CLOSED SESSION MINUTES
HILLSBOROUGH TOWN BOARD
Monday, April 9, 2001
7:30 PM, Town Barn
The Hillsborough Town Board held a Closed Session on March 12, 2001 in the
Hillsborough Town Barn for the purpose of discussing Town Reservior Litigation.
Present for the Closed Session were Mayor Horace H. Johnson, Sr., and Commissioners
Kenneth Chavious, Frances Dancy, Evelyn Lloyd, Mark Sheridan, and Brian Lowen.
Absent from the Meeting was Mayor Horace H. Johnson, Sr. Staff present were Town
Manager Eric Peterson, Town Clerk Donna Armbrister, Town Engineer Keel,
Management Intern Jim Klingler, Public Works Director/Assistant Town Manager
Demetric Potts, and Town Attorney Nick Herman.
Mayor Horace H. Johnson, Sr. opened the Closed Session.
Commissioner Lloyd requested to be excused from the Closed Session to visit her father
in the Hospital. By consensus, the Board agreed.
Town Attorney Nick Herman reviewed the status of the remammg Reservoir
condemnation cases with the Board.
By consensus, the Board authorized the Town Attorney to proceed with the execution of
an Agreement (including a statement of holding the Town Harmless and with a one year
warranty clause) with the Shambleys for the necessary construction work on their house
to accommodate the Reservoir project.
Upon a motion by Commissioner Sheridan, seconded by Commissioner Chavious, the
Board Authorized the Town Attorney to proceed with the Shambley case settlement as
directed by a vote of 4-0.
Upon a motion by Commissioner Chavious, seconded by Commissioner Lowen, the
Board moved to return to Open Session by a vote of 4-0. The motion was declared
