 3.
