An Ordinance Related to Concept
Plan Review;
Amending Section 825.69
The city council of the city of Medi-
na ordains as follows:
SECTION I. Medina Code Section
825.69 is amended by deleting the
6443iiera material and adding the un-
derlined material as follows:
Section 825.69. Review; Resubmis-
sion.
(a) Upon receipt of application for
concept plan review, the zoning ad-
ministrator shall review the applica-
tion and make such comments or
recommendation as may be appro-
priate. The planning commission
shall feview laold a public hearing on
the concept plan after receipt of a re-
port from the zoning administrator.
Notice of the public hearing shall be
mailed by the city at least ten d•ys
prior to the date of the public hearing
to each owner of property situated
wholly or p_rlly in Medina and within
2 000 feet of the property to which
the review applies. if the applicant's
property is zoned RR. RR-1 or RR-2.
For property located in any other
zoning district notice shall be mailed
to each owner of property situatad
wholly or partly in Medina and within
1,000 feet of the grope y to which
the review applies. The presentation
to the planning commission by the
applicant shall be conducted in ac-
cordance with such procedures as
may be established by the planning
commission. The planning commis-
sion may make such comments or
recommendations regarding the con-
cept plan it deems appropriate. The
city council shall review the applica-
tion following review by the planning
commission. The presentation to the
city council by the applicant shall be
conducted in accordance with such
procedures as may be established
by the city council. The city council
may offer such comments or sugges-
tions regarding the concept plan as it
deems appropriate.
(b) An applicant may revise a con-
cept plan and submit it again for a
second review following receipt of
the city council's comments. Plan-
ning commission review of the re-
vised concept plan shall be subject
to the notice and public hearing re-
quirements of paragraph (a) above.
However, the applicant must show
considerable change from the first
concept plan, and comments re-
ceived through the first concept re-
view must be addressed prior to re-
view of a second concept plan. No
concept plan for the same or a simi-
lar project shall be accepted or re-
viewed by the city more than twice
within 12 months of the date of the
initial application.
SECTION II. This ordinance shall
become effective upon its adoption
and publication.
