HomeMy Public PortalAbout2014-11 Authorizing the purchase of thirty 30 Level II Hi-Lite Ballistics Protective Vest and Speed PlatesRESOLUTION NO. 2014-11 A CAPITAL PROJECT AUTHORIZING RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AUTHORIZING THE EXPENDITURE OF AN AMOUNT NOT TO EXCEED $25,500.00 FROM THE FEDERAL ASSET SHARING ACCOUNT FOR THE PURCHASE OF THIRTY (30) LEVEL II HI-LITE BALLISTICS PROTECTIVE VEST AND SPEED PLATE FROM FEDERAL EASTERN INTERNATIONAL, INC.; PROVIDING FOR A WAIVER OF COMPETITIVE BIDDING; AND PROVIDING FOR EFFECTIVE DATE. WHEREAS, as a result of the Police Department's deep concern for the safety of its officers and citizens and visitors of the Village, the Police Department has equipped itself with the safest and most effective protection available; and WHEREAS, the protective vests have an expiration date of five (5) years and they have not been replaced; and WHEREAS, the protective vests has proven to not only reduce injuries but also save the lives of officers; and WHEREAS, the protective vests are considerably lighter and provide more flexibility to the officer; and WHEREAS, the protective vests are highly effective against fragmentation and its multi -hit performance and special -threat performance that exceeds the current FBI protocols; and WHEREAS, the protective vests will be a viable investment to the Police Department while providing a higher level of officer and citizen safety; and WHEREAS, this expenditure is an officer safety purchase, which was not included in the Police Department's operating budget costs/police equipment line item; and WHEREAS, the Police Department has in excess of $166,000.00 in the Federal Asset Sharing Account; and WHEREAS, these monies are the result of seized assets from joint investigations between the Police Department and Federal Law Enforcement Agencies, not from tax revenue; and WHEREAS, since this expenditure is from said forfeited properties, this Police Department need may be satisfied at no cost to our residents; and WHEREAS, the Village Manager has recommended to purchase this equipment using funds from the Federal Asset Sharing Fund; and WHEREAS, costs for "Weapons and Protective Gear" is an authorized expenditure of the Federal Equitable Sharing Agreement and Certification; and 'WHEREAS, the Village may, pursuant to Section 2-86 of the Village Code of Ordinances, enter into bids or contracts entered into by another governmental authority, provided that the governmental authority has gone through a competitive bidding procedure leading to the award of the bid or contract in question; and WHEREAS, the Village Council desires to purchase the equipment based upon the State Contract Number 680-850-11-1, which was competitively bid pursuant to ITB Number 14-680-850-0 (the "State Contract"); and WHEREAS, the Village Manager has recommended adoption of this Resolution and determined that the proposed expenditure complies with Federal Equitable Sharing Agreement and Certification. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF KEY BISCAYNE, FLORIDA AS FOLLOWS: 2 Section 1. Recitals Adopted. That each of the recitals stated above are hereby adopted and confirmed. Section 2. Waiver of Competitive Bidding. The Village Council, in accordance with Section 2-86 of the Village Code of Ordinances, hereby waives competitive bidding based upon the State Contract. Section 3. Purchase Authorized. That the Village Manager is hereby authorized to purchase the thirty (30) Level II Hi-Lite Ballistics Protective Vest and Speed Plates for a total expenditure not to exceed $25,500.00 from Federal Eastern International, Inc. The funds for this purchase will come from the Federal Asset Sharing Account. Section 4. Effective Date: That this Resolution shall take effect immediately upon adoption.
